Available in PDF, EPUB and Kindle. Book excerpt: Frederic W. Maitland, the pre-eminent Anglo-American legal historian, said that the trust "perhaps forms the most distinctive achievement of English lawyers. It seems to us almost essential to civilization and yet there is nothing quite like it in foreign law." This book is an updating of Maitland’s work, first looking at his suggested “foreign” sources for the trust—Roman law, German (Salic) law , and Franciscan “law”. It then considers a source Maitland did not – Islamic law – and finds that the Islamic waqf is not only “quite like” the trust, but predated it by at least five hundred years.

Book excerpt: Islamic South Asia has become a focal point in academia. Where did Muslims come from? How did they fare in interacting with Hindu cultures? How did they negotiate identity as ruling and ruled minorities and majorities? Part I covers early Muslim expansion and the formative phase in context of initial cultural encounter (app. 700-1300). Part II views the establishment of Muslim empire, cultures oscillating between Islamic and Islamicate, centralised and regionalised power (app. 1300-1700). Part III is composed in the backdrop of regional centralisation, territoriality and colonial rule, displaying processes of integration and differentiation of Muslim cultures in colonial setting (app. 1700-1930). Tensions between Muslim pluralism and singularity evolving in public sphere make up the fourth cluster (app. 1930-2002).

Available in PDF, EPUB and Kindle. Book excerpt: At a time when more nuanced understandings of Muslim countries and their legal and social practices are urgently needed in the West, the appearance of this collection is especially welcome. In these illuminating and accessible essays, the contributors explain how Islam sees itself in terms of social policy, how it treats women, and how it encourages charity, education, and general social welfare. The essays encompass many regional cultures and draw on court records and legal debates, field work on government ministries, and an extensive reading of Islamic law. In his overview of waqf (similar to the Western idea of a foundation, in which an endowment is set aside in perpetuity for specified purposes), Ahmad Dallal explains how charity, a central organizing principle in Islam, is itself organized and how waqf, traditionally a source of revenue for charitable purposes, can also become a source of tension and conflict. Donna Lee Bowen, in her essay on the position of women in Islamic law, points out the crucial differences between the Islamic principles of family equity and the Western notion of individual equality. In a subsequent essay, Bowen addresses the problems surrounding family planning and the dilemmas that have arisen within the Muslim world over differing ideas about birth control. The two final essays look at specific instances of how the modern state has treated Islamic social policy. Gail Richardson examines zakat, an Islamic tax used to assist the poor, and its administration in Pakistan. Carol Underwood, meanwhile, explores public health policy in Iran, both before and after the Islamic revolution that deposed the Shah. Addressing some of the most profound misunderstandings between Islamic and Western societies, Islam and Social Policy will be of vital interest not only to scholars and policymakers but to anyone concerned with Islam's critical place in the modern world.

Available in PDF, EPUB and Kindle. Book excerpt: After the creation of Pakistan in 1947, Sufi shrines became highly contested. Considered deviant and `un-Islamic', they soon fell under government control as part of a state-led strategy to create an `official', more unified, Islamic identity. This book, the first to address the political history of Sufi shrines in Pakistan, explores the various ways in which the postcolonial state went about controlling their activities. Of key significance, Umber Bin Ibad shows, was the `West Pakistan Waqf Properties Ordinance', a governmental decree issued in 1959. Formed when General Ayub Khan assumed the role of Chief Martial Law Administrator, this allowed the state to take over shrines as `waqf property'. According to Islamic law, a waqf, or charitable endowment, had to be used for charitable or religious purposes and the state created a separate Auqaf department to control the finances and activities of all the shrines which were now under a state sponsored waqf system. Focusing on the Punjab - famous for its large number of shrines - the book is based on extensive primary research including newspapers, archival sources, interviews, court records and the official reports of the Auqaf department. At a time when Sufi shrines are being increasingly targeted by Islamist extremists, who view Sufism as heretical, this book sheds light on the shrines' contentious historical relationship with the state. An original contribution to South Asian Studies, the book will also be relevant to scholars of Colonial and Post-Colonial History and Sufism Studies.
