Book excerpt: Excerpt from Four Hundred Million Acres: The Public Lands and Resources The Federal Government has assumed many new responsibilities since Lincoln's time, and will probably assume more in the future when the States and local communities can not alone cure abuse or bear the en tire cost of national programs, but there is an essential principle that should be maintained in these matters. I am convinced that where Federal action is essential then in most cases it should limit its responsibilities to supplement the States and local communities, and that it should not assume the major role or the entire responsibility, in replacement of the States or local government. To do otherwise threatens the whole foundation of local government, which is the very basis of self-government. Book excerpt: Excerpt from The Public Lands: Studies in the History of the Public Domain The vast and intricate story of the creation and expansion of the public domain, the administration, distribution, and management of federal lands, runs from 1776 to the present. But the ideas and values that controlled these matters lay partly in the American colonial past, partly in legal and other institutions imported from England and the Continent. Colonial experience and needs had by the time of the Revolution created different systems for obtaining legal posses sion of land, and for describing and recording titles in the separate colonies, but in one important respect the differences between the Virginia, Pennsylvania, and Massachusetts systems, for example, were superficial. Men wanted and Obtained individual ownership of land, and although they may never have heard of Blackstone, what they did illustrates his declaration that There is nothing which so generally strikes the imagination and engages the affections of mankind, as the right of property; or that sole and despotic dominion which one man claims and exercises over the external things of the world, to the total exclusion of the right of any other individual in the universe. It was understood and accepted that a set of words upon parchment served to convey dominion on land, or at least that it should. Book excerpt: Excerpt from The Political and Sectional Influence of the Public Lands, 1828 1842 The revenue attitude toward the public domain continued in the older sections, but its force was weakened by the growth of the West. The decided change in favor of the actual settler was shown) in 1820 by the passage of a general relief act, by the reduction in price from two dollars to one dollar and a quarter an acre, and by the reduction of the minimum unit from one hundred and sixty acres to eighty acres. The Western Senators made a resolute effort to gain at this time, what was a great desire of the pioneers, a gen eral preemption law, which would give every squatter the oppor tunity to buy one hundred and sixty acres surrounding his cabin and improvements up to two weeks before the beginning Of land sales in each district.3 The administration of the land system, however, still adhered too strongly to the revenue idea to per mit the sale of the choicest land at the minimum price to the law breaking pioneers. 4 Special laws dealing with individual cases and areas continued in increased numbers until 1830, when the public attitude toward the actual settler had so far changed as to allow the enactment of a general law, but even this was limited in term and retrospective in character. Book excerpt: Excerpt from Report of the Public Lands Commission, 1905: With Appendix In December, 1903, there were two sales of timber upon the ceded portion Of the Chippewa Indian Reservation in Minnesota. At the first sale, on December 5, the timber upon acres sold for an average price of per acre. At the second sale, on December 28, 95 per cent of the timber upon acres sold for an average price of per acre. The amounts to be received from the various purchases are calculated upon the estimated amount of timber upon the land at a stated price per thousand feet, board measure, but the payments will be based upon an actual scale of the logs when cut. Logging operations now in progress indicate that more than the estimated amount of timber will be cut from these lands. It will be observed that but 95 per cent of the timber was sold at the last sale, the remaining 5 per cent being reserved for reforestation.
