Book excerpt: Charged with restoring harmony and relieving pain, the Malay shaman places his patients in trance and encourages them to express their talents, drives, personality traits—the "Inner Winds" of Malay medical lore—in a kind of performance. These healing ceremonies, formerly viewed by Western anthropologists as exotic curiosities, actually reveal complex multicultural origins and a unique indigenous medical tradition whose psychological content is remarkably relevant to contemporary Western concerns. Accepted as apprentice to a Malay shaman, Carol Laderman learned and recorded every aspect of the healing seance and found it comparable in many ways to the traditional dramas of Southeast Asia and of other cultures such as ancient Greece, Japan, and India. The Malay seance is a total performance, complete with audience, stage, props, plot, music, and dance. The players include the patient along with the shaman and his troupe. At the center of the drama are pivotal relationships—among people, between humans and spirits, and within the self. The best of the Malay shamans are superb poets, dramatists, and performers as well as effective healers of body and soul. By devoting considerable time and funds to his project in the interior of Sumatra, Kozok has produced results that will change the writing of the history of Malay. [...] By conducting fieldwork (Kozok saw the text in Kerinci in August 2002), by following up leads from the colonial literature (Voorhoeve's compilation), by analyzing the text without depending on accepted knowledge and by taking the step of using the latest technology to obtain an empirical perspective about the material, Kozok has succeeded in laying a major part of a foundation for the rewriting of the history of Malay in Indonesia!"e; - James T. Book excerpt: The series Religion and Society (RS) contributes to the exploration of religions as social systems – both in Western and non-Western societies; in particular, it examines religions in their differentiation from, and intersection with, other cultural systems, such as art, economy, law and politics. Due attention is given to paradigmatic case or comparative studies that exhibit a clear theoretical orientation with the empirical and historical data of religion and such aspects of religion as ritual, the religious imagination, constructions of tradition, iconography, or media. In addition, the formation of religious communities, their construction of identity, and their relation to society and the wider public are key issues of this series.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines the challenges of the implementation of Islamic law in Malaysia. Malaysia is a pertinent jurisdiction to explore such challenges given its global focus, colonial history and institutions, and the intersection of the Shari’ah and secularism/multiculturalism. The resultant implementation challenges are underpinned by three factors that make Malaysia an important jurisdiction for those interested in understanding the place of Islamic law in the global context. First, Malaysia is often considered as a model Islamic country. Islamic law is a source of law in Malaysia. The Islamic law legal system in Malaysia operates in parallel with a common law legal system. The two systems of law generally are in harmony with one another. Nevertheless, occasional cross-jurisdictional issues do arise, and when they do, the Malaysian judiciary has been quite efficient in solving them. The Malaysian experience in maintaining such harmony between the two legal systems provides lessons for a number of countries facing such challenges. Second, Malaysia has a developed Shari’ah court system that interprets and applies Islamic law predominantly based on the Shafi’i school of thought. While, for the most part, the approach has been successful, there have been times when the implementation of the law has raised concerns as to the compatibility of Islamic law with modern principles of human rights and common law-based values. Third, there have been cases where Islamic law implementation in Malaysia has gained global attention due to the potential for wider international implications. To do justice to this complex area, the book calls on scholars and practitioners who have the necessary expertise in Islamic law and its implementation. As such, this book provides lessons and direction for other countries that operate a dual system of secular and Islamic laws.

Book excerpt: This exciting collection looks at the theory and practice of legal borrowing and adaptation in different areas of the world: Europe, the USA and Latin America, S.E. Asia and Japan. Many of the contributors focus on fundamental theoretical issues. What are legal transplants? What is the role of the state in producing socio-legal change? What are the conditions of successful legal transfers? How is globalisation changing these conditions? Such problems are also discussed with reference to substantive and specific case studies. When and why did Japanese rules of product liability come into line with those of the EU and the USA? How and why did judicial review come late to the legal systems of Holland and Scandinavia? Why is the present wave of USA-influenced legal reforms in Latin Amercia apparently having more success than the previous round? How does competition between the legal and accountancy professions affect patterns of bankruptcy? The chapters in this volume, which include a comprehensive theoretical introduction, offer a range of valuable insights even if they also show that the

Koh, Star2 This is a much-welcome new edition of the seminal introduction to Malaysia's constitution by the leading expert in the field. Retaining its comprehensive approach, it examines constitutional governance in light of authoritarianism and continuing inter-communal strife, as well as examining the impact of colonisation on Malaysia's legal public law structure. Updated throughout to include all statutory and case law developments, it also retains its socio-political perspective. A must read for all students and scholars of Malaysian law.
