Book excerpt: Excerpt from States Vs; Territories: A True Solution of the Territorial Question, August 15, 1860 It may perhaps relieve, to some extent at least, the writer of this article from the charge of presumption in setting forth in a formal manner his views on the important subject of the Territories of the United States, when it is considered that his opinions formerly and at the present time have been considered of sufficient importance to be the subject of comment from very respectable persons, both in public speeches and the newspaper press. It is certainly with no partisan purpose that this communication has been prepared, or is published; but the hope is, by a reference to the views and practice of the fathers, to aid in effecting a solution of this agitating and important question. Although so much has recently been said and written in relation to the territorial governments of the United States, there is one view of the subject which has not, in my opinion, been as distinctly and prominently brought forward as it deserves to be. The course which has been pursued by Congress from time to time since the adoption of the Federal Constitution, has been one of constant change and uncertainty. It has been governed by no uniform principle, and has been at all times and in every instance a manifest departure from those principles which formed the basis of the original cessions by the different States - from the views entertained by the members of the old Congress prior to the adoption of the Constitution - from the purposes and intentions of the members of the Convention which formed the Constitution - and from the manifest purport and entire scope, as well as the positive provisions of the Constitution itself. It is manifest that these arc the sources, not only to which we can best resort to learn the intentions of the early founders of the government and framers of the Constitution, but that they furnish the conclusive evidence on this subject.
