The steps that led up to this memorable event in the history of ecclesiastical jurisprudence are best set forth by the reigning Pontiff in his Bull Providentissima Mater Ecclesia, in which he promulgates the new Code. Then the Bull is quoted. With inevitable changes nevertheless in the conditions of the times and in the needs of mell, as our predecessor, Pius X of happy memory, pointed out in the Motu Proprio Arduum sane. issued 17 March, 1904, it became apparent that Canon Law could no longer readily attain the fulness of its aims. Indeed in the passing of centuries many, many laws had been published, of which some had been abrogated by the supreme authority of the Church or had fallen into desuetude; whilst others, owing to changed conditions, had become difficult of execution, or less useful and expedient for the common good. Moreover these laws had so increased in number and were so separated one from another and scattered about that many of them were unknown not merely to the people at large, but even to the most learned. As with Trent, the 1869-1870 Vatican Council desired several things to be completed. Trent had not considered a codification of Canon Law, but the Vatican Council had considered this as not only desirable, but essential for the good order of the Catholic Church. Following this desire Popes Pius X and Benedict XV codified Canon Law, which was issued in 1917.

Book excerpt: For many the law of the Church, canon law, has little meaning; it appears remote both from the Gospel and from the life of most people in the Church. Yet, it can impinge on them at times if a parish priest urges that a baptism be deferred, where a dispensation is needed for marriage or where there is a query about nullity of marriage. Recently, the scandals over clerical sexual abuse of children have drawn wider attention to the need for law also in the Church. At a time when it is popular to assert 'rights' of all sorts ― an identification of authentic rights and of corresponding duties in the Church, as well as mechanisms to ensure that these are respected in practice in a systematic way ― justice and law in the Church cannot be neglected. This book seeks to root the Church's law in the values of the Gospel, in particular in the justice which should guide the lives of those called to follow Christ and in the baptism by which they are incorporated into him and into his Church. The 'canon' or measure of how we should treat one another as members of the People of God and participate in our common mission in the service of that Gospel, according to our particular vocations and functions, is the focus of canon law. No law can replace the Gospel or the Holy Spirit, but canon law is an instrument of justice in the service of the Church and of its mission. The revision of canon law, which led to the Code of Canon Law of 1983 for the Latin Church, sought expressly to reflect the key teachings of the Second Vatican Council. That Code, beyond the general norms for understanding and applying its laws as a whole, centres upon the People of God in our common, diverse and complementary forms of living the Gospel, upon the Church's broad teaching function, and upon its sanctifying function, especially through the sacraments. It attends also to the temporal goods of the Church, for which there are responsibilities of stewardship, to penal law and sanctions and to procedural law ― the latter designed to ensure that practical implementation of the Church's law which is essential if its affirmations concerning justice and mission are not to remain vacuous. This book attempts to provide a theological and juridical introduction and explanation of these various aspects of the Church's life. The schematic presentation of 'key canons' is designed to enable the reader to understand the principal elements of a specific section and to see how those canons can be broken down so that their inter-related parts may be read, analysed and applied. The Code of Canon Law, then, can be seen as a valuable instrument in fulfilling the Church's mission for those with a passion for justice, rooted in the Gospel of Christ.

Book excerpt: For more than twenty years, A Concise Guide to Canon Law has provided priests, deacons, and lay pastoral ministers with essential information about Church laws that regularly impact the lives of everyday Catholics. This compact reference guide addresses topics such as who can receive the sacraments and when, the responsibilities of pastors and bishops; administration of parishes; and the role of finance and pastoral councils. The book also now includes the teachings of Popes Benedict XVI and Francis on issues such as marriage and annulment, as well as a new chapter on Catholic funerals. Canon lawyer Aldean Hendrickson, director of the tribunal for the Diocese of New Ulm, also has updated this practical guide with additional material that includes: a chapter on the Liturgy of the Hours; an updated section of frequently asked questions and answers at the end of each chapter; a revised and enhanced glossary of key terms; and a suggested reading list for deeper study.

Available in PDF, EPUB and Kindle. Book excerpt: Available for the first time in a comprehensive English translation, this thoroughly annotated but easy-to-use presentation of the classic 1917 Code of Canon Law by canon and civil lawyer Dr. Edward Peters is destined to become the standard reference work on this milestone of Church law. More than just of historical interest, the 1917 Code is an indispensable tool for understanding the current 1983 Code under which the Roman Catholic Church governs itself. Dr. Peters' faithful translation of the original Latin text of 1917, along with his detailed references to such key canonical works as Canon Law Digest and hundreds of English language doctoral dissertations on canon law produced at the world's great Catholic universities, now allows researchers to access directly this great fountain of ecclesiastical legal science. No student of canon law, and indeed, no one with a need to understand modern Church administration, can afford to be without this important volume.
