Available in PDF, EPUB and Kindle. Book excerpt: "The Contractor Fight" is what HGTV host and best-selling author Tom Reber calls the battle between your ears. We all have stories and experiences that have formed us into who we are. We are what we think, and the battleground is our mind. The Fight is not with the people you think are "cheap customers." It's not with the unlicensed competitors or the "illegals," as many contractors think. The Fight is with yourself. Sadly, most of the struggles contractors have are self-imposed. It's friendly fire. The negative ways we think about ourselves and our worth... friendly fire. The growing debt, working too much, small bank account... friendly fire. Winning the Fight is a choice. You're noble and full of integrity. You bend over backward to serve your family and clients. You have taken it on the chin more times than you can count. Now, it's time to get yours. Earn what you're worth. Create a business that serves you and energizes you, instead of one that beats you down. Choose to own your crap and get better today.

Book Synopsis Sub-Contracts DOM/1 and DOM/2 by : D. Riding
Download or read book Sub-Contracts DOM/1 and DOM/2 written by D. Riding and published by Wiley-Blackwell. This book was released on 1996-12-09 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: Much construction work is done by sub-contractors, particularly the so-called domestic sub-contractors, appointed by the main contractor. The former usually work under the standard sub-contract DOM/1 for use with JCT 80, or DOM/2 for use with JCT 81--where there is contract design. Unfortunately, many sub-contractors' rights are often abused because they have little or no understanding of their rights and obligations under the new contracts. Written by an experienced quantity surveyor, this new book provides a clause-by-clause summary of these important principles.

Book Synopsis Practical Guide to the NEC3 Engineering and Construction Contract by : Michael Rowlinson
Download or read book Practical Guide to the NEC3 Engineering and Construction Contract written by Michael Rowlinson and published by John Wiley & Sons. This book was released on 2016-05-03 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Launched in 1993, the NEC Engineering and Construction Contract has become one of the UK's leading standard forms of contract for major construction and civil engineering projects. The third edition, popularly known as NEC3, is a process based contract embodying project and commercial management best practice, so its basic philosophy differs from the more adversarial approach of other standard construction contracts. Since the first edition of this book, the third edition of the contract has seen the introduction of a new secondary option for use in the UK and amendments to a number of clauses. In addition, in September 2011, changes were introduced to cater for the amendments to the Housing Grants, Construction and Regeneration Act 1996 contained in the Local Democracy, Economic Development and Construction Act 2009, which became effective for all new contracts entered into from 1 October 2011. These amendments have been incorporated into the text. A Practical Guide to the NEC3 Engineering and Construction Contract will be useful to everyone in the construction industry working on a project under this contract. It will be of interest to the complete construction supply chain, including employers, construction professions, contractors and sub-contractors, as well as consultants and lawyers advising any of these parties, either in the preparation of contract documentation or the day to day management or the resolution of problem situations which may arise.
Book Synopsis The Law and Management of Building Subcontracts by : John McGuinness
Download or read book The Law and Management of Building Subcontracts written by John McGuinness and published by John Wiley & Sons. This book was released on 2008-04-15 with total page 560 pages. Available in PDF, EPUB and Kindle. Book excerpt: There are probably 20-25 subcontracts entered into for every major building contract. However, despite this, there are relatively few books that discuss the problems particular to the subcontract relationship between main contracts and their subcontractors. This book examines the main issues that lead to disputes between contractors and subcontractors, identifies relevant law, including decisions of the courts, and also provides a view as to how other issues might be decided. The second edition has been extensively revised to cover all the 2005 JCT subcontracts and works contracts, and recent case law. Four new chapters have been added on subcontractors selected by thrid parties; organisation of the subcontract; sub-subcontracts; and works contracts under management contracting arrangements. It draws on the author’s extensive experience of managing building subcontracts, as well as his involvement in handling over 130 adjudications.

This book was released on 2023-07-19 with total page 390 pages. Available in PDF, EPUB and Kindle. Book excerpt: Understanding and Negotiating Construction Contracts The complexities of construction contracts are made easy with this thorough and readable guide Construction contracts can be complex for both owners and contractors. For contractors, negotiating fair and balanced commercial terms in contracts is just as important as properly managing projects; a properly negotiated contract can mitigate unnecessary risk and unnecessary risk transfer. This, in turn, reduces exposure to financial liability for the contractor and for avoidance of contract claims and disputes. Understanding and Negotiating Construction Contracts provides a comprehensive and readable introduction to the world of construction contracts. Providing, for example, coverage of the four most common types of contracts—lump sum/fixed-price, cost-plus, time-and-materials, and unit-pricing—it promises to reduce uncertainty and allow contractors to enter contractual negotiations with greater confidence to be able to achieve a fair and balanced contract. This updated new edition reflects the up-to-date best practices to understand how to better negotiate the commercial terms and conditions in construction contracts. Readers of the second edition of Understanding and Negotiating Construction Contracts will also find: Updated information on indemnity, insurance, and negotiation An all-new chapter with a contract analysis checklist Real-world examples drawn from small residential, retail, large commercial, and international projects Understanding and Negotiating Construction Contracts is essential for construction professionals and college students studying construction contracts and the liabilities arising out of them.

Book Synopsis The Relationship between Main Contractors and Subcontractors in the Zambian Construction Industry by : Tafadzwa Mudzvokorwa

This book was released on 2017-07-10 with total page 150 pages. Available in PDF, EPUB and Kindle. Book excerpt: Master's Thesis from the year 2016 in the subject Engineering - Civil Engineering, University of Zambia, course: Master of Engineering Project Management, language: English, abstract: In recent years there have been a substantial number of projects conducted in the Zambian construction industry. Due to the magnitude and complexity of many of these projects, contractors have resorted to subcontracting to share responsibilities and mitigate project risks. The Zambian government has also invigorated the practice of subcontracting in the construction industry as it plays an important role in increasing economy viability and building capacity. Instead of improving project success, subcontracting can act as a catalyst for poor project outcomes. Though there are many reasons that contribute to problems from subcontracting, a poor relationship between main contractors and subcontractors can be seen as a notorious contributor affecting construction works. The study aimed at investigating the relationship between the main contractors and subcontractors in the Zambian construction industry and recommend a framework that can be implemented to better the relationship. The study also examined the effects of a poor interface between main contractors and subcontractors in Zambia. Data collection techniques used included literature review, interviews and questionnaire surveys. The relative importance index was used to determine the ranking of the results of the study. Using the results adduced from the study a main contractor-subcontractor non-contractual partnering model was developed. The study established that the relationship between main contractors and subcontractors in Zambia is poor therefore needing attention. Interface problems were caused by payment issues, poor communication, unexpected price escalations and poor construction work. In order to address interface problems, the study found that there was need for better communication between the parties, timely payments and subcontractors’ access to labour and machinery. However, the study, had some limitations that need consideration when interpreting the results found. The limitations included scarcity of specific literature on subcontracting in the Zambian construction industry, the size of the sample only being limited to Lusaka. Nevertheless, these limitations could be addressed through further studies.
