This report finds that the competition process did not go smoothly and took longer than planned. The Commission sought to stimulate competition but was constrained by a number of factors which may have deterred potential bidders. Given these difficulties, the Commission had a sound basis for its decision to award the licence to Camelot, although there was not full agreement between individual Commissioners. However, concern is expressed regarding the risk that there will be no competitive pressure when the third licence comes to be awarded, and it underlines the need for contingency plans to be established for a situation where there are no suitable bidders, or indeed where there is only one suitable bidder.

Following on from a previous National Audit Office report (HCP 803, session 2001-02; ISBN 0102915652) the Committee's report examines the extent of competition for the second licence; the issue of achieving due propriety and protecting participants of the process; and the amount paid to Good Causes. Findings include: there is a real risk of there being no effective competition for future licence competitions; the Lottery Commission should draw up contingency plans to deal with situations such as the need to terminate an operator's licence; and the operator should bear more of the risk when it fails to achieve its sales forecasts, so that this shortfall of revenue sales does not unfairly impact upon the amount paid to the Good Causes.
