Book excerpt: The book explores the rise of civil divorce in Victorian England, the subsequent operation of a fault system of divorce based solely on the ground of adultery, and the eventual piecemeal repeal of the Victorian-era divorce law during the Interwar years. The legal history of the Matrimonial Causes Act 1857 is at the heart of the book. The Act had a transformative impact on English law and society by introducing a secular judicial system of civil divorce. This swept aside the old system of divorce that was only obtainable from the House of Lords and inadvertently led to the creation of the modern family justice system. The book argues that only through understanding the legal doctrine in its wider cultural, political, religious, and social context is it possible to fully analyse and assess the changes brought about by the Act. The major developments included the end of any pretence of the indissolubility of marriage, the statutory enshrinement of a double standard based on gender in the grounds for divorce, and the growth of divorce across all spectrums of English society. The Act was a product of political and legal compromise between conservative forces resisting the legal introduction of civil divorce and the reformers, who demanded married women receive equal access to the grounds of divorce. Changing attitudes towards divorce that began in the Edwardian period led to a gradual rejection of Victorian moral values and the repeal of the Act after 80 years of existence in the Interwar years. The book will be a valuable resource for academics and researchers with an interest in legal history, family law, and Victorian studies.

Available in PDF, EPUB and Kindle. Book excerpt: The diverse violence of modern Britain is hardly new. The Britain of 1850 to 1950 was similarly afflicted. The book is divided into four parts. 'Getting Hurt' which looks at everyday violence in the home (including a chapter on infanticide). 'Uses and Rejections' two chapters on the use of violence within groups of men and women outside the home (for example, violence within youth gangs, and male violence centred around pubs). 'Going Public' three chapters on how violence was regulated by law and the professional agencies which were set up to deal with it. 'Perceptions and Representations' this final section looks at how violence was written about, using both fiction and non-fiction sources. Throughout the book the recurring themes of gender, class, continuity and change, public/private, and experience, discourses and representations are highlighted.

Book excerpt: The Edwardian Turn of Mind brilliantly evokes the cultural temper of an age. The years between the death of Queen Victoria and the outbreak of the First World War witnessed a turbulent and dramatic struggle between the old and the new. Samuel Hynes considers the principal areas of conflict - politics, science, the arts and the relations between men and women - and fills them with a wide-ranging cast of characters: Tories, Liberals and Socialists, artists and reformers, psychoanalysts and psychic researchers, sexologists, suffragettes and censors. His book is a portrait of a tumultuous time - out of which contemporary England was made.

Book excerpt: Divorce is a conspicuous character trait of modernity, commonly portrayed in texts and on screen, with its moral and social rationalisation firmly rooted in Enlightenment and Romantic thought. The aim of this volume is to bring into focus this contemporary cultural fascination by assembling the variety of academic responses it has started to create. Bringing together the reflections of scholars from the UK and North America who have worked in this domain, this study offers for the first time a genuinely wide-ranging account of the depiction of divorce across the northern hemisphere in a number of media (fiction, journalism, film and television). It reaches historically from the intellectual and legal aftermath of the Enlightenment right up to the present day. As such, the collection shows both the roots of this apparently contemporary phenomenon in nineteenth-century literary practice and the very particular ways in which divorce characterises the different narrative media of modernity.

Available in PDF, EPUB and Kindle. Book excerpt: Women's Legal Landmarks commemorates the centenary of women's admission in 1919 to the legal profession in the UK and Ireland by identifying key legal landmarks in women's legal history. Over 80 authors write about landmarks that represent a significant achievement or turning point in women's engagement with law and law reform. The landmarks cover a wide range of topics, including matrimonial property, the right to vote, prostitution, surrogacy and assisted reproduction, rape, domestic violence, FGM, equal pay, abortion, image-based sexual abuse, and the ordination of women bishops, as well as the life stories of women who were the first to undertake key legal roles and positions. Together the landmarks offer a scholarly intervention in the recovery of women's lost history and in the development of methodology of feminist legal history as well as a demonstration of women's agency and activism in the achievement of law reform and justice.

Available in PDF, EPUB and Kindle. Book excerpt: First published in 1977, this book is a companion volume to Suffer and Be Still. It looks at the widening sphere of women’s activities in the Victorian age and testifies to the dual nature of the legal and social constraints of the period: on the one hand, the ideal of the perfect lady and the restrictive laws governing marriage and property posed limits to women’s independence; on the other hand, some Victorian women chose to live lives of great variety and complexity. By uncovering new data and reinterpreting old, the contributors in this volume debunk some of the myths surrounding the Victorian woman and alter stereotypes on which many of today’s social customs are based.
