Available in PDF, EPUB and Kindle. Book excerpt: Although its concern is jurisprudence, The Tapestry of the Law is intended to offer neither an original theory of or about law nor an account of other people's theories in textbook form. It is, rather, an attempt to approach the subject without following either of these conventions. The reasons are as follows. Those engaged in legal theory are prone to assert that one cannot properly understand the law unless one takes a jurisprudential approach - preferably their own - to it. Equally, those engaged in exposition of the law may counter that legal theory fails to pay adequate attention to actual law. There is at least some truth in these claims. Analyses, courses and textbooks on both sides do often seem to be produced without reference to the other. Yet such isolation is probably more apparent than real. Most, if not all, so-called "black letter" lawyers do operate on the basis of certain jurisprudential understandings, even if these are not articulated ones. In the frequently quoted words ofF C S Northrop: There are lawyers, judges and even law professors who tell us they have no legal philosophy.

Available in PDF, EPUB and Kindle. Book excerpt: In recent years coherence theories of law and adjudication have been extremely influential in legal scholarship. These theories significantly advance the case for coherentism in law. Nonetheless, there remain a number of problems in the coherence theory in law. This ambitious new work makes the first concerted attempt to develop a coherence-based theory of legal reasoning, and in so doing addresses, or at least mitigates these problems. The book is organized in three parts. The first part provides a critical analysis of the main coherentist approaches to both normative and factual reasoning in law. The second part investigates the coherence theory in a number of fields that are relevant to law: coherence theories of epistemic justification, coherentist approaches to belief revision and theory-choice in science, coherence theories of practical and moral reasoning and coherence-based approaches to discourse interpretation. Taking this interdisciplinary analysis as a starting point, the third part develops a coherence-based model of legal reasoning. While this model builds upon the standard theory of legal reasoning, it also leads to rethinking some of the basic assumptions that characterize this theory, and suggests some lines along which it may be further developed. Thus, ultimately, the book not only improves upon the current state of coherence theory in law, but also contributes to the larger debate about how to articulate a theory of legal reasoning that results in better decision-making.

Available in PDF, EPUB and Kindle. Book excerpt: The Tapestry series continues to weave threads of fantasy, mythology, science fiction, and mystery into a wholly original adventure that appeals to fans of everything from Harry Potter to Lord of the Rings to The X-Men. Genre-blending and fully illustrated, The Tapestry novels have caught the attention of middle-grade and young adult readers alike—and the series is only getting bigger. Book One, The Hound of Rowan, was a boarding-school fantasy that School Library Journal called “a solid and worthwhile beginning . . . [that] should help ease the suffering once Harry Potter withdrawal sets in.” Book Two, The Second Siege, was an epic quest about which Kirkus Reviews said, “After devouring this title, young fans will clamor for more.” Book Three, The Fiend and the Forge, is an unforgettable dystopian adventure across a landscape overrun with goblins and trolls. The world has changed almost beyond recognition, for with the Book of Origins firmly in his possession, the villainous Astaroth now has the power to reshape history at will. Plucking pivotal discoveries from mankind’s past, he has reduced the world to a preindustrial nightmare. But while most humans toil as slaves within four demonic kingdoms, Astaroth allows those at Rowan to thrive in peaceful isolation. Theirs is a land where magic and nature flourish . . . so long as none dare oppose the new order. That proves too steep a price for Max McDaniels. Unsure of his place at Rowan, Max sets out to explore the shifting landscape of the world beyond. In the course of his travels, he will become many things: Prisoner. Gladiator. Assassin. But can he become the hero that mankind so desperately needs? In the third book of The Tapestry, author–illustrator Henry H. Neff takes the series in an exciting new direction, creating a fascinating dystopia in which myth, history, and monsters collide. Book excerpt: After assessing the strengths and weaknesses of arguments for assisted suicide and euthanasia, Gorsuch builds a nuanced, novel, and powerful moral and legal argument against legalization, one based on a principle that, surprisingly, has largely been overlooked in the debate; the idea that human life is intrinsically valuable and that intentional killing is always wrong. At the same time, the argument Gorsuch develops leaves wide latitude for individual patient autonomy and the refusal of unwanted medical treatment and life-sustaining care, permitting intervention only in cases where an intention to kill is present.

Author Maureen Longnecker knows firsthand the pain caused by these harshest of life's trials. In The Other Side of the Tapestry, Maureen recounts God's faithful love as she wrestled with the intense emotions and theological questions of her physical, mental, and spiritual journey. Offering no simple answers, Maureen weaves scriptural truths with personal experience that will encourage you to place your trust in the loving faithfulness of God, even when faced with agony and tragedy. "Maureen's story is more than a firsthand account of tragedy, trials, and turmoil. Immersed in Scripture, it is the story of a family's agonizing journey and God's unending faithfulness in life's darkest hours. Maureen reminds us that a broken heart is not healed by explanations-it's healed by God's love and the promises in His Word." -Jennifer Sands, author, speaker, and 9/11 widow

Book excerpt: “Riveting . . . American Tapestry is not only the remarkable story of the First Lady’s family, but also a microcosm of this country’s story as well.” —USA Today In this extraordinary feat of genealogical research—in the tradition of The Hemmingses of Monticello and Slaves in the Family—author Swarns, a respected Washington-based reporter for the New York Times, tells the fascinating and hitherto untold story of Ms. Obama’s black, white, and multiracial ancestors; a history that the First Lady herself did not know. At once epic, provocative, and inspiring, American Tapestry is more than a true family saga; it is an illuminating mirror in which we may all see ourselves. “The First Family becomes ever more fascinating—and ever more representative of the nation as a whole—in Rachel Swarns’s terrific investigation into the roots of Michelle Obama . . . This is a most compelling read and more evidence for our interconnectedness as a people.” —Henry Louis Gates, Jr. “Rachel Swarns has not only excavated, with painstaking care, the family tree that is Michelle Obama’s, but, with great insight and beautiful prose, has revealed the complex, eye-opening, and disconcerting experiences that are America. This is a work of impressive historical imagination and deep cultural significance.” —Steven Hahn, Pulitzer Prize-winning author “Richly detailed . . . A lushly layered portrait of the nation itself.” —The Boston Globe “A fascinating account of the First Lady’s family . . . Few important women come from such raw places. The book makes you remember why the Obamas . . . seemed so new, so implausible . . . Extraordinary.” —The New York Times

Book excerpt: Featuring international contributions from leading and emerging scholars, this innovative Research Handbook presents a panoramic view of how law sees visual art, and how visual art sees law. It resists the conventional approach to art and law as inherently dissonant – one a discipline preoccupied with rationality, certainty and objectivity; the other a creative enterprise ensconced in the imaginary and inviting multiple, unique and subjective interpretations. Blending these two distinct disciplines, this unique Research Handbook bridges the gap between art and law.

Available in PDF, EPUB and Kindle. Book excerpt: Many of the most influential contributions to private law scholarship in the latter part of the twentieth century go beyond purely doctrinal accounts of private law. A distinctive feature of these analyses is that they straddle the divide between legal philosophy, on the one hand, and the sort of traditional doctrinal analysis applied by the courts, on the other. The essays contained in this collection continue in this tradition. The collection is divided into two parts. The essays contained in the first part consider the nature of, and justification for, private rights generally. The essays in the second part address the justification for particular private law rights and doctrines. Offering insightful and innovative analyses, this collection will appeal to scholars in all fields of private law and legal theory.
