Rather than see law and new governance as oppositional projects, Mark Dawson argues that new governance can be seen as an example of legal 'transformation', in which soft norms and hard law institutions begin to cohabit and interact. He charts this transformation by analysing the Open Method of Coordination (OMC) for Social Inclusion and Protection. While this process illustrates some of the concrete advantages for EU social policy which new governance has brought, it also illustrates their extensive legitimacy challenges. Methods like the OMC have both excluded traditional institutions, such as Courts and Parliaments, and altered the boundaries of domestic constitutional frameworks. The book concludes with some practical suggestions for how a political 'constitutionalisation' of new governance could look.

In this context OMC was presented as the most appropriate policy tool towards achieving an economic and social “revival”. Since its introduction the OMC has gained momentum in European policy-making because many areas previously falling under the exclusive competence of the member states (MS) are now tackled at the European level. Although the OMC was originally designed to foster a problem-solving approach in the area of employment, it has now expanded to include the fields of social exclusion, immigration, pensions and education.

In addition, it shows how the reform materializes and is translated in everyday working life among professors and managers in higher education. It examines the so-called Open Method of Coordination as a powerful actor that uses “soft governance” to advance transnational standards in higher education. The book shows how these standards no longer serve as tools for what were once human organizational, national or international, regulators. Instead, the standards have become regulators themselves – the faceless masters of higher education. By exploring this, the book reveals the close connections between the Bologna Process and the EU regarding regulative and monitoring techniques such as standardizations and comparisons, which are carried out through the Open Method of Coordination. It suggests that the Bologna Process works as a subtle means to circumvent the EU’s subsidiarity principle, making it possible to accomplish a European governance of higher education despite the fact that education falls outside EU’s legislative reach. The book’s research interest in translation processes, agency and power relations among policy actors positions it in studies on policy transfer, policy borrowing and globalization. However, different from conventional approaches, this study draws on additional interpretive frameworks such as new materialism.

Although it remains uncontested that integration has brought a long period of stability and economic growth to the region, questions have increasingly been raised about the democratic legitimacy of the EU rule. After all, members of the most important Community Institutions are not democratically elected for the tasks they carry out and methods of policy-making are often too complicated for being traced by the public. There is one policy area which has a very direct effect on citizens’ lives and which is more and more concerned by integration: social policy. This is why it is preferred to other areas which would of course also have been suitable to serve as a concrete example in this investigation. In consideration of the facts that the settings of European welfare states are too diverse to find a one-fits-all solution, and that national leaders have been reluctant to cede this policy area to the supranational level, a new method has progressively been applied to the different fields of social policy: the Open Method of Co-ordination (OMC), a very prominent example of multi-level and multi-actor governance. At first, guidelines - which are not legally binding - are passed by the Council. Their implementation is then completely left to the member states. Important features of this method include the identification of best practices in member states, benchmarking and peer review. In 2000, the Commission, aware of a growing distrust of the citizens towards the EU, decided to initiate a governance reform, setting out five principles of good governance to be observed in EU policy making: transparency, participation, accountability, effectiveness and coherence. This paper will outline the processes of OMC and, referring to different stages of the policy chain, examine the question to what extent the OMC as applied in social policies meets these criteria at this stage and where there is still a need for improvement.

Through incorporation of iterative benchmarking processes to assess progress in achieving the objectives set forth by the EU on the national level, mutual learning among member states and mobilization of actors across many levels – EU, national and sub-national levels – the OMC represented a novel approach to governance in the EU. Because the environment in which the OMC is applied, the multiple actors it involves across multiple levels, as well as the challenge of correctly placing it among other soft-law measures and the existing tool set of the EU institutions the literature in OMC research is equally complex. Contributions to OMC research emanate from many researchers across different fields of science, such as economists, legal scholars, sociologists and political scientists that have brought forth analyses looking at the topic from various angles. These include the OMC as a New Mode of Governance, a form of Policy Learning and Europeanisation and as a motor of European Integration. Taking this complexity into account and given the limited ability of this specific type of essay it seems necessary to concentrate on a few specific aspects. This work will thus limit its time frame – from the implementation of the Lisbon Strategy in 2000 until the overhaul it received with the introduction of ‘Europe 2020’ in 2010 at most – and discuss the case of the United Kingdom (UK) with regard to the possible impact the OMC has had on social policy and the way in which different levels of government and non-government actors have been involved. Today, for example, a highly developed body of law regulates equal treatment in social security and co-ordinates national security schemes; national health services have opened up to patients and service providers from other states; and rules govern the translation of educational and vocational certificates across member states. This state of affairs is all the more remarkable given the relatively limited resources at the EU's disposal and the initial intentions of its founders. During negotiations for the Treaty of Rome in the 1950s, social policy was viewed as the exclusive provenance of the member states. There were to be provisions to facilitate labour mobility within the common market, but until the 1970s social policy making at the EU-level was modest. However, plans for the internal market moved social policy on the EU's decision-making agenda. The Social Chapter was adopted in 1989, and the Single European Act expanded EU competencies in social policy. The Treaties of Maastricht, Amsterdam and Nice all expanded competencies further, so that by the time the heads of government met in Lisbon in 2007 to sign the EU's latest treaty, the extent of supranational control over important aspects of social policy making was quite impressive. This important book provides a full account of the evolution of social policy in the EU and of its current reach. It examines the reasons for the increased role of the EU in the area, in spite of formidable obstacles, and details its effects in member states, where social provision is often the biggest item in government budgets and a crucial issue in national elections. Drawing on research done on welfare states around the world and on European integration, this book provides a distinctive and sophisticated account of social policy in Europe, showing how it must now be understood in the context of multi-level governance in which EU institutions play a pivotal role.
