Available in PDF, EPUB and Kindle. Book excerpt: The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.

Book excerpt: Originally published in 1959, and using material collected from eight languages, much of which was previously unpublished, this is a genuine comparative study, not merely describing each country separately, but an analysis of the most important questions facing 20th century public administration. A substantial historical introduction traces from Roman to modern times the concept and practice of public service and brings out the underlying unity of European experience.

Available in PDF, EPUB and Kindle. Book excerpt: The Max Planck Handbooks in European Public Law series describes and analyses the public law of the European legal space, an area that encompasses not only the law of the European Union but also the European Convention on Human Rights and, importantly, the domestic public laws of European states. Recognizing that the ongoing vertical and horizontal processes of European integration make legal comparison the task of our time for both scholars and practitioners, it aims to foster the development of a specifically European legal pluralism and to contribute to the legitimacy and efficiency of European public law. The first volume of the series begins this enterprise with an appraisal of the evolution of the state and its administration, with cross-cutting contributions and also specific country reports. While the former include, among others, treatises on historical antecedents of the concept of European public law, the development of the administrative state as such, the relationship between constitutional and administrative law, and legal conceptions of statehood, the latter focus on states and legal orders as diverse as, e.g., Spain and Hungary or Great Britain and Greece. With this, the book provides access to the systematic foundations, pivotal historic moments, and legal thought of states bound together not only by a common history but also by deep and entrenched normative ties; for the quality of the ius publicum europaeum can be no better than the common understanding European scholars and practitioners have of the law of other states. An understanding thus improved will enable them to operate with the shared skills, knowledge, and values that can bring to fruition the different processes of European integration.

Available in PDF, EPUB and Kindle. Book excerpt: Principles of French Constitutional Law offers a concise and accessible account of the key principles and rules of constitutional law in the French legal system, presenting a muchneeded up-to-date overview of this rapidly changing subject. The textbook explores the five essential pillars that underpin the teaching of constitutional law, namely the institutions, legal history, case law, comparative law, and current affairs and developments. It is split into two core sections: Part I examines the basis of French constitutional law, the theoretical developments about key notions of constitutional law such as the state and the constitution, as well as the historical background to French constitutional law. Part II provides students with an understanding of the current Fifth Republic and how constitutional rules are adopted and applied, and how they affect other areas of law and politics. It offers a critical account of the 1958 Constitution’s past, present, and future by placing it in its political and socio-historical contexts and critically assessing contemporary developments and constitutional reforms. Given the growing expansion of this branch of law in the French legal system, this book will be essential reading for anyone studying French Law, Law with French, Comparative Constitutional Law, and European Legal Studies.
