Book excerpt: This paper focuses on why 'indicators' and evaluative questions about the external form of commercial law in transition economies are now so much in vogue. I trace the objectives and methods of a four different evaluative projects sponsored by the World Bank and USAID that are designed to assess and ultimately to rank the legal systems of transition economies. One obvious impetus for the evaluative turn in technical legal assistance is that there are so many legal systems in 'transition' and so much money is being spent on them. Another is that global bureaucracies such as the World Bank, the IMF, the European Bank for Reconstruction and Development, the Asian Development Bank and the postindustrial states that sponsor them are predisposed to using evaluative techniques as forms of audit and control. The 'indicators' of commercial law now used in legal technical assistance projects are designed to allow ranking of legal systems according to their compliance with 'best-practice' models of commercial law in countries assumed to have well-established 'rule of law'. Significantly, the rankings are intended in many cases to guide allocative decision-making. This is the process that I call the 'law reform Olympics'

This is the first work on this important subject – the Olympic Games having been well described as ‘the greatest sporting show on earth’ – and the author, Alexandre Miguel Mestre, a distinguished Portuguese international sports lawyer, is to be warmly congratulated on producing it. The book covers the historical development of ‘Olympic Law’ and the current legal status of the International Olympic Committee (IOC) as an NGO (non-g- ernmental organisation) under Public International Law, and its various constituent members and organs. The UN resolutions on the Olympic Truce of which the latest one is published in the book, are of a recommendatory nature (‘soft law’), but well illustrate the wide range of international legal instruments, which constitute the corpus of so-called ‘Olympic Law’, including the inter-State Nairobi Treaty on the Protection of the Olympic Symbol – the famous five interconnected rings. The book also addresses some contemporary legal issues affecting the Olympic Movement, including eligibility criteria, dual participation in the Olympics and the Paralympics as well as environmental concerns and the protection of the so-called ‘Olympic Properties’ – in other words the valuable intellectual property rights of the IOC including TV rights – without which the Olympic Games could not be financed and staged.

The most significant provision of the new law is the establishment of a Commission on the State of U.S. Olympics and Paralympics to review the governance of the United States Olympic and Paralympic Committee ("USOPC") and make proposals for change. The Commission's creation comes at a crucial time in U.S. Olympic governance. This article advocates for more significant changes to the Olympic structure that the commission should consider, such as direct or indirect government funding for the USOPC and the sport governing bodies in return for adherence to more stringent transparency and ethical rules.
