Book excerpt: In February 1997 WTO members signed the Fourth protocol, which, for the first time, determined a set of international rules for trade in basic telecommunication services. While this agreement was a major step in the direction of liberalising national telecommunication markets, many deficiencies remained. At the time, it was agreed to enter a new round of negotiations by the year 2000. However, 20 years later, as of today, the former rules are still in place without any revision. While this is rather disillusioning from a free trade perspective, progress has been made on bilateral trade agreements. One such agreement is the Comprehensive Economic and Trade Agreement (CETA) between the EU and Canada, which provisionally entered into force on 21 September 2017. CETA, that includes two Chapters affecting telecommunications markets, one on services in general and one on telecommunications services, envisages amongst others to further open up service markets to foreign companies by lifting existing market entry barriers. It is the objective of this paper to analyse whether the CETA-agreement on telecommunications services can serve as a blueprint for a future WTO accord towards multilateral trade liberalisation. In answering this question, the results of the CETA-agreement on telecommunication services will be compared with the results of the WTO accord on telecommunications services. Thereby the focus will be on the question whether CETA can serve as model for a future revision of the WTO rules in the area of telecommunications services. Is CETA a major step in the direction of further liberalising national telecommunication markets and are the regulatory provisions detailed enough to make competitive market access become reality?

Book excerpt: If one were to believe the politicians and pundits in the trade press,the world is in midst of a “telecoms revolution,” resulting from (the) deregulation and new competitive opportunities represented by the 1997 World Trade Organisation Agreement on Basic Telecommunications Services. This may be true. Unfortunately, however, the actions of many regulators and industry participants more accurately reveal not a telecoms “revolution” but instead a growing telecoms trade war that is dangerously close to spiralling out of hand. In this book, Naftel and Spiwak review U.S. and European competition and regulatory initiatives post-WTO and provide both a useful roadmap to today's U.S., EU and WTO telecoms regulation and an examination of various case studies to illustrate their points. In so doing, the authors discover unfortunately the sad reality that, despite the political rhetoric, regulators on both sides of the Atlantic have eschewed innovative and indeed productive solutions to create a market structure conducive to long-term competitive rivalry. Instead, the authors demonstrate that current policies reveal a growing cynicism towards the maximisation of consumer welfare that will be difficult - if not outright impossible- to remove.

It deals equally with general international law and WTO law. The aim is to explain how the Appellate Body interprets and applies customary international law on treaty interpretation in dealing with the WTO covered agreements. The main concern is to analyze the judicial reasoning and ways of justifying judicial decision-making. In particular, it answers the question of how the Appellate Body explains its reading of WTO treaty language. It is argued that the Appellate Body has interpreted the WTO covered agreements in a contextual and effective manner, an approach that corresponds with general international law. The character of the WTO covered agreements has, nevertheless, confronted the Appellate Body with some questions of interpretation that were until recently unexplored or neglected by other courts and tribunals. In that sense, the Appellate Body has contributed to the development of general international law on treaty interpretation, or at least to its practice. WTO law is primarily treaty law, but increasingly soft law and broader themes and values from other disciplines, such as governance, variable geometry and legitimacy, are introduced and discussed. Customary international law - with the exception of the principles of treaty interpretation - and general principles of law are often seen as excluded entirely. An ancillary theme of this proposed monograph is the extent to which customary international law and general principles of law have penetrated WTO law through the technique of treaty interpretation.
