Book excerpt: Excerpt from The Reform of the English Land System IN discussing the Reform of the English Land System, we have to consider how far it may be expedient to modify that System, either in the special interest of agriculture, or in the general interest of social and political well-being. But we cannot hope to form a just conception of the English Land System as it ought to be, without having a practical knowledge of the English Land System as it is that is, of those distinctive and typical features which characterise it among the Land Systems of the world. Such a study is especially interesting at the present moment, when the Irish Land System has just been subjected to radical changes, and when the English Land System itself has been placed on its trial, not only by the progress of democratic ideas, but also by the inevitable effect of agricultural depression, the severest and the most prolonged which has occurred within living memory. Book excerpt: Excerpt from English Land and English Landlords: An Enquiry Into the Origin and Character of the English Land System, With Proposals for Its Reform; With in Index The present volume treats of the historical growth, the distinctive features, and the prospective development, of the English Land System. It does not purport to deal with the Scotch or Irish land systems, in so far as they differ from the English, except where these differences may be significant, for purposes of illustration. Nor does it purport to describe fully the land systems of foreign countries, though I have thought it well to introduce a concise review of the more important among these, in order to exhibit in stronger relief the unique character of the agrarian constitution established in England by the joint operation of Law and Custom. The peculiar essence of that constitution is to be found in the marked separation of the agricultural community into three classes - landlords, farmers, and labourers. Of these classes, the first is at once the most powerful, and the most typical product of the English Land System. I have, therefore, associated "English Land" with "English Landlords," in the title of a work chiefly designed to set forth the reciprocal influence of social and agricultural relations in the past, the present, and the future. Book excerpt: Excerpt from The English Land Laws: Being an Account of Their History, Present Features and Proposed Reforms The Land Question is one which before very long must hold the foremost rank in the line Of English politics. It is a question which materially affects the well-being of our working population generally: but it must be Of more Special interest to those Of the rural districts, - to those two millions - who, by reason Of their late political enfranchisement, have become a power in the state which neither party can afford to despise. They are no longer compelled to Obey laws in the making of which they have had no voice: and legislation concerning the soil they till is no longer at the mercy of those whose interest it was to make laws for the benefit of a class and to maintain the unjust privileges of a landed aristocracy. The Agricultural Labourers are now indeed responsible citizens of a great country, - responsible because they at last form part Of that democracy into whose hands we have placed the destinies of England. And if the great questions of the day are clearly placed before them, at any crisis of our nation's history, I do not think we Shall ever have reason to doubt the wisdom or the patriotism Of their decision. Book excerpt: Excerpt from The Reform of the English Land System The following Essay is, in the main, a popular abridgment of those chapters in my own treatise, entitled "English Land and English Landlords," which deal with the reforms to be effected in the English system of Land Tenure and Land Tenancy. One of these reforms has been partially carried out by Lord Cairns' Settled Estates Act, but reasons are here given for regarding that Act, however beneficial, as no more than a tentative adjustment of a question which must needs be ultimately settled on broader principles. In the discussion of Tenant Right, liberal quotations have been made from an article contributed by me to Fraser's Magazine of February, 1882. Book excerpt: Excerpt from The English Land The modern system of farming, properly carried out, requires considerable capital, varying in amount according to the nature of the land occupied and the live stock it is capable of carrying. Large purchases have annually to be made of Oil-cake, corn, and other feeding stuffs, for producing beef and mutton costly manures have to be bought for raising roots and green crops to be consumed by the animals. The money expended on these substances often amounts to more than the rent of the farm. Then there is the purchase and maintenance of expensive machinery, and above all the labour bill, which Often exceeds in amount the rent paid. Book excerpt: Excerpt from Land Tenure by Registration This is the one relic of the Feudal System which has survived all changes of dynasty and Of govern ment, and though grievously overshadowed and be clouded, it still remains a living fact, a Vindication and assertion Of the ownership by the nation of all the land lying within its jurisdiction as a nation. Did no such fact exist, that right of ownership is established by natural law, for no nation can exist without land as a basis upon which to establish and develop that edifice Of social order which constitutes a nation. In the eleventh century william the norman crossed the sea with some steel-clad robbers at his back, and established himself in this fair land of England. Now William was a notable fighting man and a great soldier, but more especially was he distinguished as a statesman. Upon the rude basis of the communal tenures of the anglo-saxons he raised up his feudal system, a magnificent system according to the ideas at that time current. It remains to apply the same system to indexing statutory and specific liens on land required to be filed in the offices of the County Clerks of New York and Kings, according to mv original plan, and to supplement the whole of the indexing work by the adoption of other reforms calculated to improve its efficiency for the purpose for which it was designed, namely, to facilitate, cheapen and make more secure the trans fer of land. Book excerpt: Excerpt from Reform of the Land Laws; Conservation of National Resources: Extracts From Recommendations of the President, the Secretary of the Interior, and the Commissioner of the General Land Office, Etc The boundaries of the national forest reserves unavoidably include certain valuable timber lands not owned by the Government. Im portant among them are the land grants of various railroads. For more than two years negotiations with the land-grant railroads have been in progress looking toward an arrangement by_ which the forest on railroad lands within national forest reserves may be preserved by the removal of the present crop of timber under rules prescribed by the Forest Service, and its perpetuation may be assured by the trans fer of the land to the Government without cost. The advantage of web an arrangement to the Government lies in the acquisition of lands whose protection is necessary to the general welfare. The advantage to the railroads is found in the proposal to allow them to. Consolidate their holdings of timber within forest reserves by ex? Change after deeding their lands to the Government and thus to out within a limited time solid bodies of timber instead of alternate eetions, although the amount of timber in each case would be the same. It is possible that legislation will be required to authorize this or a similar arrangement with the railroads and other owners. If so. I recommend that it be enacted.
