Book excerpt: The aim of each volume of this series Guides to Information Sources is to reduce the time which needs to be spent on patient searching and to recommend the best starting point and sources most likely to yield the desired information. The criteria for selection provide a way into a subject to those new to the field and assists in identifying major new or possibly unexplored sources to those who already have some acquaintance with it. The series attempts to achieve evaluation through a careful selection of sources and through the comments provided on those sources.

Book excerpt: The Continuity of Legal Systems in Theory and Practice examines a persistent and fascinating question about the continuity of legal systems: when is a legal system existing at one time the same legal system that exists at another time? The book's distinctive approach to this question is to combine abstract critical analysis of two of the most developed theories of legal systems, those of Hans Kelsen and Joseph Raz, with an evaluation of their capacity, in practice, to explain the facts, attitudes and normative standards for which they purport to account. That evaluation is undertaken by reference to Australian constitutional law and history, whose diverse and complex phenomena make it particularly apt for evaluating the theories' explanatory power. In testing whether the depiction of Australian law presented by each theory achieves an adequate 'fit' with historical facts, the book also contributes to the understanding of Australian law and legal systems between 1788 and 2001. By collating the relevant Australian materials systematically for the first time, it presents the case for reconceptualising the role of Imperial laws and institutions during the late nineteenth and early twentieth centuries, and clarifies the interrelationship between Colonial, State, Commonwealth and Imperial legal systems, both before and after Federation.

Book excerpt: Formal justice systems have not served the human rights of native and aboriginal groups well and have led to growing natural and international pressure for equal treatment and increased political and legal autonomy. Indigenous activities in areas of community healing have created a fervor of interest as native peoples have shared experiences with programs that reduce addiction, family violence, child abuse, and sociocultural disintegration of traditional communities. Through ethnographic and indigenous contributions this volume penetrates the psychosocial aspects of the indigenous movement in the United States, Canada, Australia, and New Zealand. It analyzes community-based reforms and shows how years of experience in adversity, peacemaking, and community preservation have equipped native peoples with skills they now wish to share for spiritual world healing.

All strategies that have been created to incorporate hard copy researching techniques have been updated with alternate electronic methods.Particular attention has been paid to the chapter on secondary sources, and with the maintenance of a structured approach to research, recognises that online research - with its many inherent pitfalls - must carefully fit within rules of research required by the discipline.

Available in PDF, EPUB and Kindle. Book excerpt: The migration movements of the 20th century have led to an increased interest in similarly dramatic population changes in the preceding century. The contributors to this volume - legal scholars, sociologists, political scientist and historians - focus on migration control in the 19th century, concentrating on three areas in particular: the impact of the French Revolution on the development of modern citizenship laws and on the development of new forms of migration control in France and elsewhere; the theory and practice of migration control in various European states is examined, focusing on the control of paupers, emigrants and "ordinary" travelers as well as on the interrelationship between the different administrative levels - local, regional and national - at which migration control was exercised. Finally, on the development of migration control in two countries of immigration: the United States and France. Taken altogether, these essays demonstrate conclusively that the image of the 19th century as a liberal era during which migration was unaffected by state intervention is untenable and in serious need of revision.

Available in PDF, EPUB and Kindle. Book excerpt: Palestine as a territorial entity has experienced a curious history. Until World War I, Palestine was part of the sprawling Ottoman Empire. After the war, Palestine came under the administration of Great Britain by an arrangement with the League of Nations. In 1948 Israel established itself in part of Palestine's territory, and Egypt and Jordan assumed administration of the remainder. By 1967 Israel took control of the sectors administered by Egypt and Jordan and by 1988 Palestine reasserted itself as a state. Recent years saw the international community acknowledging Palestinian statehood as it promotes the goal of two independent states, Israel and Palestine, co-existing peacefully. This book draws on evidence from the 1924 League of Nations mandate to suggest that Palestine was constituted as a state at that time. Palestine remained a state after 1948, even as its territory underwent permutation, and this book provides a detailed account of how Palestine has been recognized until the present day.

Available in PDF, EPUB and Kindle. Book excerpt: In The Legality of a Jewish State, the author traces the diplomatic history that led to the partition of Palestine in 1948 and the creation of Israel as a state. He argues that the fate of Palestine was not determined on the basis of principle, but by the failure of legality. In focusing on the lawyer-diplomats who pressed for and against a Jewish state at the United Nations, he offers an explanation of the effort in 1947-48 by Arab states at the UN to gain a legal opinion from the International Court of Justice about partition and the declaration of a Jewish state. Their arguments at that time may surprise a twenty-first-century reader, touching on issues that are still at the heart of the contemporary conflict in the Middle East.
