Book Synopsis 10 Years of Swiss Rules of International Arbitration - ASA Special Series No. 44 by : Nathalie Voser
Download or read book 10 Years of Swiss Rules of International Arbitration - ASA Special Series No. 44 written by Nathalie Voser and published by Juris Publishing, Inc.. This book was released on 2014-10-01 with total page 331 pages. Available in PDF, EPUB and Kindle. Book excerpt: On the occasion of the 10th anniversary of the Swiss Rules of International Arbitration, the ASA decided to devote its annual conference in January 2014 to this topic. This volume of the ASA Special Series contains the written versions of all the presentations given during this conference. Most of the contributions were based on the verbatim protocol which was prepared on the conference day and thus retain their informal speaking style. In their 10 years of existence, the Swiss Rules have established themselves as modern arbitration rules, offering a user efficient and transparent arbitral proceedings. Probably the most distinguishing feature of the Swiss Rules with regard to the administration of the cases is their "light touch" as applied by the Swiss Chambers' Arbitration Institution, reserving however a supervisory function for its Court. This volume is structured along the panels of the conference. The first panel addressed the history and the background of the Rules as well as their main characteristics. The second and the third panels explore the key features of the revised Swiss Rules, namely the consolidation and joinder provisions, the set-off and counter-claim provisions, the expedited procedure, provisional measures and the emergency arbitrator as well as provisions on confidentiality and settlement facilitation. While the fourth panel provided the insiders’ view into how the Institution administers its cases, the fifth and last panel discussed the perspectives of the users, the arbitrators and counsel as well as their experiences with the Swiss Rules.

Book Synopsis Joined-up History by : Arthur Chapman
Download or read book Joined-up History written by Arthur Chapman and published by IAP. This book was released on 2015-08-01 with total page 394 pages. Available in PDF, EPUB and Kindle. Book excerpt: Debates about the identity of school history and about the nature and purpose of the learning that does, can and should take place in history classrooms continue in many countries around the world. At issue, in many of these debates, beyond the concerns about history and national identity, are often unaddressed questions about the role and inter-relationship of historical knowledge and historical understanding in historical learning. Research on historical thinking is on-going and a complex tradition of enquiry has developed across national borders in the last 30 years, focusing, in particular on developing students understanding of historical meta-concepts such as ‘evidence’ and ‘causation’. There has been comparatively little focus, however, on the historical content that students study, on how they study it and on how mastery of historical content contributes to students overall picture of a historical past. This volume gathers together recent research and theorising from around the world on key issues central to historical learning and instruction. What sense do students make of the history that they are taught? Are students able to organise historical knowledge in order to form large scale representations of the past and what difficulties can children face in doing so? What are the relationships that obtain between history as an academic discipline, as practised in universities, and history as a subject taught in schools? What can research tell us about the effects of instructional strategies that aim to help students ‘join up’ what they learn in class into meaningful historical knowledge and understanding?

Book Synopsis Karl Barth and the Problem of War, and Other Essays on Barth by : John Howard Yoder
Download or read book Karl Barth and the Problem of War, and Other Essays on Barth written by John Howard Yoder and published by Wipf and Stock Publishers. This book was released on 2003-09-26 with total page 202 pages. Available in PDF, EPUB and Kindle. Book excerpt: A passionate opponent of Nazism, Karl Barth was required to serve in the Swiss army. At the age of 54, he helped guard the Swiss border at Basel from German intruders. Some would suggest this is all we need to know in order to understand Barth's views on Christianity and war. John Howard Yoder begged to differ. "Karl Barth and the Problem of War" is an essay in which Yoder articulates the views of his former teacher on war, these views comprising a position he refers to as "chastened non-pacifism." Through a rigorous examination of Barth's ethical method, Yoder seeks to show how the logic of Barth's basic theological commitments makes him even closer to pacifism than is often noticed. Here five additional essays, three of which have never before been published, join this long essay. These essays offer further reflections on Barth's "chastened non-pacifism," as well as offering some of Yoder's fruitful use of Barth's theology for social ethics.
