Book excerpt: International investment law is relational. It is about how we define and govern the relationship between the actors involved in and affected by foreign investment projects. Most international investment law literature confirms the relational nature of this field. The scholarship has analyzed the resolution of specific disputes and the regulatory relationship between foreign investors and host states. As could be expected, some of the key issues that have emerged include states' right to regulate, the risk of regulatory chill, and how to review state regulation. There is, however, an important blind spot in this relational approach. A look at many foreign investment disputes, particularly in the natural resource extraction sector, shows that local communities are also central protagonists of foreign investment projects. These communities have a lot at stake but have remained almost invisible to the international investment regime. Apart from the ability to submit amicus curiae briefs, they have neither rights nor remedies in this regime. This essay discusses international investment law from an inclusive relational perspective, and shows how, contrary to this perspective, recent awards in investor-state dispute settlement continue to render invisible local communities and their rightful aspirations.

Book excerpt: After the conquest of Mexico, colonial authorities attempted to enforce Christian beliefs among indigenous peoples—a project they envisioned as spiritual warfare. The Invisible War assesses this immense but dislocated project by examining all known efforts in Central Mexico to obliterate native devotions of Mesoamerican origin between the 1530s and the late eighteenth century. The author's innovative interpretation of these efforts is punctuated by three events: the creation of an Inquisition tribunal in Mexico in 1571; the native rebellion of Tehuantepec in 1660; and the emergence of eerily modern strategies for isolating idolaters, teaching Spanish to natives, and obtaining medical proof of sorcery from the 1720s onwards. Rather than depicting native devotions solely from the viewpoint of their colonial codifiers, this book rescues indigenous perspectives on their own beliefs. This is achieved by an analysis of previously unknown or rare ritual texts that circulated in secrecy in Nahua and Zapotec communities through an astute appropriation of European literacy. Tavárez contends that native responses gave rise to a colonial archipelago of faith in which local cosmologies merged insights from Mesoamerican and European beliefs. In the end, idolatry eradication inspired distinct reactions: while Nahua responses focused on epistemological dissent against Christianity, Zapotec strategies privileged confrontations in defense of native cosmologies.

Beginning by discussing the need to demarcate space by creating 'invisible lines' - which give certainty to what extent authority over land can be established - the book then explores legal and theoretical definitions of 'land' and 'property' and looks at the various different policies and forms of land tenure. One of the most recent developments in land reform policy has been to look to traditional forms of access to land and of resource conservation. But a more pressing dilemma presents itself - the dilemma that community, as a valid and meaningful social construct, is losing relevance. Community represents the best of what people can accomplish when they work together. But in practice, community is irreconcilable with prevailing economic, political and social trends. When I was younger, I believed that it was possible to develop a political framework and from that political framework could and would emerge the complementary and supportive social and civic institutions necessary to support, protect and evolve that framework. I have come to believe that politics, institutional arrangements, and social organization instead follow from the dominant economy. As such, in an economy dominated by attributes dependent upon a pliant, mobile workforce, there is little practical tolerance for social organization beyond the individual, the family and church groups. It is my sincere hope that this book serves as a wake-up call to the valuable attributes of community as a social construct, but also how community is a necessary predicate to popular democracy - the preservation of which should represent a cause that we treat as a valuable legacy, instead of an underlying social circumstance we all take for granted while all its meaning and relevance is slowly being dismantled.

As the glittering skyline in Shanghai seemingly attests, China has quickly transformed itself from a place of stark poverty into a modern, urban, technologically savvy economic powerhouse. But as Scott Rozelle and Natalie Hell show in Invisible China, the truth is much more complicated and might be a serious cause for concern. China’s growth has relied heavily on unskilled labor. Most of the workers who have fueled the country’s rise come from rural villages and have never been to high school. While this national growth strategy has been effective for three decades, the unskilled wage rate is finally rising, inducing companies inside China to automate at an unprecedented rate and triggering an exodus of companies seeking cheaper labor in other countries. Ten years ago, almost every product for sale in an American Walmart was made in China. Today, that is no longer the case. With the changing demand for labor, China seems to have no good back-up plan. For all of its investment in physical infrastructure, for decades China failed to invest enough in its people. Recent progress may come too late.
