Book excerpt: There is a clear need to better understand the relationship between two concepts at the heart of peacebuilding: the Rule of Law (RoL), and Security Sector Reform (SSR). If it is acknowledged in principle that they are interdependent, in practice enduring conceptual ambiguities and contradictions undermine latent synergies. As a consequence, international donor agencies are under increasing pressure to demonstrate the benefits of their RoL and SSR assistance. This SSR Paper moves the RoL-SSR debate forward through examining these activities jointly within a peacebuilding context. It proposes a heuristic framework that helps to rationalize this relationship on a conceptual level, demonstrating that RoL and SSR are interdependent and mutually reinforcing. The resulting framework provides a basis for the development of coherent policies that can support the development of coordinated, complementary programmes on the ground.

They both reflect a conceptualization of security that is not limited to the level of the state, but takes into account security threats and needs at societal and individual levels. This common basis provides opportunities for synergies between SSR and mine action. However, empirical evidence demonstrates that the strong conceptual basis is not fully reflected in concrete activities, and the linkages remain limited and underexplored. Despite this gap, there are positive examples showing the potential for synergies between SSR and mine action. Ultimately, this paper maintains that the concept of human security provides a comprehensive framework which can bridge the differences and open broader opportunities for cooperation, which in turn will increase the impact of interventions in SSR and mine action.

Book excerpt: Since the end of the Cold War almost all European countries have reformed their armed forces, focusing on downsizing, internationalization and professionalization. This paper examines how these changes in security sector governance have affected the normative model underlying the military’s relationship to democracy, using the image of the “democratic soldier”. Drawing on a comparative analysis of 12 post-socialist, traditional and consolidated democracies in Europe, the different dimensions of the national conception of soldiering are analysed based on the official norms that define a country’s military and the ways in which individual members of the armed forces see their role. Cases converge around the new idea of professional soldiering as a merging of civilian skills with military virtues in the context of the military’s new post-Cold War missions. Yet despite this convergence, research also shows that specific aspects of national traditions and context continue to influence the actual practice of soldiering in each case. The contradictions that result between these old and new visions of the role of the military and the soldier illustrate the tensions that exist between political goals and defence reform dynamics.

Book excerpt: A groundbreaking comparative analysis of three understudied cases of intelligence democratization revealing new insights into main barriers to reform when states transition from authoritarianism Reforming the intelligence services is essential when a state transitions from authoritarianism to democracy. But which areas should be reformed, how do we know when there has been real transformation, and how and where do authoritarian legacies persist? Intelligence in Democratic Transitions is a comparative examination of the democratic transitions of Portugal, Greece, and Spain starting in the 1970s. Although these three countries began their transitions around the same time, they present significantly different results. Sofia Tzamarelou discovers that main barriers to reform are legacies of the past and legacy personnel. She does this through the lens of five Security Sector Reform (SSR) indicators: Lustration, Control and Oversight, Recruitment, Targeting and Civil Society. Tzamarelou uses primary sources throughout the study, including governmental documents and legal statutes–such as draft laws, bills and presidential decrees–paired with “outside” primary source reporting, such as analysis reporting by the CIA. She complements this rich primary source material with secondary sources from authors in each country and internationally who specialize in intelligence or who provide historical context. Tzamarelou’s unique comparative analysis of intelligence democratization using a common framework–SSR–applied to each country contributes to readers’ understanding of why and how some reforms fail and others succeed and how the SSR framework can be used in the intelligence arena.

Using examples from Latin America and Europe, it examines the impact of democracy promotion and how the economy, civil society, rule of law, crime, corruption and mass media affect the success or otherwise of achieving democratic control and oversight of intelligence. The volume draws on two main intellectual and political themes: intelligence studies, which is now developing rapidly from its original base in North America and UK; and democratisation studies of the changes taking place in former authoritarian regimes since the mid-1980s including security sector reform. Book excerpt: This book situates Ghana's truth-telling process, which took place from 2002 to 2004, within the discourse on the effectiveness of the different mechanisms used by post-conflict and post-dictatorship societies to address gross human rights violations. The National Reconciliation Commission was the most comprehensive transitional justice mechanism employed during Ghana's transitional process in addition to amnesties, reparations and minimal institutional reforms. Due to a blanket amnesty that derailed all prospects of resorting to judicial mechanisms to address gross human rights violations, the commission was established as an alternative to prosecutions. Against this background, the author undertakes a holistic assessment of the National Reconciliation Commission's features, mandate, procedure and aftermath to ascertain the loopholes in Ghana's transitional process. She defines criteria for the assessment, which can be utilised with some modifications to assess the impact of other transitional justice mechanisms. Furthermore, she also reflects on the options and possible setbacks for future attempts to address the gaps in the mechanisms utilised. With a detailed account of the human rights violations perpetrated in Ghana from 1957 to 1993, this volume of the International Criminal Justice Series provides a useful insight into the factors that shape the outcomes of transitional justice processes. Given its combination of normative, comparative and empirical approaches, the book will be useful to academics, students, practitioners and policy makers by fostering their understanding of the implications of the different features of truth commissions, the methods for assessing transitional justice mechanisms, and the different factors to consider when designing mechanisms to address gross human rights violations in the aftermath of a conflict or dictatorship.
