Available in PDF, EPUB and Kindle. Book excerpt: The American courtroom trial is a speech situation. Everything occurs through the spoken word. The 'summation', as speech event embedded within the trial, which is the chronological and psychological culmination of it, is one of the few opportunities for the lawyer to communicate directly with jurors. But the speech genre summation involves preliminaries as well as the event itself; and it can affect the aftermath of the trial, for the decisions of the jurors may be influenced by this discourse. This ethnographic study considers the summation from three perspectives: that of the producer, from the point of view of the ethnographer who observed and analyzed sixty-six actual summations and from that of the receivers of the speech event who must act upon it. Information was obtained from post-deliberation questionnaires completed by 223 jurors, plus 35 alternate jurors.

Book excerpt: Engagement has turned essential in today’s communication, as professional communities are becoming more specialised and transient, and their audiences more diverse. Promotionalism and competitiveness, in addition, increasingly pervade human activity, and thus engaging readers, listeners and viewers to attract and persuade them is part of the know-how of almost every profession. The eighteen chapters in this book, written by well-known discourse analysts from different nationalities and research backgrounds, and with various interests and understandings of communicative engagement, guide us through a discovery of perspectives and strategies across work settings and practices, genres, semiotic modes, discourses, disciplines, and theoretical frameworks and methods. They build a mosaic that leads to a broad picture of (meta)discursive engagement as (di)stance and raises current issues, challenges, and future research directions.

Available in PDF, EPUB and Kindle. Book excerpt: Exploring the characteristics of different types of workplace conversations, including decision-making, training, briefing or making arrangements, this enthralling account pays particular attention to interactions with a more social focus, such as small talk or office gossip. Presenting a range of approaches to analyzing such workplace discourse, Almut Koester argues for a combination of quantitative corpus-based methods, to compare specific linguistic features in different genres and qualitative methods involving a close analysis of individual conversations, to explore such issues as politeness, power, conflict and consensus-building. A corpus of conversations recorded in a variety of office environments both in the UK and the USA is used throughout to demonstrate the interplay between speakers accomplishing tasks and maintaining relationships in the workplace.

Book excerpt: Honorable Mention, 2019 Barbara T. Christian Literary Award, given by the Caribbean Studies Association Winner, 2017 Clifford Geertz Prize in the Anthropology of Religion, presented by the Society for the Anthropology of Religion section of the American Anthropological Association Finalist, 2017 Albert J. Raboteau Prize for the Best Book in Africana Religions presented by the Journal of Africana Religions An examination of the religious importance of food among Caribbean and Latin American communities Before honey can be offered to the Afro-Cuban deity Ochún, it must be tasted, to prove to her that it is good. In African-inspired religions throughout the Caribbean, Latin America, and the United States, such gestures instill the attitudes that turn participants into practitioners. Acquiring deep knowledge of the diets of the gods and ancestors constructs adherents’ identities; to learn to fix the gods’ favorite dishes is to be “seasoned” into their service. In this innovative work, Elizabeth Pérez reveals how seemingly trivial "micropractices" such as the preparation of sacred foods, are complex rituals in their own right. Drawing on years of ethnographic research in Chicago among practitioners of Lucumí, the transnational tradition popularly known as Santería, Pérez focuses on the behind-the-scenes work of the primarily women and gay men responsible for feeding the gods. She reveals how cooking and talking around the kitchen table have played vital socializing roles in Black Atlantic religions. Entering the world of divine desires and the varied flavors that speak to them, this volume takes a fresh approach to the anthropology of religion. Its richly textured portrait of a predominantly African-American Lucumí community reconceptualizes race, gender, sexuality, and affect in the formation of religious identity, proposing that every religion coalesces and sustains itself through its own secret recipe of micropractices.

Book excerpt: The closing arguments from ten noteworthy cases—“lawyers and nonlawyers will enjoy the passion and eloquence of these counselors; practitioners of law will find much to learn from them” (Los Angeles Times Book Review). Until now, only the twelve jurors who sat in judgment were able to appreciate these virtuoso performances, where weeks of testimony were boiled down and presented with flair, wit, and high drama. For five years the authors researched every archive, and readers can now lose themselves in the summations of America’s finest litigators. Clarence Darrow saves Leopold and Loeb from the gallows in the Roaring Twenties. Gerry Spence takes on the nuclear power industry for the death of Karen Silkwood in a modern-day David and Goliath struggle. Vincent Bugliosi squares off against the madness of Charles Manson and his murderous “family” in the aftermath of their bloody spree. Clara Foltz, the first woman to practice law in California, argues passionately to an all-male jury, defending her place in the courtroom. Bobby DeLaughter brings the killer of civil-rights leader Medgar Evers to justice after thirty years and two mistrials. Aubrey Daniel brings Lt. William Calley, Jr., to justice for the My Lai massacre. William Kunstler challenges the establishment after the 1968 Chicago riots in his defense of yippie leaders known as the Chicago Seven. Each closing argument is put into context by the authors, who provide historical background, a brief biography of each attorney, and commentary, pointing out the trial tactics used to great effect by the lawyers, all in accessible, reader-friendly language.

Book excerpt: Jury Speech Rules: The Art of Ethical Persuasion, Second Edition shows trial lawyers that persuasive jury opening statements and closing arguments require imagination, story-telling skills, and a thorough knowledge of the legal and ethical rules that govern this important part of trial. Using famous historical cases and many useful examples, they demonstrate when things go wrong and when they are done right.Opening statements can present the important facts to the jury from the party's perspective, making the jurors receptive to the story that counsel intends to tell through the witnesses, documents, and visuals; well-constructed and well-delivered openings, which avoid improper argument, make an interesting introduction of the parties and the attorneys. Counsel can keep the other lawyer quiet by presenting an opening that provides no opportunity for interruption with objections. Closing arguments that can present inferences, arguments, and conclusions will help the jurors understand the significance of the facts that have been proven at trial; such arguments can explain the significance of expert testimony; they can point out logical errors in the opponents' stories; and they can win the jurors' by persuading them that the more interesting story0́4the more natural story, the story that fits their own experiences best0́4is the truthful story.Malone and Radler bring it all together here for the busy attorney who does not need a treatise but who does need sound and brief advice. All of the most important rules are covered so that attorneys will feel confident that they are on sound ethical and legal ground. This is a book to keep handy in your trial bag if you are serious about doing it right.

Book excerpt: In a book that itself exemplifies the dialogic scholarship it proposes, Kay Halasek reconceives composition studies from a Bakhtinian perspective, focusing on both the discipline's theoretical assumptions and its pedagogies. Framing her discussions at every level of the discipline--theoretical, historical, pedagogical--Halasek provides an overview of portions of the Bakhtinian canon relevant to composition studies, explores the implications of Mikhail Bakhtin's work in the teaching of writing and for current debates about the role of theory in composition studies, and provides a model of scholarship that strives to maintain dialogic balance between practice and theory, between composition studies and Bakhtinian thought. Halasek's study ranges broadly across the field of composition, painting in wide strokes a new picture of the discipline, focusing on the finer details of the rhetorical situation, and teasing out the implications of Bakhtinian thought for classroom practice by examining the nature of critical reading and writing, the efficacy and ethics of academic discourse, student resistance, and critical and conflict pedagogy. The book ends by setting out a pedagogy of possibility, what Halasek terms elsewhere a "post-critical pedagogy" that redefines and redirects current discussions of home versus academic literacies and discourses.
