It is that criminals may take advantage of the plea of insanity to secure acquittal or commitment to a hospital instead of to a prison. The necessity, therefore, of protecting the prisoner on one hand and of protecting society on the other has introduced marked changes in modern law and methods of practice in the courts of civi lized countries. We are obliged to ask to-day whether the prisoner was sane when the act with which he is charged was committed. At least we are obliged to meet this question whenever it is raised. He may have been sane when the act was committed and be insane at the time of his trial, or he may have been insane when the act was committed though sane at the time of trial, or he may become insane after he is convicted and sentenced and while serving his term in prison. The irresponsibility of the prisoner thus creates a new responsibility for society. It is the responsibility, first, of determining whether an accused person is or was mentally diseased, and then of deciding what form of treatment the person shall receive. It may be acquittal if his recovery and harmlessness are beyond doubt, or it may be committal to a hospital or to a Special asylum for the criminal insane. The preliminary issue was tried in April, 1865, in the county where the Offence was committed, and occupied five days. The difficulty of Obtaining an unbiased jury on that occa sion, grew, in consequence of the increased publicity and agitation of the matter, into an impossibility of doing so on the trial of the main issue, compounded of both the guilt and the insanity. To try this, the whole panel Of jurors summoned was first exhausted, and then the whole jury list of the county; and out of the whole three hundred or thereabouts, not twelve men could be found, who were not excluded either by peremptory challenges, or for confessed or presumed bias. It was therefore determined to try the case in Cortland county. Both trials were before Justice Mason, of the Supreme Court, now of the Court of Appeals. The government appeared by Cochrane, Attorney General, on the pre liminary issue, and by Martindale, his successor, on the main issue, assisted by Mr. Wilson, District Attorney of Tompkins county, on both. We have had in early times the punishment of numerous innocent insane persons; in later times a revulsion of feeling in favor of insanity as an excuse of crime; then a reaction against the improper use of this plea; and with each ebb and flow of popular feeling, guilty men have escaped and innocent men have suffered. I wish here at the outset to disclaim all sympathy with the excessive and injurious benevolence which sees in all crimes, only the misfortunes and not the fault of their perpetrators, and inveighs against the present defects of society as the res ponsible agency. It may well be that the fatal snare of evil inheritance and environment makes criminals in many instances what they are, and that with the external conditions reversed, the relative position of the criminal and the executioner of the law would also be reversed; but the vicious and de structive influences which would annihilate all order and all progress, can only be met by stern repression and control. It is true that society has a duty toward the criminal beyond simply immuring him where he can do no harm; but swift and certain punishment is also an essential part of' that duty, and the direction in which progress is to be made is (let) in the more careful adjustment of the penalty to the measure of responsibility; (2d) in the judicious introduction of agencies within the prison which will carefully foster whatever there may be left of right-mindedness in the individual criminal.
