Book excerpt: Excerpt from The Miscellaneous Writings, Literary, Critical, Juridical, and Political of Joseph Story, LL. D: Now First Collected The present volume owes its existence to an unexpected request of the enterprising publishers, that I would permit them to print a collection of my miscellaneous writings. To such a request I could not but yield a ready compliance; and my chief solicitude has been to present to the public such only of my compositions, as might be deemed least unworthy of their favor. Some of them have never before appeared in print; and in regard to those, which have so appeared, I have availed myself of the present opportunity to correct many errors, by which they were unavoidably blemished, in consequence of my not having originally examined the proof-sheets, as they passed through the press. Although I am fully aware, that I can have little claim to ask the public indulgence for the defects, which may be discovered in these literary efforts, I trust, that I may be permitted in some measure to deprecate the severity of criticism by alluding to the fact, that they were all written, not in hours of literary leisure or ease, but in hours oppressed by the weight of professional business, and sometimes by anxious cares, at which the heart sickens, and the spirit faints. Available in PDF, EPUB and Kindle. Book excerpt: Frontier Democracy examines the debates over state constitutions in the antebellum Northwest (Indiana, Illinois, Iowa, Michigan, Minnesota, Ohio, and Wisconsin) from the 1820s through the 1850s. This is a book about conversations: in particular, the fights and negotiations over the core ideals in the constitutions that brought these frontier communities to life. Silvana R. Siddali argues that the Northwestern debates over representation and citizenship reveal two profound commitments: the first to fair deliberation, and the second to ethical principles based on republicanism, Christianity, and science. Some of these ideas succeeded brilliantly: within forty years, the region became an economic and demographic success story. However, some failed tragically: racial hatred prevailed everywhere in the region, in spite of reformers' passionate arguments for justice, and resulted in disfranchisement and even exclusion for non-white Northwesterners that lasted for generations.

Available in PDF, EPUB and Kindle. Book excerpt: "Subversion and Sympathy : Gender, Law, and the British Novel brings new energy and perspective to the law-and-literature movement. Focusing on the position of women in British novels of the eighteenth and nineteenth centuries - a period during which literature played a creative role in legal reform - the book illustrates the many ways in which the investigation of legal matters sheds new light on major literary works. At the same time, it shows that attention to literary representations of legal issues illuminates developments in the law by bringing to life matters at stake in legal reforms. In fourteen essays, the volume spans a range of gender-related issues, including inheritance, money lending, illegitimacy, marriage, and rape. At the same time, it makes a methodological contribution, displaying (and discussing) a range of perspectives that exemplifies the breadth and range of this interdisciplinary area of scholarship, which links history, gender studies, philosophy, literary studies, and law. The volume seeks to reinvigorate the methodology of the law-and-literature movement by provoking a cross-disciplinary conversation among legal scholars, judges, literary scholars, and feminist philosophers. Participants include those already known for their work on law and literature but also, crucially, legal leading lights who have not previously written about literature. Subversion and Sympathy shows that the conversation between law and literature can enrich our understanding not just of the fields in question but also of the deeper human issues at the heart of a given period - and beyond"--Unedited summary from book jacket.

Cloth. $95. * A thorough survey and examination of the "formal commentaries" on the Constitution that were written as summaries of official pronouncements by proponents of the two major schools of constitutional interpretation before the Civil War--the nationalist Northern school as evidenced by the Marshall-Story decisions in the Supreme Court, and the Southern states rights advocates who lacked an equal spokesman. As this important study places the commentaries in a historical context by comparing their theories, examining their impact and their roots in the lives of the authors, it serves to illustrate "the early divergence between the North and South in theoretical discussions of the nature of the Union, and eventually lead to the constitutional justification of Southern secession." From the Preface.

Available in PDF, EPUB and Kindle. Book excerpt: Intellectual property has become a dominant feature of our knowledge based economy in recent years, but how has property rights in intangible items developed? This book brings together for the first time exemplary scholarship with diverse approaches to the history of United States intellectual property protection, including trade secrets, trademark, copyright, and patent law. These articles, written by leading experts in the field and often challenging conventional narratives, underscore the importance of historical perspectives for understanding how an extensive, evolving framework for the regulation of knowledge emerged in the modern period. By tracing intellectual property from an historical perspective - not merely providing justifications in philosophy or economics in the abstract - this book draws upon the past to address contemporary debates over such varied topics as: access to knowledge; policing copyright infringement; whether employees should own the products of their minds; the role of national borders in an age of digital information; and the very future of intellectual property as stakeholders and consumers contest the extent of its legal protection.

Book excerpt: This book offers the first account of the dead as an imagined community in the early nineteenth-century. It examines why Romantic and Victorian writers (including Wordsworth, Dickens, De Quincey, Godwin, and D’Israeli) believed that influencing the imaginative conception of the dead was a way to either advance, or resist, social and political reform. This interdisciplinary study contributes to the burgeoning field of Death Studies by drawing on the work of both canonical and lesser-known writers, reformers, and educationalists to show how both literary representation of the dead, and the burial and display of their corpses in churchyards, dissecting-rooms, and garden cemeteries, responded to developments in literary aesthetics, psychology, ethics, and political philosophy. Imagining the Dead in British Literature and Culture, 1790-1848 shows that whether they were lauded as exemplars or loathed as tyrants, rendered absent by burial, or made uncannily present through exhumation and display, the dead were central to debates about the shape and structure of British society as it underwent some of the most radical transformations in its history.
