Book excerpt: Excerpt from The Law of Homestead and Exemptions It was deemed wise to set forth the facts of some particular cases, as well as the peculiarities of the statutes under which they arose, that the reader might determine how far the rules laid down therein would apply to other cases or localities, the aim being to make a work which should prove useful to the practitioner. Cases arising under the bankrupt law or concerning per sonal property have all been collected in the chapters upon those subjects, even though determining the same principles as those announced in the earlier chapters of the book. Book excerpt: Excerpt from A Treatise on Homestead and Exemption Laws The latest revisions of statutes on file in the St. Louis Law Library show that homestead laws exist in all the States of the Union. Except Connecticut, Rhode Island, New Jersey, Delaware, Pennsylvania, Maryland, West Virginia, * and Indiana. The earliest American homestead law of which the writer has knowledge was an act of the republic of Texas, passed January 26, 1839. This statute (1 Pasc. Dig. Texas Laws, art. 3798) exempted from execution, to every citizen or head of a family in this republic, fifty acres of land, or one town lot, including his or her homestead, and improvements not exceeding five hundred dollars in value, together with tain enumerated chattels. The founders of the infant republic wisely enacted that the passage of this act shall not interfere with contracts between parties heretofore made. See post, a 10 et seq. The Spanish law, which this system displaced, pro vided for many exemptions, such as implements of husbandry, bread of bakers. Tools of artificers, books of advocates and students, beds, wearing-apparel. And other things necessary for daily use. Cobbs v. Coleman, 14 Texas. 599. From the passage of the act first named, the protection of the homestead became a favorite object with the legislatures of Texas; and when that republic adopted a new constitution, on enter ing the American Union in 1845, that instrument, for the first time among American constitutions, guaranteed a family homestead, of given dimensions and value. From forced sale for the payment of debts, and from alienation by the husband without consent of the wife. Const. Texas 1845, art. 7, a 22; 1 Pasc. Dig. Laws Texas, 65. The earliest legislation of the other states on this subject, of which the writer has knowledge, was the Vermont act of 1849. From this period the subject was taken up by the legislatures of other states, and the protection of the family homestead of debtors from forced sale soon became a part of the general policy of the country. Book excerpt: Excerpt from Amending the Homestead Laws: Hearings Before the Committee on the Public Lands, House of Representatives, on Various Bills Proposing Amendments to the Homestead Laws, January 31 and February 5, 1912 The acting chairman. That is one of the various matters we would like to have the Secretary express his views upon. Mr. Mondell. The Secretary's office has recently ruled that the entryman is not entitled to have the first six months after he makes his entry considered as a period of constructive residence. It has been so considered for many years, and as the Secretary has made some recommendations along that line in his annual report I suggest that the Secretary give us his Views, at such length as he may see fit, upon that particular question as an opening. Hon. Walter L. Fisher (secretary of the Interior). Mr. Chair man and gentlemen of the committee, I have no hesitancy in discus sing this entire general subject candidly and as fully as it is possible under the very short notice I received. I want it understood, how ever, that the views I express are expressed on very short notice and are subject to modification at any time without notice. Book excerpt: Excerpt from The Homestead Right as It Exists in New Hampshire, 1901 It was just a half century ago that the people of the state became impressed with the realization that although all men might be created equal they remained so for only a short time after their creation, and that it was for the public interest that such of them as should become so unfortunate as to need it should be afforded protection for their homes against both their misfortune and improvi dence, which would secure to each inhabitant a house and lot of reasonable value, and thus relieve them from the contemplation of being occupants of the poor house. They accordingly sent numerous petitions to the legisla ture for the enactment of a law to carry out this design.
