Book Synopsis Is Administrative Law Unlawful? by : Philip Hamburger
Download or read book Is Administrative Law Unlawful? written by Philip Hamburger and published by University of Chicago Press. This book was released on 2014-05-27 with total page 646 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Hamburger argues persuasively that America has overlaid its constitutional system with a form of governance that is both alien and dangerous.” —Law and Politics Book Review While the federal government traditionally could constrain liberty only through acts of Congress and the courts, the executive branch has increasingly come to control Americans through its own administrative rules and adjudication, thus raising disturbing questions about the effect of this sort of state power on American government and society. With Is Administrative Law Unlawful?, Philip Hamburger answers this question in the affirmative, offering a revisionist account of administrative law. Rather than accepting it as a novel power necessitated by modern society, he locates its origins in the medieval and early modern English tradition of royal prerogative. Then he traces resistance to administrative law from the Middle Ages to the present. Medieval parliaments periodically tried to confine the Crown to governing through regular law, but the most effective response was the seventeenth-century development of English constitutional law, which concluded that the government could rule only through the law of the land and the courts, not through administrative edicts. Although the US Constitution pursued this conclusion even more vigorously, administrative power reemerged in the Progressive and New Deal Eras. Since then, Hamburger argues, administrative law has returned American government and society to precisely the sort of consolidated or absolute power that the US Constitution—and constitutions in general—were designed to prevent. With a clear yet many-layered argument that draws on history, law, and legal thought, Is Administrative Law Unlawful? reveals administrative law to be not a benign, natural outgrowth of contemporary government but a pernicious—and profoundly unlawful—return to dangerous pre-constitutional absolutism.

Available in PDF, EPUB and Kindle. Book excerpt: This is the first book that directly addresses the cultural history of the legal profession. An international team of scholars canvasses wide-ranging issues concerning the culture of the legal profession and the wider cultural significance of lawyers, including consideration of the relation to cultural processes of state formation and colonisation. The essays describe and analyse significant aspects of the cultural history of the legal profession in England, Canada, Australia, France, Germany, Italy, Sweden, Switzerland, Norway and Finland. The book seeks to understand the complex ways in which lawyers were imaginatively and institutionally constructed, and their larger cultural significance. It illustrates both the diversity and the potential of a cultural approach to lawyers in history. Book Synopsis The Political Worlds of Women by : Sarah Richardson
Download or read book The Political Worlds of Women written by Sarah Richardson and published by Routledge. This book was released on 2013-03-05 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: Traditional analyses of nineteenth-century politics have assigned women a peripheral role. By adopting a broader interpretation of political participation, the author identifies how middle-class women were able to contribute to political affairs in the nineteenth century. Examining the contribution that women made to British political life in the period 1800-1870 stimulates debates about gender and politics, the nature of authority and the definition of political culture. This volume examines female engagement in both traditional and unconventional political arenas, including female sociability, salons, child-rearing and education, health, consumption, religious reform and nationalism. Richardson focuses on middle-class women’s social, cultural, intellectual and political authority, as implemented by a range of public figures and lesser-known campaigners. The activists discussed and their varying political, economic and religious backgrounds will demonstrate the significance of female interventions in shaping the political culture of the period and beyond.

Book Synopsis Sir Edward Coke and the Reformation of the Laws by : David Chan Smith
Download or read book Sir Edward Coke and the Reformation of the Laws written by David Chan Smith and published by Cambridge University Press. This book was released on 2014-11-06 with total page 311 pages. Available in PDF, EPUB and Kindle. Book excerpt: Throughout his early career, Sir Edward Coke joined many of his contemporaries in his concern about the uncertainty of the common law. Coke attributed this uncertainty to the ignorance and entrepreneurship of practitioners, litigants, and other users of legal power whose actions eroded confidence in the law. Working to limit their behaviours, Coke also simultaneously sought to strengthen royal authority and the Reformation settlement. Yet the tensions in his thought led him into conflict with James I, who had accepted many of the criticisms of the common law. Sir Edward Coke and the Reformation of the Laws reframes the origins of Coke's legal thought within the context of law reform and provides a new interpretation of his early career, the development of his legal thought, and the path from royalism to opposition in the turbulent decades leading up to the English civil wars.

Download or read book Islandology written by Marc Shell and published by Stanford University Press. This book was released on 2014-10-08 with total page 386 pages. Available in PDF, EPUB and Kindle. Book excerpt: Islandology is a fast-paced, fact-filled comparative essay in critical topography and cultural geography that cuts across different cultures and argues for a world of islands. The book explores the logical consequences of geographic place for the development of philosophy and the study of limits (Greece) and for the establishment of North Sea democracy (England and Iceland), explains the location of military hot-spots and great cities (Hormuz and Manhattan), and sheds new light on dozens of world-historical productions whose motivating islandic aspect has not heretofore been recognized (Shakespeare's Hamlet and Wagner's Ring of the Nibelung). Written by Shell in view of the melting of the world's great ice islands, Islandology shows not only new ways that we think about islands but also why and how we think by means of them.
