Yet, in mid-2016 the Lautenberg Act regulating toxics - chemicals employed in commerce - was passed, winning business and environmental support. What might explain this? Has the Trump administration undercut the law's effects? Does the Act's passage portend more progressive actions? We show that the Act was a function of the status quo changing due to regulatory efforts abroad and in the United States, and from outside pressures on business. These influences impacted implementation, with the Trump administration not targeting toxics regulation analogous to other programs. Further, the processes we observe for toxics may not be unique.

Book Synopsis Regulating Toxic Substances by : Carl F. Cranor
Download or read book Regulating Toxic Substances written by Carl F. Cranor and published by Oxford University Press. This book was released on 1993-02-18 with total page 273 pages. Available in PDF, EPUB and Kindle. Book excerpt: The proliferation of chemical substances in commerce poses scientific and philosophical problems. The scientific challenge is to develop data, methodologies, and techniques for identifying and assessing toxic substances before they cause harm to human beings and the environment. The philosophical problem is how much scientific information we should demand for this task consistent with other social goals we might have. In this book, Cranor utilizes material from ethics, philosophy of law, epidemiology, tort law, regulatory law, and risk assessment, to argue that the scientific evidential standards used in tort law and administrative law to control toxics ought to be evaluated with the purposes of the law in mind. Demanding too much for this purpose will slow the evaluation and lead to an excess of toxic substances left unidentified and unassessed, thus leaving the public at risk. Demanding too little may impose other costs. An appropriate balance between these social concerns must be found. Justice requires we use evidentiary standards more appropriate to the legal institutions in question and resist the temptation to demand the most intensive scientific evaluation of each substance subject to legal action.

Available in PDF, EPUB and Kindle. Book excerpt: The growing concern in the United States about the safety of chemicals in our environment makes the Toxic Substances Control Act (TSCA) a timely topic. TSCA is the primary vehicle for enabling the government to review most chemicals, other than foods, drugs, cosmetics and pesticides, before they are introduced into commerce. Last year's dramatic recall of children's toys tainted with lead has increased the calls for thorough information about the chemicals in our environment. In addition, the lightening speed of nanotechnology development threatens to leave regulators with very few tools to address the environmental and toxicological effects of nanomaterials. This book is a unique resource for lawyers and regulatory affairs specialists who need to understand the Toxic Substances Control Act (TSCA), including the surrounding law, regulations and guidances. This volume includes a CD-ROM containing a broad array of resource materials, references to other supporting source materials, and procedures to implement an integrated TSCA compliance plan.

Book excerpt: Thirty-five years of experience implementing and enforcing the Toxic Substances Control Act (TSCA) have demonstrated the strengths and weaknesses of the law and led many to propose legislative changes to TSCA's core provisions. The basic structure of the Toxic Substances Control Act (TSCA) of 1976 has never been amended, but recent legal, scientific, and technological changes are prompting some policy makers to re-examine the law. This book summarises the Toxic Substances Control Act (TSCA) and the major regulatory programs dealing with chemical production and distribution in U. S. commerce.
