Book excerpt: Them Before Us has flipped the script on adult-centric attitudes toward marriage, parenthood, and reproductive technologies by framing these issues around a child’s right to be raised by both their mother and father. Set against a backdrop of sound research, the compelling stories throughout each chapter confirm that a child’s mental, physical, and emotional well-being depends on being loved by the two people responsible for their existence. It’s a paradigm shift that will impact the personal and the political, and reframe every marriage and family conversation across the globe. Them Before Us dispels many prevalent, harmful myths concerning children’s rights, such as: • Kids need only love and safety—moms and dads are optional. • Love makes a family—biology is irrelevant. • Marriage is about adults—it has nothing to do with kids. • Children are resilient and will “get over” divorce. • Studies show “no difference” in outcomes for kids with same-sex parents. • Sperm and egg donor kids are fortunate because they are so wanted. • Surrogacy is a great way to help wannabe parents have a baby. • Reproductive technologies are just like adoption. Are you tired of a culture that views adults as victims in family matters, when it’s clear that kids are the ones who truly pay the price? If so, we are your people, and this is your movement.

Book excerpt: The discovery of the Babatha archive provided scholars with unique opportunities for reconstructing the life of Jews in second-century Arabia. Although legal issues and especially the question of the relationship between Roman and local law have received attention in a number of publications, this study presents the first complete overview of the legal situation as presented in the Babatha as well as the Salome Komaise archive, using references to law in the documents' texts as the key element for understanding what law is applicable to these documents. By distinguishing between two levels in the papyri, of substantive and of formal law, a new understanding is reached of the part both Roman and local law played in legal reality.

Available in PDF, EPUB and Kindle. Book excerpt: The Oxford Handbook of Fiduciary Law provides a comprehensive overview of critical topics in fiduciary law and theory through chapters authored by leading scholars. The Handbook opens with surveys of the many fields of law in which fiduciary duties arise, including agency law, trust law, corporate law, pension law, bankruptcy law, family law, employment law, legal representation, health care, and international law. Drawing on these surveys, the Handbook offers a synthetic analysis of fiduciary law's key concepts and principles. Chapters in the Handbook explore the defining features of fiduciary relationships, clarify the distinctive fiduciary duties that arise in these relationships, and identify the remedies available for breach of fiduciary duties. The volume also provides numerous comparative perspectives on fiduciary law from eminent legal historians and from scholars with deep expertise in a diverse array of the world's legal systems. Finally, the Handbook lays the groundwork for future research on fiduciary law and theory by highlighting cross-cutting themes, identifying persistent theoretical and practical challenges, and exploring how the field could be enriched through empirical analysis and interdisciplinary insights from economics, philosophy, and psychology. Unparalleled in its breadth and depth of coverage, The Oxford Handbook of Fiduciary Law represents an invaluable resource for practitioners, policymakers, scholars, and students in this essential field of law.

But homeschooling children at high school level strikes fear into even the most dedicated of homeschoolers. They need information and answers to their questions. And with the current educational and unemployment problems in South Africa, young people need clear direction and guidance to help them achieve their goals. In addition to exploring the popular ways to gaining a recognised matric certificate outside the formal school system, Homeschooling High School also challenges readers to rethink their values, particularly the value they place on certification, and to consider some unconventional or alternative paths to success. In a clearly presented format, the book includes advice on legal matters, identifying appropriate courses, sourcing study material, tips on entrepreneurship, financing tertiary studies and the testimonies of successful homeshooled graduates. Homeschooling High School is a comprehensive guide to plotting a path through high school and beyond.

Available in PDF, EPUB and Kindle. Book excerpt: Children's rights law is a relatively young but rapidly developing discipline. The U.N. Convention on the Rights of the Child, the field's core legal instrument, is the most widely ratified human rights treaty in history. Yet, like children themselves, children's rights are often relegated to the margins in mainstream legal, political, and other discourses, despite their application to approximately one-third of the world's population and every human being's first stages of life. Now thirty years old, the Convention on the Rights of the Child (CRC) signalled a definitive shift in the way that children are viewed and understood--from passive objects subsumed within the family to full human beings with a distinct set of rights. Although the CRC and other children's rights law have spurred positive changes in law, policies, and attitudes toward children in numerous countries, implementation remains a work in progress. We have reached a state in the evolution of children's rights in which we need more critical evaluation and assessment of the CRC and the large body of children's rights law and policy that this treaty has inspired. We have moved from conceptualizing and adopting legislation to focusing on implementation and making the content of children's rights meaningful in the lives of all children. This book provides a critical evaluation and assessment of children's rights law, including the CRC. With contributions from leading scholars and practitioners from around the world, it aims to elucidate the content of children's rights law, explore the complexities of implementation, and identify critical challenges and opportunities for children's rights law.

Available in PDF, EPUB and Kindle. Book excerpt: Despair over the reported inadequacies of public education leads many people to consider religious schools as an alternative. James G. Dwyer demonstrates, however, that religious schooling is almost completely unregulated and that common pedagogical practices in fundamentalist Christian and Catholic schools may be damaging to children. He presents evidence of excessive restriction of children's basic liberties, stifling of intellectual development, the instilling of dogmatic and intolerant attitudes, as well as the infliction of psychological and emotional harms, including excessive guilt and repression and, especially among girls, diminished self-esteem. Courts, legal and political theorists, and the public typically argue that families and religious communities are entitled to raise their children as they see fit and that the state must remain neutral on religious matters. Dwyer proposes an alternative framework for state policy regarding religious schooling and other child-rearing practices, urging that the focus always be on what is best, from a secular perspective, for the affected children. He argues that the children who attend religious schools have a right to adequate state regulation and oversight of their education. States are obligated to ensure that such schools do not engage in harmful practices and that they provide their students with the training necessary for pursuit of a broad range of careers and for full citizenship in a pluralistic, democratic society.
