Book excerpt: It has been clear for at least 50 years the disadvantages that small businesses face in competing for U.S. government contracts. The Small Business Act of 1953 created the Small Business Administration (SBA), an independent agency in the executive branch that counsels and assists specific types of small businesses including firms owned by minorities and other socially and economically disadvantaged individuals and firms owned by women. Women-owned small businesses, however, are underrepresented or substantially underrepresented in some industries. In 2002, the SBA Office of Federal Contract Assistance for Women Business Owners (CAWBO) organized a draft study containing a preliminary set of approximations of the representation of women-owned small businesses in federal prime contracts over $25,000 by industry. Because of the past legal challenges to race- and gender-conscious contracting programs at the federal and local levels, the SBA asked the Committee on National Statistics of the National Academies to conduct an independent review of relevant data and estimation methods prior to finalizing the CAWBO study. The Steering Committee on Women-Owned Small Businesses in Federal Contracting was created and charged with holding a workshop to discuss topics including the accuracy of data and methods to estimate the use of women-owned small businesses in federal contracting and the definition of "underrepresentation" and "substantial underrepresentation" in designating industries for which preferential contracting programs might be warranted. Analyzing Information on Women-Owned Small Businesses in Federal Contracting presents the committee's report as well as the recommendations that committees have made.

In The Segregated Origins of Social Security, Mary Poole challenges that basic assumption. Meticulously reconstructing the behind-the-scenes politicking that gave birth to the 1935 Social Security Act, Poole demonstrates that segregation was built into the very foundation of the welfare state because white policy makers--both liberal and conservative--shared an interest in preserving white race privilege. Although northern white liberals were theoretically sympathetic to the plight of African Americans, Poole says, their primary aim was to save the American economy by salvaging the pride of America's "essential" white male industrial workers. The liberal framers of the Social Security Act elevated the status of Unemployment Insurance and Social Security--and the white workers they were designed to serve--by differentiating them from welfare programs, which served black workers. Revising the standard story of the racialized politics of Roosevelt's New Deal, Poole's arguments also reshape our understanding of the role of public policy in race relations in the twentieth century, laying bare the assumptions that must be challenged if we hope to put an end to racial inequality in the twenty-first.

Book excerpt: One of the most controversial topics that has been debated in the last two decades is affirmative action. In 1989, Adarand Constructors offered the lowest bid to subcontract guardrails on a Department of Transportation highway contract, but was not awarded the contract. The award instead went to a minority firm so the prime contractor could receive monetary incentives from the Goverment for subcontracting with minorities. Adarand sued the Government on the basis that the affirmative action policy violated its constitutional rights of equal protection and due process. In 1995, the U.S. Supreme Court reviewed the case and held that the level of scrutiny applied in future applications of affirmative action implementing Federal socioeconomic policy would be raised from intermediate to strict. This thesis studied the need for such programs, the history of socioeconomic policy in Federal contracting, previous Supreme Court cases challenging affirmative action, the changes resulting from the Court's Adarand decision on the Federal contracting process, and interview results exploring reaction to the decision in the small business community. The methodology provided could be used for further research and to assist agencies in making decisions about their continued use of affirmative action.

In recent years, Marshall's great truths have been challenged by proponents of originalism and strict construction. Such legal thinkers as Supreme Court Justice Antonin Scalia argue that the Constitution must be construed and applied as it was when the Framers wrote it. Book excerpt: The conventional interpretation of equality under the law singles out certain groups or classes for constitutional protection: women, racial minorities, and gays and lesbians. The United States Supreme Court calls these groups 'suspect classes'. Laws that discriminate against them are generally unconstitutional. While this is a familiar account of equal protection jurisprudence, this book argues that this approach suffers from hitherto unnoticed normative and political problems. The book elucidates a competing, extant interpretation of equal protection jurisprudence that avoids these problems. The interpretation is not concerned with suspect classes but rather with the kinds of reasons that are already inadmissible as a matter of constitutional law. This alternative approach treats the equal protection clause like any other limit on governmental power, thus allowing the Court to invalidate equality-infringing laws and policies by focusing on their justification rather than the identity group they discriminate against.
