Book excerpt: Strange, outdated laws from each of the 50 U.S. states—some overturned, some still on the books, and some merely the stuff of legends—are depicted with sly wit by Olivia Locher. Incisive, ironic, and gorgeous, these images will appeal to art buffs and trivia fans alike. A foreword from American poet Kenneth Goldsmith and an interview with the artist by Eric Shiner, former director of the Andy Warhol Museum, contextualize rising-star Locher's photography. From serving wine in teacups in Kansas to licking a toad in Kentucky or perming a child's hair in Nebraska, breaking the law has never looked so good.

They embody our society’s genetic code. In the masterful hands of the subject’s greatest living historian, the story of the evolution of our laws serves to lay bare the deciding struggles over power and justice that have shaped this country from its birth pangs to the present. Law in America is a supreme example of the historian’s art, its brevity a testament to the great elegance and wit of its composition.

Book excerpt: Dubbed a pioneer of critical race theory, Delgado offers a book of compelling conversations about race in America Richard Delgado is one of the most evocative and forceful voices writing on the subject of race and law in America today. The New York Times has described him as a pioneer of critical race theory, the bold and provocative movement that, according to the Times "will be influencing the practice of law for years to come." In The Rodrigo Chronicles, Delgado, adopting his trademark storytelling approach, casts aside the dense, dry language so commonly associated with legal writing and offers up a series of incisive and compelling conversations about race in America. Rodrigo, a brash and brilliant African-American law graduate has been living in Italy and has just arrived in the office of a professor when we meet him. Through the course of the book, the professor and he discuss the American racial scene, touching on such issues as the role of minorities in an age of global markets and competition, the black left, the rise of the black right, black crime, feminism, law reform, and the economics of racial discrimination. Expanding on one of the central themes of the critical race movement, namely that the law has an overwhelmingly white voice, Delgado here presents a radical and stunning thesis: it is not black, but white, crime that poses the most significant problem in modern American life.

Available in PDF, EPUB and Kindle. Book excerpt: “The volcanic political atmosphere in the bubbling cauldron of the caldera that was the Gazelle Peninsula came to a head in December 1969.” This unique book tells the story of the day-to-day life of a young criminal circuit lawyer from Tasmania, Kerry Dillon, some 50 years ago in a country where many people lived as generations before had lived, back into the mists of time. Employed as a 22-year-old lawyer in the Office of the Public Solicitor, WA Lalor, in the Territory of Papua and New Guinea, Kerry travelled the country on Supreme Court criminal circuits from 1969 to 1971, appearing as counsel for Indigenous people accused of serious criminal offences, including stealing, rape and wilful murder. Written as a chronicle, this account features descriptions of criminal cases in major centres and in remote places only accessible by small planes. It depicts the clash of cultures as Australian criminal law was introduced, and there is valuable material on the application of the rule of law in the emerging nation. “The differing ways of life between Papua New Guinean communities, and the wide variation in the character of their interactions with Europeans and the Administration, was a significant part of the complex environment in which Kerry’s experiences in the country took place and which his account illustrates.” – Michael Adams QC

Available in PDF, EPUB and Kindle. Book excerpt: As a law student and young lawyer in the 1760s, Thomas Jefferson began writing abstracts of English common law reports. Even after abandoning his law practice, he continued to rely on his legal commonplace book to document the legal, historical, and philosophical reading that helped shape his new role as a statesman. Indeed, he made entries in the notebook in preparation for his mission to France, as president of the United States, and near the end of his life. This authoritative volume is the first to contain the complete text of Jefferson’s notebook. With more than 900 entries on such thinkers as Beccaria, Montesquieu, and Lord Kames, Jefferson’s Legal Commonplace Book is a fascinating chronicle of the evolution of Jefferson’s searching mind. Jefferson’s abstracts of common law reports, most published here for the first time, indicate his deepening commitment to whig principles and his incisive understanding of the political underpinnings of the law. As his intellectual interests and political aspirations evolved, so too did the content and composition of his notetaking. Unlike the only previous edition of Jefferson’s notebook, published in 1926, this edition features a verified text of Jefferson’s entries and full annotation, including essential information on the authors and books he documents. In addition, the volume includes a substantial introduction that places Jefferson’s text in legal, historical, and biographical context.

Book excerpt: Beginning in the late eighteenth century, British rule transformed the relationship between law, society, and the state in South Asia. But qazis and muftis, alongside ordinary people without formal training in law, fought back as the colonial system in India sidelined Islamic legal experts. They petitioned the East India Company for employment, lobbied imperial legislators for recognition, and built robust institutions to serve their communities. By bringing legal debates into the public sphere, they resisted the colonial state's authority over personal law and rejected legal codification by embracing flexibility and possibility. With postcards, letters, and telegrams, they made everyday Islamic law vibrant and resilient and challenged the hegemony of the Anglo-Indian legal system. Following these developments from the beginning of the Raj through independence, Elizabeth Lhost rejects narratives of stagnation and decline to show how an unexpected coterie of scholars, practitioners, and ordinary individuals negotiated the contests and challenges of colonial legal change. The rich archive of unpublished fatwa files, qazi notebooks, and legal documents they left behind chronicles their efforts to make Islamic law relevant for everyday life, even beyond colonial courtrooms and the confines of family law. Lhost shows how ordinary Muslims shaped colonial legal life and how their diversity and difference have contributed to contemporary debates about religion, law, pluralism, and democracy in South Asia and beyond.

Available in PDF, EPUB and Kindle. Book excerpt: Biography of Ernie Goodman, a Detroit lawyer and political activist who played a key role in social justice cases. In a working life that spanned half a century, Ernie Goodman was one of the nation's preeminent defense attorneys for workers and the militant poor. His remarkable career put him at the center of the struggle for social justice in the twentieth century, from the sit-down strikes of the 1930s to the Red Scare of the 1950s to the freedom struggles, anti-war demonstrations, and ghetto rebellions of the 1960s and 1970s. The Color of Law: Ernie Goodman, Detroit, and the Struggle for Labor and Civil Rights traces Goodman's journey through these tumultuous events and highlights the many moments when changing perceptions of social justice clashed with legal precedent. Authors Steve Babson, Dave Riddle, and David Elsila tell Goodman's life story, beginning with his formative years as the son of immigrant parents in Detroit's Jewish ghetto, to his early ambitions as a corporate lawyer, and his conversion to socialism and labor law during the Great Depression. From Detroit to Mississippi, Goodman saw police and other officials giving the "color of law" to actions that stifled freedom of speech and nullified the rights of workers and minorities. The authors highlight Goodman's landmark cases in defense of labor and civil rights and examine the complex relationships he developed along the way with individuals like Supreme Court Justice and former Michigan governor Frank Murphy, UAW president Walter Reuther, Detroit mayor Coleman Young, and congressman George Crockett. Drawing from a rich collection of letters, oral histories, court records, and press accounts, the authors re-create the compelling story of Goodman's life. The Color of Law demonstrates that the abuse of power is non-partisan and that individuals who oppose injustice can change the course of events.
