Book excerpt: A unique software application has been developed which combines a set of three modeling programs under one user interface to allow shipyard environmental managers to perform technical environmental modeling and risk evaluation in preparation for NPDES discussions with their regulators. This suite of programs 1.) takes simple shipyard data such as slopes, areas, copper concentrations, sediment load and rainfall data, and 2.) calculates the dispersion of the copper throughout a body of water and its sediment, and then 3.) estimates the risk involved to specified aquatic organisms from the predicted pollutant levels. The models, as packaged herein, were developed using NASSCO shipyard as the test or base shipyard. Thus, the bay modeled is the San Diego Bay and the discharge source is NASSCO's location on the bay. In addition, copper is the only pollutant considered in the model; it was selected as being one of the most toxic and difficult contaminants to control. Using the current version of the application, any facility located on San Diego Bay can easily modify the discharge location and begin to use the models. For facilities outside of San Diego Bay, additional programming will be needed to incorporate the specific tidal and bathymetry data for their own water body before the application can be used for their facility. Additional organisms can be added to the ecological risk evaluation at anytime, provided that copper toxicology data is available for the organism. A survey of regulatory agencies indicated that slightly over half of the 23 survey respondents would allow an industry to renegotiate its NPDES permit limits based upon an ecological risk assessment of the facility's discharge, although not all are currently doing so. Some respondents thought it would be 2-10 years before they are ready to do so. One regulator said that ecological risk assessment will never be used by their agency for NPDES permitting.

Book excerpt: This report presents a 2-D depth-averaged numerical model simulating water flow and reactive contaminant and sediment transport in bay/estuary systems. This model includes two computational modules: flow and transport. We use a splitting strategy to solve hydrodynamic equations where the method of characteristics (MOC) is employed first to compute circulation without taking into account eddy fluxes, and then the Galerkin finite element method is applied to deal with eddy fluxes. The computed flow results are used to compute the migration of sediments and contaminants in the transport module. Sediments can be either suspended in the water column or deposited on bed rock, and whose distributions are determined subject to advection, dispersion, and deposition/erosion processes. Contaminants, either organic or inorganic, may exist in the dissolved phase in the water column or in the interstitial water of the bed sediments. They may appear also as particulate chemicals on sediments through adsorption reactions. All chemical reactions, including aqueous complexation, adsorption/desorption, and volatilization, are assumed elementary and kinetic with reaction rates calculated based on the collision theory where forward and backward rate constants are determined experimentally. We employ a predictor-corrector strategy in the transport module where transport equations are computed in the predictor step with reaction rates estimated at the previous time, and rate correction is achieved node in the corrector step to obtain the concentration distributions at the present time. The Lagrangian-Eulerian approach is applied to solve the transport equations in the predictor step with a particle tracking technique used to handle advection. The Picard method and the Newton-Raphson method are used to solve the rate correction equations for sediment distribution and reactive chemistry, respectively, in the corrector step. Four examples are used to demonstrate the capability of this model.

He indicated the Administration s receptivity to creative compliance solutions, recognizing that command-and-control regulations have limited effectiveness. The President also pointed out that better decisions evolve from a collaborative process in which people work together. In response to the President s initiative, the U.S. Environmental Protection Agency (EPA or the Agency) began efforts to review its various regulatory programs and its statutory mandates to develop such programs. These efforts were the catalyst for this National Shipbuilding Research Program (NSRP) project on the subject. In the first part of this project, a regulatory reform questionnaire was sent to fourteen shipyard representatives on the SP-1 Panel, asking the shipyards representatives to rank the environmental issues that affect the shipbuilding industry. See Attachment 1. This report represents the second part of the NSRP regulatory reform project. The purpose of this report is to present the results of the NSRP questionnaire (Attachment 2), listing the survey participants (Attachment 3) and describing in detail their topranked environmental concerns. This report also summarizes their lower-ranked environmental concerns. Using the survey and this report, NSRP representatives can determine the most effective strategy for promoting NSRP s interests in promoting meaningful regulatory reform at EPA.

This was accomplished by reformatting this project's Task Deliverables to correspond with the EPA's Sustainable Industry project goals. Additionally the EPA provided funding to expand the overall scope of the work to include specific Sustainable Industry project deliverables. This portion of the overall NSRP/EPA-SI project now consists to two Task Deliverables: I. Development of a comprehensive US Shipbuilding and Repair Industry Sector contact database: and 2. Performance and analysis of a Shipyard Environmental Issues of Concern survey. This report documents the results of these two tasks. Additional reports will be prepared and provide to the NSRP regarding the results of additional Tasks funded by the EPA-SI and other sources. The final collection of these reports will be considered to be the Final Project Report for both the NARP and EPA-SI.

The development of this new proposed effluent guideline is the result of a consent decree, NR5C et al v. Reilly. At present, some shipyards or shipyard process wastewaters are regulated under the Metal Finishing categorical effluent standard which was promulgated in 1982 (40 CFR Part 433). Certain industries including the shipbuilding and repair industry, which are currently regulated under the Metal Finishing Category, will be incorporated into the new proposed MP&M standards.

As environmental regulations increase in rigidity and become more expansive, industry must continually evaluate their operations and focus on the potential for proactive pollution prevention. lndustry has the greatest understanding of their processes, practices, and organization therefore, industry itself is best suited for determining cost effective methods for controlling air pollution. Industry realizes that it should take a proactive approach to reduce air pollution because of the importance of minimizing air pollution and reducing industrial impact on the environment and public health. In many cases, Air Quality Best Management Practices (AQBMPs) are the most effective mechanism to minimize air pollution from shipbuilding and repair operations. For the purpose of this project, the NSRP defines AQBMPs as low cost, low technology, common sense measures and practices designed to reduce air pollution. AQBMPs are frequently the most cost effective method of pollution control and therefore, an area of research that the NSRP directed project finding. The goal of this project was to investigate shipyard operations and develop AQBMP ideas to be presented in a resource document. The resource document provides environmental and production personnel with suggestions for minimizing emissions from several production operations and equipment. The AQBMPs are designed to be flexible to be customized for a specific shipyard. A suggested AQBMP implementation strategy is also provided in the document for additional guidance. Developing and implementing proactive AQBMPs will benefit shipyards and enhance their current environmental management efforts.

This document does not intend to recommend one technology over another for a given application, but instead to provide a basis for comparable evaluations of technologies. It is left to the shipyard environmental manager to evaluate the available pollution prevention and/or pollution control technologies and determine which technologies best meets their needs.
