Fitzgerald, aka TFitz, is a software engineer who has found himself involved in his fair share of police interactions: good and bad. This guide is the culmination of those events. TFitz offers a no holds barred view in regards to any sort of interaction with law enforcement, and offers practical advice to help you when the time comes. At 20 years old, his residence was surrounded by jump-out boys, claiming probable cause for a search after illegally entering the home’s curtilage and smelling marijuana. He was told later, an informant claimed dope was being cooked there. They left with nothing but a few people in handcuffs and a small amount of marijuana. At 23 he was pulled over for improper lane usage. Sober, yet refused to blow. Much money and time later, he was found not guilty of any charges. That night the arresting officer had broken the record for number of DUI arrests. Currently he is doing all he can to fight for the most important person in his life, his son. He is an outstanding father & role model, and there is nothing in the world he wouldn’t do to protect Zeke (his son). He has been awaiting trial for 1.5 years on false accusations of domestic violence. During that time he has met many others who have family members currently jailed over lies and others’ abuses of our legal system. He is doing his part to help change that with the organization Women Against False Accusations. If you are interested, search TFitz on YouTube; he’ll be there. Please send prayers and love to all.

These officers observe driving behaviors of DUI drivers, respond to 911 calls and accidents, observe the physical appearances and mannerisms of DUI drivers, administer field sobriety tests to drivers, and ultimately must decide whether the driver is under the influence of alcohol or drugs. The complexity of these tasks under difficult conditions requires the law enforcement officer to make many decisions that will affect the individual being investigated and ultimately the case against this person. Therefore the decisions made by the officer must only be based on a thorough and well crafted investigation. This book details the DUI investigation process from the initial observations of driving, the first contact with the driver, and the administration of field sobriety tests. This book takes an objective view of the DUI investigation process and what law enforcement must do to properly and ethically proceed with each phase of the DUI investigation. This book is a must for every DUI law enforcement officer and any individual in the field of DUI, including prosecutors and defense attorneys.

Available in PDF, EPUB and Kindle. Book excerpt: Alcohol, Drugs, and Impaired Driving addresses many theoretical and practical issues related to the role played by alcohol and other psychoactive drugs on driving performance, road-traffic safety, and public health. Several key forensic issues are involved in the enforcement of laws regulating driving under the influence of alcohol and/or other drugs, including analytical toxicology, pharmacology of drug action, as well as the relationships between dose taken, concentration levels in the body, and impairment of performance and behavior. Our knowledge of drunken driving is much more comprehensive than drugged driving, so a large part of this book is devoted to alcohol impairment, as well as impairment caused by use of drugs other than alcohol. For convenience, the book is divided into four main sections. The first section gives some historical background about measuring alcohol in blood and breath as evidence for the prosecution of traffic offenders. The important role of the Breathalyzer instrument in traffic-law enforcement, especially in Australia, Canada, and the USA is presented along with a biographical sketch of its inventor (Professor Robert F. Borkenstein of Indiana University) with focus on the man, his work and his impact. The second section discusses several issues related to forensic blood and breath-alcohol alcohol analysis as evidence for prosecution of traffic offenders. This includes how the results should be interpreted in relation to impairment and an evaluation of common defense challenges. Because most countries have adopted concentration per se laws, the main thrust of the prosecution case is the suspect’s measured blood- or breath-alcohol concentration. This legal framework necessitates that the analytical methods used are "fit for purpose" and are subjected to rigorous quality assurance procedures. The third section gives a broad overview of the current state of knowledge about driving under the influence of non-alcohol drugs in various countries. This includes adoption of zero-tolerance laws, concentration per se statutes, and clinical evidence of driver impairment based on field sobriety tests and drug recognition expert evidence. The fourth section deals with epidemiology, enforcement, and countermeasures aimed at reducing the threat of drunken and drugged driving. All articles have appeared previously in the international journal Forensic Science Review, but all are completely updated with current data, references, and the latest research on developments since the articles were published. This book contains a convenient collection of the best articles covering recommendations for blood and breath testing methods, public policy relating to such methods, and forensic and legal implications of the enforcement of measures to counter driving under the influence.

Officers will learn the verbal and non-verbal methods that are most effective for enhancing credibility, and study examples of cross-examination in real cases. Points made in the sections on report writing and how to improve as a witness are essential to the officer who may be called to the witness stand repeatedly over a career.
