Book excerpt: Excerpt from Reconstruction Claims of the Inhabitants of the States Engaged in the Rebellion to Restoration of Political Rights and Privileges Under the Constitution The question of the day with the people of the United States - and none of graver moment ever agitated the public mind - is that concerning the claims of the inhabitants of the several States, recently in open rebellion against the national Government, to be re-admitted to the exercise of the personal and corporate political powers and franchises which they enjoyed under the Constitution before they made war upon the Union in order to accomplish its destruction. That, by reason of that rebellion and its suppression, those who were parties to it forfeited their rights, as individual citizens, to property, liberty, and life, of which they could at any time be deprived by due process of law, and to which they could be restored only by the pardon of the Government, no one who does not justify the rebellion denies. Book excerpt: Excerpt from The New Constitution In times prosperous at home and peaceful abroad, the people of England have not desired of their rulers any change in the system of their representation. In domestic distress, or with foreign revolution, on the contrary, the clamour for such an experiment has been usually raised, but has hitherto been silenced by patient firmness on the part of the government. During last November, these two stimulants combined to produce in the country an unusual agitation: but the accession of the Whigs to office soothed the excitement, the gentry with the middle classes quieted the disorders of the southern counties, and the Belgic revolution threw fresh employment into the manufacturing towns. Available in PDF, EPUB and Kindle. Book excerpt: The U.S. Constitution found in school textbooks and under glass in Washington is not the one enforced today by the Supreme Court. In Restoring the Lost Constitution, Randy Barnett argues that since the nation's founding, but especially since the 1930s, the courts have been cutting holes in the original Constitution and its amendments to eliminate the parts that protect liberty from the power of government. From the Commerce Clause, to the Necessary and Proper Clause, to the Ninth and Tenth Amendments, to the Privileges or Immunities Clause of the Fourteenth Amendment, the Supreme Court has rendered each of these provisions toothless. In the process, the written Constitution has been lost. Barnett establishes the original meaning of these lost clauses and offers a practical way to restore them to their central role in constraining government: adopting a "presumption of liberty" to give the benefit of the doubt to citizens when laws restrict their rightful exercises of liberty. He also provides a new, realistic and philosophically rigorous theory of constitutional legitimacy that justifies both interpreting the Constitution according to its original meaning and, where that meaning is vague or open-ended, construing it so as to better protect the rights retained by the people. As clearly argued as it is insightful and provocative, Restoring the Lost Constitution forcefully disputes the conventional wisdom, posing a powerful challenge to which others must now respond. This updated edition features an afterword with further reflections on individual popular sovereignty, originalist interpretation, judicial engagement, and the gravitational force that original meaning has exerted on the Supreme Court in several recent cases.

Book excerpt: Excerpt from The Story of the Constitution of the United States Whatever may be the form of government, in the last analysis the people are the sovereigns, and the exercise of sovereignty goes with a majority of the military power. For if there is an absolute or hereditary ruler, he is so because a majority of the people, or a majority of the arms-bearers, have chosen that he shall be, or because they submit to his continuance. Whenever thev are agreed to have it otherwise, his reign comes to an end, no matter if his empire and his prescriptive rights be a thousand years old. They may execute him, as they executed Charles I and Louis XVI or they may simply depose him as they deposed Dom Pedro II of Brazil. They may or may not be wise in doing this, and may or may not be fortunate m their new government; but the sovereignty resides in them, and they have ex ercised it. When they have enthroned a king, he may call himself a sovereign, and speak of them as his subj ects - and in theory they are such - but in fact he is their servant, and if the service is bad they will not accept it forever. If they prescribe limits to his powers, that prescription of limits, as far as it goes, is a constitution. It is common to speak of his giving them a constitution, but instead it is they that give one to him, for it is only by their sufierance that he is on the throne at all, and usually it is be cause he has been made to realize this that he gra ciously grants the people a constitution. Book excerpt: Excerpt from Reconstruction and the Constitution 1866-1876 In my preface to "The Middle Period" I wrote that the re-establishment of a real national brotherhood between the North and the South could be attained only on the basis of a sincere and genuine acknowledgment by the South that secession was an error as well as a failure. I come now to supplement this contention with the proposition that a corresponding acknowledgment on the part of the North in regard to Reconstruction between 1866 and 1876 is equally necessary. In making this demand, I must not be understood as questioning in the slightest degree the sincerity of the North in the main purpose of the Reconstruction policy of that period. On the other hand, I maintain that that purpose was entirely praiseworthy. It was simply to secure the civil rights of the newly emancipated race, and to re-establish loyal Commonwealths in the South. But there is now little question that erroneous means were chosen. Two ways were open for the attainment of the end sought. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Yet what urgency has been alleged by its movers for this headlong proposal? The more moderate - it must be added, the least firm of mind - have been swayed probably by the rooted mistake of the party which they have joined, that by granting all that is asked. Book excerpt: Excerpt from Disunion and Restoration in Tennessee It claimed the constitutional right to abolish slavery in the District of Columbia, the forts, arsenals, dock-yards, and other places ceded to the United States within the bounds of the slaveholding States. It proposed a prohibition of the slave-trade between the States, thereby crowding the slaves together, and preventing the exit south until they became unprofitable to such an extent that it would force the owner finally to abandon them in self-defence. It has, by the deliberate legislative enactments of a large majority of the Northern States, openly and flagrantly nullified the clause of the Constitution which provided for the return of fugitive slaves. Book excerpt: Excerpt from Commentaries on the Constitution of the United States, Vol. 2 of 3: With a Preliminary Review of the Constitutional History of the Colonies and States, Before the Adoption of the Constitution These dangers, by the division ofthe legislative andjudicial functions, are in this country effectually provided against. Parliament knows not the individuals, upon whom its acts will operate it has no cases or par ties before it; no private designs to serve: consequently, its resolutions will be suggested by the consideration of universal effects and tenden cies, which always produce impartial, and commonly advantageous regu lations. Vtnlaws are made, courts ofjustice, whatever he the dispo sition of the judges, must abide by them; for the legislative being necessarily the supreme power of the state, the judicial and every other power is accountable to that: and it. Cannot be doubted, that the persons, who possess the sovereign authority Of government, will be tenacious of the laws, which they themselves prescribe, and sufficiently jealous of the assumption of dispensing and legislative power by any others.
