Book excerpt: Excerpt from The Ontario Weekly Reporter and Index-Digest, 1912, Vol. 21: January-April, 1912 It is said that the original will indicated a scheme in the mind of the testator that each of his sons should receive per sonal estate to the extent of and the distribution of the residue in proportion to that sum, and that this scheme will be' disturbed if the provisions of the codicils as re peets Henry Alfred and David John Hunter are given effect to. It may be that the testator when making the disposi tions contained in the original will had some such design in view, but it is evident that if he had it was based upon a view of all the provisions he had then made. But the first codicil introduced at once a change, not only as respects David John, to whom lands had been given, but as respects Henry Alfred, to whom no lands and nothing except had been given by the original will. If the testator had desired to preserve the proportions mentioned in the original will he could easily have done so by a process similar to that-used in the case of W. H. Earl Hunter. The appeal should be allowed and it should be declared that Henry Alfred and David John Hunter are entitled to share in the residue in the proportions that the sum of $7, 000 bears to the residue, with the consequent directions. The costs of the litigation have hitherto been directed to be borne by the estate, and in view of all the circumstances it is proper to continue that direction, including the costs of this appeal - the executors' costs between solicitor and client.
