Book excerpt: Excerpt from The Origin of Property in Land April, 1889 It seemed especially suitable for translation'; since it presented in a comparatively brief compass all the main arguments of that great historian against the various attempts which have been made to support the theory Of primitive agrarian communism by an appeal to historical records. The translation has been made with the consent of Madame Fustel de Coulanges; and it has benefited by the suggestions of M. Guiraud, an old pupil of the author, and now Charge de Cours at the Sorbonne. The presentation of the Essay in an English dress has been deemed a suitable occasion to estimate the bearing of its arguments on early English social history, and to review in the light of it the evidence now accessible as to the origin of the English manor. Book excerpt: Excerpt from The Community of Property: Nationalization of Land I think a few considerations may be not out of place at present, on that scheme of the hour which, in laudable aspiration for the extinction of all human want, would propose to realize at last the equality of mankind through that community of property that Plato fabled. It is a big subject, and I do not propose new to do more than break ground on it, with a few remarks as well on general principles as on what the newspapers make salient at present. In these, for example, I read three or four days ago the report of a speech by Mr Henry George. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Right of Property and the Ownership of Land Social science seeks to understand the laws of the structure of human society with a view to use its knowledge for the increase of human welfare. Man's nature is so complex that social science has difficultly in grasping all its phases. It has again and again found itself in error, because it has omitted some essential phase of society, in computing the elements of a social problem. In this session of our Congress, we have already discussed the importance of a complete inventory of the topics that lie within the province of Social Science. We must comprehend the scope of the whole, and be able to make clear to ourselves by a definition the essential items in our general survey. We must discover one by one, all the elements that condition the problem of society, and learn to keep them in view when we seek an answer to any given question. We are all aware of the dismal failure of political economy to explain the phenomena of wealth and poverty as an isolated province of human welfare. Man is a property-using animal, indeed, but this definition does not exhaust the nature of man. For man has three other provinces of activity equally essential. He reproduces his race by the institution of the family and sets up a process of compensation for the inequalities of sex, age, and other limitations of individuality, such as disease and personal peculiarities. Property and its production, exchange, distribution and consumption demand a social combination which we call the community or civil society, an institution quite distinct from the family. Nevertheless there can be no science of the community if the family is ignored. For the entire structure of the community or civil society must be conformed to the essential requirements of the family. Book excerpt: Excerpt from An Introduction to the History of the Law of Real Property: With Original Authorities My object in undertaking tins work was to attempt in some degree to supply a want which at present greatly impedes the study of English law at the Universities. There is no really elementary work on the English law of real property adapted for students who have not and may never have any practical experience in the working of the law. Almost all elementary books have been written from the professional rather than the educational point of view; excellent as many of them are as introductions to a practical knowledge of law, they are scarcely available for purposes of legal education at an University. Blackstone's treatise stands almost alone in adequately satisfying both demands. It has been the fashion of late to dwell on the defects rather than on the merits of that great work, and there are obvious reasons why it is hardly adapted to the requirements of the present time. Nevertheless Blackstone still remains unrivalled as an expositor of the law of his day. Throughout the following pages his work is referred to as at once the most available, and the most trustworthy authority on the law of the eighteenth century. In considering the mode in which the elementary principles of the important branch of English law, which is the subject of this treatise, can best be dealt with, there can be little question that it is necessary to begin by sketching the history and development of rights over land. As he was a man of pure taste, and naturally much more inclined to criticism than assent, his approval gave me pleasure. But being a man also very honest and outspoken, he took care to explain that his approval was not unqualified. He liked the whole book except one chapter, in which, he added, it seems to me there is a good deal of nonsense. Book excerpt: Excerpt from Property: Its Origin and Development MY inspiration for this book, as for earlier volumes, has been drawn from that fruitful method which alone, I believe, can throw light upon sociological origins: I Speak of the ethnographic method, which consists in looking upon existing inferior races as living representatives of our primitive ancestors. I am not here concerned to justify this method of treatment. It is the very basis of evolutionary socio logy, since it allows us to study (to visu the series of social stages swallowed up in the gulf of the past. By its help the most distant ages rise again in flesh and blood; by the most scientific Of incantations the past becomes the present, and the Observer can simultaneously criticise the successive phases through which civilised peoples have taken chronological cycles to pass. Whatever fresh sociological question may be approached, it thus becomes possible to study all its historic and prehistoric links, to embrace, at a glance, the slow strivings of humanity, and call up a spectacle of striking interest. Book excerpt: Excerpt from The Public Lands: Studies in the History of the Public Domain The vast and intricate story of the creation and expansion of the public domain, the administration, distribution, and management of federal lands, runs from 1776 to the present. But the ideas and values that controlled these matters lay partly in the American colonial past, partly in legal and other institutions imported from England and the Continent. Colonial experience and needs had by the time of the Revolution created different systems for obtaining legal posses sion of land, and for describing and recording titles in the separate colonies, but in one important respect the differences between the Virginia, Pennsylvania, and Massachusetts systems, for example, were superficial. Men wanted and Obtained individual ownership of land, and although they may never have heard of Blackstone, what they did illustrates his declaration that There is nothing which so generally strikes the imagination and engages the affections of mankind, as the right of property; or that sole and despotic dominion which one man claims and exercises over the external things of the world, to the total exclusion of the right of any other individual in the universe. It was understood and accepted that a set of words upon parchment served to convey dominion on land, or at least that it should. Book excerpt: Excerpt from The History of Landholding in England This work is an expansion of a paper read at the meeting of the Royal Historical Society in May 1875, and will be published in the volume of the Transactions of that body. But as it is an expensive work, and only accessible to the Fellows of that Society, and as the subject is one which is now engaging a good deal of public consideration, I have thought it desirable to place it within the reach of those who may not have access to the larger and more expensive work. I am aware that much might be added to the information it contains, and I possess materials which would have more than doubled its size, but I have endeavoured to seize upon the salient points, and to express my views as concisely as possible. I have also preferred giving the exact words of important Acts of Parliament to any description of their objects. If this little essay adds any information upon a subject of much public interest, and contributes to the just settlement of a very important question, I shall consider my labour has not been in vain. Book excerpt: Excerpt from English Land and English Landlords: An Enquiry Into the Origin and Character of the English Land System, With Proposals for Its Reform; With in Index The present volume treats of the historical growth, the distinctive features, and the prospective development, of the English Land System. It does not purport to deal with the Scotch or Irish land systems, in so far as they differ from the English, except where these differences may be significant, for purposes of illustration. Nor does it purport to describe fully the land systems of foreign countries, though I have thought it well to introduce a concise review of the more important among these, in order to exhibit in stronger relief the unique character of the agrarian constitution established in England by the joint operation of Law and Custom. The peculiar essence of that constitution is to be found in the marked separation of the agricultural community into three classes - landlords, farmers, and labourers. Of these classes, the first is at once the most powerful, and the most typical product of the English Land System. I have, therefore, associated "English Land" with "English Landlords," in the title of a work chiefly designed to set forth the reciprocal influence of social and agricultural relations in the past, the present, and the future.
