Book excerpt: This dataset contains data about case records created between 1859-1959 in the Massachusetts Superior Court (and its predecessors) for two Massachusetts counties. Part 1 contains data for 1,952 criminal cases with 52 descriptive variables, including : type of crime, year crime was committed, pleas, sentences, appeals, size of file, and demographic characteristics of victim and defendant (e.g., gender, status, residence, and occupation). Eighteen variables describe and rate each case's historical interest. Part 2 contains data on 1,968 civil (law, equity, and divorce) cases, with 82 descriptive variables, such as : relationship between parties, type of complaint, relief sought, disposition, relief granted, number of claims, damages awarded, size of file, and demographic characteristics of plaintiff and defendant (e.g., gender, status, residence, and occupation). Ten variables describe and rate each case's historical interest. In both fichiers, criteria for historical interest coding include : (1) inherent interest, such as offenses that are not routine (e.g., white-collar crimes, sexual crimes, and serious felonies), parties who are inherently interesting (e.g., famous persons, institutional defendants, and law enforcement personnel), and legal proceedings that are inherently interesting (e.g., alleged violations of prosecutorial or judicial discretion), (2) contexts that are inherently interesting, and (3) extraordinary documentation, such as those that shed light on the legal system (e.g., pardons or letters from citizens' committees), shed light on social history (e.g., the testimony of a woman who moved to the city and inadvertently ended up in a brothel), provide legal/procedural information (e.g., the details of search or a technical challenge to an indictment), and describe public or political history (e.g., milk inspection or zoning laws) ... Book excerpt: Until the late 20th century, ‘an archive’ generally meant a repository for documents, as well as the generic name for the wide range of documents the repository might hold. An archive could be visited, and then also searched, to discover past actions or lives that had meaning for the present. While historians and historiographers have long understood the contests that archives contain and represent, the very idea of ‘the archive’ has, over the last 40 years, become the subject and object of widening and intensified consideration. This consideration has been intellectual (from scholars in a wide range of disciplines) and public (from communities and individuals whose stories are held captive, or sometimes hidden or excluded from official archives), as well as institutional. It has involved scrutiny and critique of official archives’ limitations and practices, as well as symbolic, affective and theoretical expansion and heightened expectation of what ‘the archive’ is or should be. The very language of ‘the archive’ now carries freight as administrative practice, normative value, metaphor, description and aspiration in different ways than it did in the 20th century. This collection offers a unique contribution to these reinvigorated and sometimes new conversations about what an archive might be, what it can do as a consequence, and to whom it bears custodial responsibilities. In particular, this collection addresses what it means for contemporary Australian superior courts of record to not only have constitutional and procedural duties to documents as a matter of law, but also to acknowledge obligations to care for those materials in a way that understands their public meaning and public value for the Australian people, in the past, in the present and for the future.

Book excerpt: During the formative years of the American republic, lawyers and architects, both eager to secure public affirmation of their professional status, worked together to create specialized, purpose-built courthouses to replace the informal judicial settings in which trials took place during the colonial era. In From Tavern to Courthouse, Martha J. McNamara addresses this fundamental redefinition of civic space in Massachusetts. Professional collaboration, she argues, benefitted both lawyers and architects, as it reinforced their desire to be perceived as trained specialists solely concerned with promoting the public good. These courthouses, now reserved exclusively for legal proceedings and occupying specialized locations in the town plans represented a new vision for the design, organization, and function of civic space. McNamara shows how courthouse spaces were refined to reflect the increasingly professionalized judicial system and particularly to accommodate the rapidly growing participation of lawyers in legal proceedings. In following this evolution of judicial space from taverns and town houses to monumental courthouse complexes, she discusses the construction of Boston's first civic building, the 1658 Town House, and its significance for colonial law and commerce; the rise of professionally trained lawyers through the seventeenth and eighteenth centuries; and changes in judicial rituals at the turn of the century and development of specialized judicial landscapes. A case study of three courthouses built in Essex County between 1785 and 1805, delineates these changes as they unfold in one county over a thirty year period. Concise and clearly written, From Tavern to Courthouse reveals the processes by which architects and lawyers crafted new judicial spaces to provide a specialized, exclusive venue in which lawyers could articulate their professional status.
