Book excerpt: Excerpt from The War Powers of the President, Military Arrests, Reconstruction of the Union It is not denied that the powers given to the various depart ments of government are in general limited and defined; nor is it to be forgotten that the powers not delegated to the United States by the constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people. (const. Amendment, Art. X.) But the powers claimed for the President and for Congress, in this essay, are believed to be delegated to them respectively under the constitution, expressly or by neces sary implication. Military Arrests, Reconstruction & Military Government. Also, Now First Published, War Claims of Aliens with Notes on the Acts of the Executives & Legislative Departments During Our Civil War & a Collection of Cases Decided in the National Courts. 1864. Tenth edition. Boston: Little, Brown, and Company, 1864. xvii, 342 pp. Reprinted 2002 by The Lawbook Exchange, Ltd. LCCN 99-049360. ISBN 1-58477-055-4. Cloth. $80. * Whiting's writings are widely believed to have profoundly affected President Lincoln's war actions. In Whiting's legal theories regarding war powers and the abolition of slavery espoused here Lincoln found justification for the Emancipation Proclamation, and the constitutional authority to abolish slavery. Simply stated, Whiting held that the abolition of slavery is constitutionally appropriate when viewed not as the objective end of the war, but as a means to end the rebellion in order to save the republic. His writing style was geared to the average reader, and this popular style, along with the tremendous influence of his writings led to the work going through 43 editions in less than a decade. This, the tenth edition is based on his earlier work, The War Powers of the President and the Legislative Powers of Congress, in Relation to Rebellion, Treason and Slavery (1862) which is thought to have been the work that originally brought Whiting to Lincoln's attention and led to his appointment as Solicitor of the War Department. This edition includes various unpublished sensitive documents that he handled in the course of that position.

Book excerpt: Whiting's influential treatise on the constitutional limits of war powers in the United States was first published in 1862, during the Civil War. Arguing that the president can only exercise war powers in accordance with the strict limits set by the Constitution, Whiting provides a powerful defense of civil liberties and the rule of law. This book is a must-read for anyone interested in the history of American political thought and the role of the executive in times of crisis. Book excerpt: Pocket versions of the Constitution of the United States of America abound, as do multi-volume commentaries, scholarly histories of its writing, and political posturings of various clauses. But what if you want a delightfully quick, witty, and readable reference that, in one compact volume, places the document and its clauses into context? You're out of luck -- until now. Written by Seth Lipsky, described in the Boston Globe as "a legendary figure in contemporary journalism,&" The Citizen's Constitution draws on the writings of the Founders, case law from our greatest judges, and current events in more than 300 illuminating annotations. Lipsky provides a no-nonsense, entertaining, and learned guide to the fundamental questions surrounding the document that governs how we govern our country. Every American should know the Constitution. Rarely has it glinted so brightly.

Available in PDF, EPUB and Kindle. Book excerpt: This book focuses on the post-Civil War treason prosecution of Confederate President Jefferson Davis, which was seen as a test case on the major question that animated the Civil War: the constitutionality of secession. The case never went to trial because it threatened to undercut the meaning and significance of Union victory. Cynthia Nicoletti describes the interactions of the lawyers who worked on both sides of the Davis case - who saw its potential to disrupt the verdict of the battlefield against secession. In the aftermath of the Civil War, Americans engaged in a wide-ranging debate over the legitimacy and effectiveness of war as a method of legal adjudication. Instead of risking the 'wrong' outcome in the highly volatile Davis case, the Supreme Court took the opportunity to pronounce secession unconstitutional in Texas v. White (1869).
