The fact of its being patented first in a foreign country does not debar its being patented here. Citizens and foreigners alike can secure patents in this. Country, and on the same terms. Joint inventors are entitled to a joint patent: neither one can claim a patent separately but the independent in ventors of separate and independent improvements in the same machine cannot obtain a joint patent for their separate inventions, nor does the fact that one man furnishes the capital and the other makes the invention eh-r title them to make application as joint inventors. In such cases the patent should be applied for in the name of the inventor alone, who may, however, assign any part or the whole of his rights during the prosecution of his application and before the issue of the patent.
