Book excerpt: This book draws on the analytical framework of New Institutional Economics (NIE) to critically examine the role which law and the legal system play in economic development. Analytical concepts from NIE are used to assess policies which have been supported by multilateral development organisations including securing private property rights, reform of the legal system and financial development. The importance of culture in shaping the legal environment, which in turn influences financial sector development, is also assessed using Oliver Williamson’s ‘levels of social analysis’ framework.

Book excerpt: The book examines the theory and practice of law and development. It reviews the evolution of law and development studies and presents a general theory of law and development. The general theory sets the conceptual parameters of "law" and "development" and explains the mechanisms by which law impacts development. In the second part, the book applies the general theory to analyze the development cases of South Korea and South Africa from legal and institutional perspectives. The book also adopts, for the first time, the law and development approaches to analyze the economic issues of the United States. It discusses why it is critical to develop the Analytical Law and Development Model or "ADM."

Available in PDF, EPUB and Kindle. Book excerpt: This book is a major stocktaking of law and economics in the context of developing and emerging economies, and in the light of the dramatic changes in the global economy that we have witnessed in recent years. The rise of artificial intelligence, digital technology, and mega platforms that collect data and facilitate trade is changing the landscape of economics. Rapid globalization has created new challenges for law and regulation, since increasingly contentious cases arise which span multiple countries and several legal jurisdictions. All these changes are giving rise to new problems in developing countries where many people lead precarious lives anyway, healthcare is minimal, and corruption widespread. Alongside these global developments, the discipline of law and economics is also undergoing profound changes, making us re-think some of the founding assumptions of the subject.

Book excerpt: The Cost of Crime provides estimates of the annual cost of crime in the United States. A better understanding of the repercussions of crime could guide the prioritization of law enforcement, education, and social programs that deter criminal activity. Traditional measures of criminal activity count crimes or estimate direct costs that typically include the costs of policing, corrections, criminal justice, and replacing stolen merchandise. This study estimates the burden of a broad set of crime's repercussions, both direct and indirect, to tell a more complete story. This study places less emphasis on imprecise counts of crimes than most previous measures of crime's burden. The comprehensive approach adopted here captures several types of cost shifting that can result from crime prevention efforts. The inclusion of private crime prevention expenditures in this study captures the potential for public expenditures to reduce total societal outlays for crime, with or without a decrease in the crime rate. The comprehensive scope of this study also accounts for regional shifts in crime. This study examines costs for the entire nation, which accounts for the possibility of losses in one region of the United States substituting for losses in another. For the purposes of this research, the cost of crime is defined to include all costs that would not exist in the absence of illegal behavior under current law. The benchmark in this study is perfect compliance with the law. The Cost of Crime speaks to the benefits of cooperation and ethical behavior. In the ideal state of voluntary legal compliance, there would be no need for expenditures on crime prevention, no costly repercussions of criminal acts, and no losses due to fear and distrust. We will not reach that ideal state, but with knowledge of the full cost of crime, we also know the benefit of eliminating a more realistic fraction of that cost. Valid questions remain regarding the inclusion of particular cost components in the calculation of crime's burden. The approach here is to sidestep unsolvable debates by providing itemized lists of crime-cost elements. This enables the reader to adopt customized formulations for the cost of crime.

It is aimed at undergraduate economics students who are interested in law and organization, law students who want to know the economic basis for the law, and students in business and public policy schools who want to understand the economic approach to law and organization. The book covers such diverse topics as bankruptcy rules, corporate law, sports rules, the organization of Congress, federalism, intellectual property, crime, accident law, and insurance. Unlike other texts on the economic analysis of law, this text is not organized by legal categories but by economic theory. The purpose of the book is to develop economic intuition and theory to a sufficient degree so that one can apply the ideas to a variety of areas in law and organization.

Book excerpt: Financial crises have become an all too common occurrence over the past twenty years, largely as a result of changes in finance brought about by increasing internationalization and integration. As domestic financial systems and economies have become more interlinked, weaknesses can significantly impact not only individual economies but also markets, financial intermediaries, and economies around the world. This volume addresses the twin objectives of financial development in the context of financial stability and the role of law in supporting both. Financial stability (frequently seen as the avoidance of financial crisis) has become an objective of both the international financial architecture and individual economies and central banks. At the same time, financial development is now seen to play an important role in economic growth. In both financial stability and financial development, law and related institutions have a central role.

Available in PDF, EPUB and Kindle. Book excerpt: This book is a collection of essays that identify and analyze a new phase in thinking about the role of law in economic development and in the practices of development agencies that support law reform. The authors trace the history of theory and doctrine in this field, relating it to changing ideas about development and its institutional practices. The essays describe a new phase in thinking about the relation between law and economic development and analyze how this rising consensus differs from previous efforts to use law as an instrument to achieve social and economic progress. In analyzing the current phase, these essays also identify tensions and contradictions in current practice. This work is a comprehensive treatment of this emerging paradigm, situating it within the intellectual and historical framework of the most influential development models since World War II.
