Book excerpt: The Spirit of the Laws is, without question, one of the central texts in the history of eighteenth-century thought, yet there has been no complete, scholarly English-language edition since that of Thomas Nugent, published in 1750. This lucid translation renders Montesquieu's problematic text newly accessible to a fresh generation of students, helping them to understand quite why Montesquieu was such an important figure in the early enlightenment and why The Spirit of the Laws was, for example, such an influence upon those who framed the American constitution. Fully annotated, this edition focuses attention upon Montesquieu's use of sources and his text as a whole, rather than upon those opening passages towards which critical energies have traditionally been devoted, and a select bibliography and chronology are provided for those coming to Montesquieu's work for the first time.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Spirit of Our Laws A great many people take an interest in the law without being lawyers or litigants or specialists of any sort. They like to understand something of what is going on around them, and for their law they have to trust to snatches from the newspapers. Though, possibly, both writer and reader are well-educated persons, the exact point or points on which the report turns is almost certain to be missed, for neither has any training to catch it. Hence the frequent exclamation, I can't understand this case; however could such a decision have been arrived at? And, of course, the bewilderment is greater where there is any desire even to scratch beneath the surface. Yet between the formal study of the law and the perusal of the daily newspaper there is no satisfaction for the amateur reader, better, perhaps, known as the general reader. A professed lawyer, of course, would not dream of trusting an ordinary newspaper report (with a few exceptions) for practical purposes, even for his own guidance; for he requires at least a certain degree of accuracy, and may require the highest. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Liquor Laws of the United States: Their Spirit and Effect The liquor trafic, in all its bearings upon the moral and social condition of man, has recently been made the subject of methodical enquiries in very many European countries, and a mass of extremely valuable material has already been and is still being gathered there for the purpose of establishing a seien tific basis for future legislation. Similar efforts are at present being made in the United States, and it is to be hoped that fairness, impartiality, and an unselfish regard for the welfare of the Whole country may guide them. This book is offered as an unpretending contribution to these efforts. It claims no merit save that of strictest truthfulness in the representation of the spirit and effect of the liquor laws of this country. The nature of its subject-matter required a separation of the laws enacted by Congress from those enacted by the legislatures of the States. The former laws are reviewed in the present volume; the latter will form the subject of another volume. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. This book was released on 2010-05-15 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Spirit of the Laws—Montesquieu’s huge, complex, and enormously influential work—is considered one of the central texts of the Enlightenment, laying the foundation for the liberally democratic political regimes that were to embody its values. In his penetrating analysis, Thomas L. Pangle brilliantly argues that the inherently theological project of Enlightenment liberalism is made more clearly—and more consequentially— in Spirit than in any other work. In a probing and careful reading, Pangle shows how Montesquieu believed that rationalism, through the influence of liberal institutions and the spread of commercial culture, would secularize human affairs. At the same time, Pangle uncovers Montesquieu’s views about the origins of humanity’s religious impulse and his confidence that political and economic security would make people less likely to sacrifice worldly well-being for otherworldly hopes. With the interest in the theological aspects of political theory and practice showing no signs of diminishing, this book is a timely and insightful contribution to one of the key achievements of Enlightenment thought.

Book excerpt: Excerpt from The Spirit of the Common Law HE dartmouth alumni lectureships have been established upon the theory that the influence of the intellectual life of the Col lege ought to be available, in some degree at least, to others than those who are in residence as students, - as for example, to graduates who are solicitous for some contact with the College which will help to maintain the breadth of their scholarship; or to friends who are interested in the kinds of intellectual interest for which the College wishes to stand. The suggestion of the particular form which the project of these lectureships has taken was made in my inaugural address in 1916 when statement was made as follows. Available in PDF, EPUB and Kindle. Book excerpt: There is a law of healing so plain that even a child can understand it, so fundamental that the ablest mind has never yet thought through all the facts and phenomena of life that rest upon it. It is the purpose of this book to make this law plain. The greatest power in the world is the power of thought, for it is Creative Mind in action. Nothing exists that did not first exist in thought from the first sun that blazed only in the Mind of the Creator, to the last doll-dress fashioned by a childish hand. Science supports the fact that the first movement in nature can have come only from the application of an immaterial force or Will to the primary etheric particles otherwise in a perfect state of equilibrium. It must leave to metaphysics not only an explanation of the Will that moves but also the substance that is moved. This, then, it is the province of this book to show with all that it entails. Since an act of Will is an act of mind, we concern ourselves with the activity of a Creative Mind. Again since Mind acts creatively, there is a way in which it acts. We must also, therefore, teach the way. It is to teach this way that the Bible was written, that Jesus lived and taught. This way has been known for many centuries but has always been taught in terms of the understanding of the day in which the teacher lived. The Great Metaphysician taught largely in parables and oriental figures of speech. But He taught "the Way" and his followers were called the People of the Way.

Pangle brings to light Montesquieu's rethinking of the philosophical groundwork of liberalism, showing how The Spirit of the Laws enlarges and enriches the liberal conception of natural right by means of a new appeal to History as the source of basic norms.

By paying careful attention to the historical, political, and philosophical contexts of Montesquieu's ideas, the contributors provide fresh readings of The Spirit of Laws, clarify the goals and ambitions of its author, and point out the pertinence of his thinking to the problems of our world today.

As John Owen Haley traces the features of contemporary Japanese law and its principal actors, distinctive patterns emerge. Of these none is more ubiquitous than what he refers to as the law's "communitarian orientation." While most westerners may view judges as Japanese law's least significant actors, Haley argues that they have the last word because their interpretations of constitution and codes define the authority and powers they and others hold. Based on a "sense of society," the judiciary confirms bonds of village, family, and firm, and "abuse of rights" and "good faith" similarly affirms community. The Spirit of Japanese Law concludes with constitutional cases that help explain the endurance of community in contemporary Japan.
