Book excerpt: The study was requested in order to assist the Commission in assessing the scope for updating and clarifying Annex IV of the Professional Qualifications Directive 2005/36/EC, which mainly relates to activities in the craft, commerce and industry sectors. The specific study aims were to: - Provide a comprehensive inventory of those professions that are regulated in EU Member States and that are deemed to pursue activities listed in the existing Annex IV; - Compare the current list of activities in Annex IV of the Professional Qualifications Directive 2005/36/EC ("PQD") that use ISIC (1958) and NICE industrial classification codes (1958) with the latest revised ISIC Rev. 4 2008 and the NACE Rev. 2 2008 classification codes; - Explore the extent to which (and how) it might be necessary to simplify and update Annex IV under the current comitology procedure, in accordance with Article 20 of the PQD; - Assess the possible impact of the updating and modernisation of the list of activities in Annex IV using the newly revised classifications (e.g. legal certainty by providing greater clarity for certain regulated professions). The study scope was Directive 2005/36/EC and the recent Commission proposal to modernise the Directive was excluded. Article 20 of the current Directive defines the conditions under which the Commission can adapt the list of activities in Annex IV. It allows the Commission to take measures under the comitology procedure with a view to updating or clarifying the scope of activities covered as defined through industrial classifications. The proposed measures should not however involve changes to activities related to individual categories within Annex IV (Lists 1, 2 and 3). The Commission will use the study's results as the basis for a discussion to update Annex IV so that it better reflects economic activities currently pursued in the Member States and to clarify the professions eligible for automatic recognition. The study's geographic scope was EU27 but for the inventory, where appropriate, regulated professions falling within Annex IV's scope were also included from Croatia, EEA and EFTA countries
