Book excerpt: Excerpt from The Thirteenth Juror: A Tale Out of Court Certainly there was no keener Observer in Fraser County than Peter Reeve as he sat on his impro vised rostrum, pipe in hand, beaming a bene diction on his assembled guests. He knew every man in the place and just what had brought him there; he could name every juror who had sat on any case of importance during the past thirty years, and give the inside history of his verdict; he was generally familiar with the claims of the litigants long before they reached the court-room; and there were not many lawyers who could tell him anything he did not already know concerning the private afiairs of their clients. Book excerpt: Excerpt from Commercial Law The author of this work has aimed to select from the exten sive field of the law those fundamental principles, a knowledge of which the business man will most frequently find of value to him, and which the teacher of Commercial Law will regard most useful to his classes. It is not the purpose of this volume to make lawyers of its readers, but to teach them to discern the ways that lead from litigation, and to enable them to conduct their business dealings with an intelligent idea of their legal rights and limitations. Technical terms have been avoided as far as possible, and when it has been thought advisable to use them they have been fully defined either in the text or in the glossary. The latter contains a most complete list of the legal terms ordinarily em ployed, with concise yet sufficient definition. The subjects discussed have been arranged in the order in which it is deemed advisable for the teacher to present them. It is believed that all of the subjects with which the business man should become familiar have been included in the present volume, and are explained with sufficient detail to give the reader a correct knowledge of the law concerning them. In many instances different conclusions that have been arrived at by the courts in the several states have been pointed out in detail, that the student may understand the conflicts in the laws of the different jurisdictions. Book excerpt: Excerpt from Landmarks of a Lawyer's Lifetime Supreme Court, an associate on the bench with my father, followed by the Strongs who founded the practice of that distinguished firm - Strong Cad walader of New York City, in which for many years there was no Strong, but the name was regarded of sufficient value to be retained. The progeny of these two branches of Strongs ramified far and wide in the field of law, and quite likely a few more judges among them might be unearthed by more or less diligent search, and if the fates had been kinder upon my two nominations for a judgeship by the Republi cans of New York City, I might have added another to the list of Supreme Court Judges. It is a matter Of satisfaction in looking over the roll of these worthies of the bench and bar, that in about a century and a half neither the sentence of sus per coll nor of disbarment has been pronounced against any of them. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Spirit of Our Laws A great many people take an interest in the law without being lawyers or litigants or specialists of any sort. They like to understand something of what is going on around them, and for their law they have to trust to snatches from the newspapers. Though, possibly, both writer and reader are well-educated persons, the exact point or points on which the report turns is almost certain to be missed, for neither has any training to catch it. Hence the frequent exclamation, I can't understand this case; however could such a decision have been arrived at? And, of course, the bewilderment is greater where there is any desire even to scratch beneath the surface. Yet between the formal study of the law and the perusal of the daily newspaper there is no satisfaction for the amateur reader, better, perhaps, known as the general reader. A professed lawyer, of course, would not dream of trusting an ordinary newspaper report (with a few exceptions) for practical purposes, even for his own guidance; for he requires at least a certain degree of accuracy, and may require the highest. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Popular Government, Vol. 60: Winter 1995 Litigants can benefit greatly from interacting with the mediator as an impartial, but knowledgeable and sympa thetic, participant. One benefit is that mediators can point out weaknesses in a litigant's case - weaknesses that their own attorneys may have been reluctant to emphasize. Or the attorney may already have tried to explain the weaknesses to the litigant, but the litigant may listen better when the mediator explains. Another benefit is that the litigants derive some satis faction from expressing their frustration and hostility to the mediator. Whether this happens (and how it happens) depends upon the type of case and the mediator's style. We observed a wide range of mediator attitudes toward the emotional aspects of mediation, from those who arevery patient and sympathetic to those who have no inter est in letting litigants express their feelings. Allowing emo tions to come out in the open increases the risk of the mediator losing control over the conference, but some times it can effectively clear the way for settlement. To this end, a mediator might even allow a party to engage in show and tell. In a case arising from a fatal automobile accident, the deceased victim's family showed videos of her. At another conference the plaintiff explained how she had been emotionally shaken by her automobile acci dent because she had lost her daughter several years be fore in a wreck. The mediator encouraged her to talk about her daughter and show pictures of her. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. We cannot respect our selves unless we respect the law whose guardians we are, and every man Who enters the Bar as sumes thereby an obligation to make the 1553571 its precepts and its practice, worthy of respect. This is his first and last debt to his P'rofession. The great lawyers of the past have been the leaders of the community, and have deserved and enjoyed in ample measure the confidence of their fellow-citizens. To - day unhappily, for rea sons Which I shall discuss later, the law and its ministers are no longer trusted as implicitly, but on the contrary are attacked from every side, and lawlessness increases the country over. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Lawyers' Merriments Law is a serious matter, but the outside world seems to find in it a perpetual source of entertainment. Litigants and lawyers, courts and judges, and the very law itself, have furnished topics for scores of amusing volumes. Morison's Dictionary, with its seventeen thousand pages, to say nothing of the Appendix and many volumes of Supplement, is a vast repertory of learning, of much sound and of some bad law, but the curious reader will find not a little to amuse him in the situations presented by the cases reported, by the odd observations of the reporters, and the naive and pithy remarks of the judges. No one has attacked it, but any enthusiast who does so will find material for many gatherings of Curiosities. This treatment of the law and those who resort to its aid, or who are engaged in its administration, is perfectly legitimate, and there is no reason why outsiders should not laugh at what they find provokes to laughter. Ill drawn or absurd statutes, muddled or bizarre wills, may quite well be treated as Curiosities of Legislation, or as Whims of Testators, and many industrious authors have employed themselves in searching out and exhibiting such maladroit performances of legislators and draftsmen -lay or professional - and the confusion which they bring about. Book excerpt: Excerpt from Greek Prose Composition Part I contains, in graded lessons, the principal points of Greek syntax, the unusual and non-essential being purposely omitted. These lessons are designed for use at the beginning of the second year's study of Greek, thereby serving as a partial review of the first year's work and as an introduction to the composition work in connection with the reading of Xenophon's Anabasis. Part II contains short, simple English sentences, based on Books I - IV of the Anabasis. These should be used daily in connection with the reading of the text. Part III contains connected English prose, based on Books I - IV of the Anabasis. This is carefully graded, so that the stu dent who performs faithfully the work outlined here will be able to pass the entrance examination of any of the American colleges. The method of writing Greek at sight used in this book needs a word of explanation. It is the outgrowth of the author's personal experience in the classroom, and his belief that the best results can be obtained only by systematic practice in connection with the regular work.
