Book excerpt: This article reviews the development of American poor law from 1790 to 1820. Because poor law was primarily state based, the main focus is on the laws of ten states that joined the U.S. during this time: Vermont, Kentucky, Tennessee, Ohio, Louisiana, Indiana, Mississippi, Illinois, Alabama, and Maine. English poor law continued to impact the development of state poor relief law, but legislative experiences in other states began to exert significant influence as well. Work remained the cure for poverty. Poor people who could work were to do so. Poor children were expected to labor and were often apprenticed. Poor adults were put to work in workhouses and poorhouses, or jailed as vagrants. State laws of this period continue to reflect a strong theme that punishing and stigmatizing the non-working poor would prod them to work and thus cure their poverty.

Book excerpt: Only edition. The author of the standard English justice of the peace manual of the eighteenth century, Burn was also the author of a law dictionary and important treatises on ecclesiastical and poor law. 'The [History of Poor Laws] is a history, an account of the various proposals made at different periods for the reform of the poor law, and the author's own proposals for the reform both of the poor law and of some other branches of the jurisdiction of the justices of the peace. Like Burn's other works, it is a clear and well arranged account of the subjects with which it deals; but it is more valuable as a criticism, by an exceptionally competent critic, of the defects of the law in his own day, than as a history.'

ISBN 1-58477-354-5. Cloth $70. * Reprint of first edition. Parry [1863-1953] was an English municipal judge for over twenty years. His book, a guide for "the man in the street," which began as a series of newspaper articles, outlines the laws concerning insolvency, debt and poverty. It is distinguished by its emphasis on cultural attitudes toward the poor, and its readability and humanity. Parry's was among the strong voices to speak in sympathy to the poor in response to the Poor Law Amendment Act which had been enacted in 1834. "Judge Parry is particularly gifted with that rare imagination which enables him to see mortal men and women where others see cases, litigants, and parties before the courts. Hence his volume is a rare document, especially useful as a corrective to the tendency to lose sight of actual living conditions in the logical pursuit of abstract legal doctrines." Cohen, Law and Social Order cited in Marke, A Catalogue of the Law Collection at New York University (1953) 810.
