Book excerpt: This chapter explores the multilateral system of the International Treaty on Plant Genetic Resources for Food and Agriculture with a view to uncover vital lessons for managing access and benefit sharing challenges of the bilateral approach as well as lessons for improving ABS practices for common pools' resources and knowledge. In analysing the organisational structure of the multilateral system - and focusing on the criteria of effectiveness, justice and facilitation of public research and development, its legal framework regulating access, use and transfer of plant genetic resources for food and agriculture as well as sharing of benefits from their utilisation - the chapter exposes some of the setbacks hindering its further development.

Available in PDF, EPUB and Kindle. Book excerpt: The International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) is a pivotal piece of recent legislation, providing a route map for the use of such resources for sustainable agriculture and food security. Plant Genetic Resources and Food Security explains clearly the different interests and views at stake between all players in the global food chain. It touches upon many issues such as international food governance and policy, economic aspects of food and seed trade, conservation and sustainable use of food and agricultural biodiversity, hunger alleviation, ecological concerns, consumers' protection, fairness and equity between nations and generations, plant breeding techniques and socio-economic benefits related to food local economies. The book shows that despite the conflicting interests at stake, players managed to come to an agreement on food and agriculture for the sake of food security and hunger alleviation in the world. Published with the Food and Agriculture Organization (FAO) of the United Nations and with Bioversity International.

Book excerpt: This paper argues that a comprehensive Multilateral System for plant genetic resouce for food and agriculture is required which ensures the conservation of plant genetic resources and their utilization form human benefit at a global level. Such a system would incorporate agreements on access to plant genetic resources which ensured their availability; mechanisms for the sharing of benefits derived from plant genetic resources; conservation networks and information systems, and research and plant breeding capacity which meets the needs of farmers worldwide. Such a system should be developed with the full participation of all groups involved in teh management genetic resources.

Book excerpt: Plant genetic resources for food and agriculture (PGRFA) are part of the foundation of agriculture and of central importance to food sovereignty. These gain an increasingly pivotal role in the context of climate crises, which are threatening predictable crop production, and the erosion of agricultural biodiversity. The main instrument for the governance of PGRFA is the International Treaty on Plant Genetic Resources for Food and Agriculture. Strengthening the Treaty is crucial. The Treaty establishes a binding international framework for the conservation and sustainable use of plant genetic resources for food and agriculture, and the fair and equitable sharing of the benefits arising from their use. Since 2013, negotiations have been underway to enhance the functioning of the Multilateral System of Access and Benefit-sharing. Current informal consultations may pave the way for constructive negotiations at the next Governing Body meeting in May 2022.

Available in PDF, EPUB and Kindle. Book excerpt: There is much current controversy over whether the rights to seeds or plant genetic resources should be owned by the private sector or be common property. This book addresses the legal and policy aspects of the multilateral seed management regime. First, it studies in detail the International Treaty on Plant Genetic Resources for Food and Agriculture (the Treaty) in order to understand and identify its dysfunctions. Second, it proposes solutions - using recent developments of the "theory of the commons" - to improve the collective seed management system of the Treaty, a necessary condition for its member states to reach the overall food security and sustainable agriculture goals. Redesigning the Global Seed Commons provides a significant contribution to the current political and academic debates on agrobiodiversity law and governance, and on food security and food sovereignty, by analyzing key issues under the Treaty that affect the design and implementation of regulatory instruments managing seeds as a commons. It also examines the practical, legal, political and economic problems encountered in the attempt to implement these obligations in contemporary settings. In particular, it considers how to improve the Treaty implementation by proposing ways for Contracting Parties to better reach the Treaty’s objectives taking a holistic view of the human-seed ecosystem. Following the tenth anniversary of the functioning the Treaty’s multilateral system of access and benefit-sharing, which is currently under review by its Contracting Parties, this book is well-timed to examine recent developments in the field and guide the current review process to design a truly Global Seed Commons.

Book excerpt: In 2020, the FAO Office of Evaluation (OED) launched the evaluation of the third project cycle of the Benefit-sharing Fund (BSF). The evaluation assessed the results of the programme and provided lessons learned and recommendations to inform the further development of the BSF programme. The BSF was established in 2009 by the Contracting Parties of the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) in the spirit of multilateralism to fund projects in developing countries to increase crop diversity and enable a dynamic exchange of plant genetic material for increased adaptation, agricultural diversification and food security. Since its inception, a total of USD 26 million has been invested in four project cycles. Nine recommendations emerge from this evaluation. These include the need to capitalize on BSF achievements by highlighting PGRFA as an indispensable element of farmers’ food and nutrition security while building on the biodiversity and climate change nexus to further advance the BSF’s alignments with SDG 2 (end hunger), SDG 13 (climate action) and the Paris Agreement on enhancing adaptive capacity, strengthening resilience and reducing vulnerability to climate change by further sharpening, illustrating and concretizing the strategic importance of PGRFA to a resilient food and nutrition security in the context of climate change.
