Download or read book The Constitution of Empire written by Gary Lawson and published by Yale University Press. This book was released on 2008-10-01 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Constitution of Empire offers a constitutional and historical survey of American territorial expansion from the founding era to the present day. The authors describe the Constitution’s design for territorial acquisition and governance and examine the ways in which practice over the past two hundred years has diverged from that original vision. Noting that most of America’s territorial acquisitions—including the Louisiana Purchase, the Alaska Purchase, and the territory acquired after the Mexican-American and Spanish-American Wars—resulted from treaties, the authors elaborate a Jeffersonian-based theory of the federal treaty power and assess American territorial acquisitions from this perspective. They find that at least one American acquisition of territory and many of the basic institutions of territorial governance have no constitutional foundation, and they explore the often-strange paths that constitutional law has traveled to permit such deviations from the Constitution’s original meaning.
Book Synopsis Creating a More Perfect Slaveholders' Union by : Peter Radan
Download or read book Creating a More Perfect Slaveholders' Union written by Peter Radan and published by University Press of Kansas. This book was released on 2023-10-27 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: In Texas v. White (1869), the Supreme Court ruled that the unilateral secession of a state from the Union was unconstitutional because the Constitution created “an indestructible Union, composed of indestructible States.” The Court ruled “there was no place for reconsideration, or revocation, except through revolution, or through consent of the States.” In his iconoclastic work, Peter Radan demonstrates why the Court’s ruling was wrong and why, on the basis of American constitutional law in 1860–1861, the unilateral secessions of the Confederate states were lawful on the grounds that the United States was forged as a “slaveholders’ Union. Creating a More Perfect Slaveholders’ Union addresses two constitutional issues: first, whether the states in 1860 had a right to secede from the Union, and second, what significance slavery had in defining the constitutional Union. These two matters came together when the states seceded on the grounds that the system of government they had agreed to—namely, a system of human enslavement—had been violated by the incoming Republican administration. The legitimacy of this secession was anchored, as Radan demonstrates, in the compact theory of the Constitution, which held that because the Constitution was a compact between the member states of the Union, breaches of its fundamental provisions gave affected states the right to unilaterally secede from the Union. In so doing the Confederate states sought to preserve and protect their peculiar institution by forming a more perfect slaveholders’ Union. Creating a More Perfect Slaveholders’ Union stands as the first and only systematic analysis of the legal arguments mounted for and against secession in 1860–1861 and reshapes how we understand the Civil War and, consequently, the history of the United States more generally.

Book Synopsis Presidents and Presidencies in American History [4 volumes] by : Jolyon P. Girard
Download or read book Presidents and Presidencies in American History [4 volumes] written by Jolyon P. Girard and published by Bloomsbury Publishing USA. This book was released on 2019-10-07 with total page 1495 pages. Available in PDF, EPUB and Kindle. Book excerpt: This innovative encyclopedia explores the life and times of America's forty-five presidents—from the first administration to that of Donald Trump. Forty-five men have served as President of the United States since George Washington swore the oath of office in 1789 in New York City. Some have proved exceptional leaders, and others have not. Some have faced serious crises, both foreign and domestic. Franklin Roosevelt was elected to four terms, leading the country through a major economic depression and a world war, while one held the office for only a single month. Each, however, played a key role in the evolution of United States history. Each of their histories therefore remains a critical civics lesson to consider. This four-volume encyclopedia provides an expansive analysis of the life and times of each United States president in chronological order from George Washington to Donald Trump. Each chapter includes a timeline, a biographical sketch, a historical overview, and an analytical essay concerning the president and his presidency. Each also includes a substantial selection of related primary documents presenting important presidential speeches and correspondence. A suggested reading list for further study of each president rounds out each entry.
