Book excerpt: Excerpt from The Trust Company Idea and Its Development It was formerly laid down that corporations could not be trustees. The reason assigned for this rule was that they could not be compelled to execute a trust, for Courts of Equity in decreeing the execution of a trust lay hold upon the conscience, and it is impossible that a body so artificially created could have a conscience. Again, it was said they could not be imprisoned if they refused to obey the rules of the court But these technical rules have long ceased to operate, and to-day in more than one country the trust company is as firmly established as the bank. It is interesting to note how starting from a common basis, the services of executor and trustee, distinct and totally different types of trust companies have been developed in the British Colonies and the United States reflecting on the one hand the conservative British character and on the other the versatile and organizing genius of the American people. Book excerpt: Excerpt from The Making of a Trust Company: Twenty-One Years' Experience of Chicago Trust Company The town was so small and remote and hard to find that a band of enterprising promoters down at Indianapolis decided that it was entitled to a bank. Those were the happy days of Wild-catting. MO rocco was in line for a bank because it would be im possible for the general public to visit any bank at Morocco. The idea, away back yonder, was to have the banks so far away from the banking public that no one could drop in and draw out money. Book excerpt: Excerpt from The Story of the Trust Companies Trust companies are a modern development. Their literature, as revealed in the bibliography at the close of this volume, has been of limited scope, although statistics have now been avail able for some years and the legal aspects and technical methods of Operating the companies have had bestowed upon them a considerable degree of attention. The present book is intended, with an avoidance of technicalities, to sketch the beginnings and advances of the older companies, and to bring the individual narratives of a number of the largest institutions down to 1916, - a point Within one hundred years of the original announcement by an American corporation of an intention to trans act a trust business. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Modern Trust Company: Its Functions and Organization To a correspondent asking, "What book or books will best give me a working knowledge of trust company and banking methods; particularly regarding the work of the various departments of the trust companies?" the New York Evening Post recently replied that so far as it was aware no such book had been published. A search in library catalogues confirms the almost equally discouraging statement of the Chief Bibliographer of the Library of Congress that "there is not much literature on trust companies appearing in separate book form." On the other hand, much has been written about the functions, organization, and methods of the banks. The reason is easily given. The development of the "trust company idea" is a recent one, and only within the past twenty years have these corporations become a prominent factor in the financial world. Until the organization of the Trust Company Section of the American Bankers Association in 1896, the only publications in reference to trust companies were short chapters in works on banking and an occasional magazine article. Since that time the transactions of the Trust Company Section and articles in banking periodicals and the financial press have constituted the most important contributions to the subject; but in spite of all that has been written on special lines of trust company work, it is still difficult to obtain a general knowledge of what a trust company is and how it does its business. The aim of the present volume is to describe the functions and organization of the trust company as it exists in the United States to-day. Book excerpt: Excerpt from Trusts for Business Purposes In all probability no part of our law is so well settled as that in reference to trusts and trustees; a rule on this subject laid down in one section of the country is usually adopted and ap plied in another. The reason for this is readily found in that the principles underlying the trust are the same throughout the country irrespective of state lines. This of course is not true of the corporation, for each state has its own acts and no state is bound by the interpretation of the corporate law of a sister state.
