Especially, it seems necessary to explain why so much political history has been included in a work dealing primarily with a law-court. This is due to the dual character of the Council in the North, its administrative responsibility constantly leading to an extension of its judicial powers, and resentment at its governmental action as constantly finding expression in opposition to its judicial authority. Some reference to the political history of the North during the period of the Council's existence was therefore necessary. Unfortunately, the standard works dealing with the period seldom do more than refer to events in the North, and usually the references are derived from Chronicles and other secondary authorities. My own researches having convinced me that these authorities are not always to be trusted, I was faced with these alternatives: either to write a history of the Council as a law-court with references to political history which must appear dogmatic because they implied views differing in many ways from those generally received, which yet were not supported by a reasoned statement of the evidence; or to write an account of the political history of the North during the period under consideration as well as an account of the Council itself. At first I chose the former alternative, and it was a history of the Council as a law-court that I submitted to the University of London for the degree of Doctor of Literature in 1911.
