Book excerpt: This report examines how well the Independent Police Complaints Commission (IPCC) is managing its resources, the adequacy of the IPCC's quality assurance arrangements and how far the IPCC has sought to assess the impact of its work. Complaints against the police of a serious nature requiring IPCC involvement led to it opening 100 independent investigations in 2007-08, compared to 31 in 2004-05. The IPCC also received 4,141 appeals about local police investigations which was a four-fold increase on the number in 2004-05. As a result of its increasing workload, the IPCC has found itself working at above full capacity. The IPCC has no formal quality control framework in place. The IPCC's Commissioners have not been formally approving all investigation reports, one of their key responsibilities. Public confidence in the police complaints system is essential. While the IPCC has commissioned research to look at levels of public confidence in the complaints system, it has not sought the views of complainants, police officers and appellants about their experiences of the IPCC's processes. The absence of feedback from those who have had direct experience of dealing with the IPCC is a significant oversight which the IPCC is now rectifying. There is a lack of clarity about who has responsibility for monitoring the implementation of IPCC recommendations. The IPCC accepts responsibility for recording each police force's acceptance or rejection of the recommendations following an investigation, but not for monitoring the implementation of the recommendations. The IPCC has, therefore, only limited evidence on the impact of its work.

Editor Brian D. Fitch brings together the works of a diverse task force with a vested interested in reducing officer misconduct—including law enforcement scholars, educators, and practitioners from a variety of disciplines—to present a comprehensive look at this critical subject that is gaining more attention in agencies and in the media today. The text covers topics on the roles of culture, environment, social learning, policy, and reward systems as they pertain to law enforcement ethics, as well as the ethics of force, interrogations, marginality, and racial profiling. This volume also covers several unique aspects of ethics, such as the role of Post-Traumatic Stress Disorder in misconduct (PTSD), cheating during law enforcement promotional practices, off-duty misconduct, and best practices in developing countries.

Book excerpt: The book will explore the impact of the Lawrence Report since it was published in 1999. Upon publication, Home Secretary Jack Straw promised that the Macpherson Inquiry would lead to real change in the policing of minority ethnic communities in Britain. Several senior police officers made similar pledges and insisted that the benchmark against which their commitment should be judged should be the extent to which progress was made 'on the ground'. In the aftermath of the report a host of initiatives have addressed issues ranging from police liaison with victims, first aid training, to stop and search procedures and police complaints. As well as exploring the many ways in which the Lawrence Report has impacted on the police service and on society more widely this collection assesses the extent to which, in retrospect, the Macpherson Inquiry has led to significant changes to policing, and highlights areas where future efforts ought to be concentrated.

Available in PDF, EPUB and Kindle. Book excerpt: On 15 April 1989, ninety-six spectators lost their lives at Sheffield's Hillsborough Stadium as they gathered for an FA Cup semi-final match between Liverpool and Nottingham Forest. The events of that spring afternoon sparked a controversy that continues to reverberate through British football and policing to this day. Norman Bettison, a Chief Inspector in the South Yorkshire Police at the time of the Hillsborough disaster, witnessed the tragedy as a spectator at the match. Since then, he has found himself one of the focal points of outrage over the actions of the police. Comments he made in the wake of the Hillsborough Independent Panel in 2012 stoked further criticism in the press and in Parliament and, in October 2012, he resigned from his job as Chief Constable of West Yorkshire Police. This personal account describes how the Hillsborough disaster unfolded, provides an insight into what was happening at South Yorkshire Police headquarters in the aftermath, and gives an objective and compassionate account of the bereaved families' long struggle for justice, all the while charting the author's journey from innocent bystander to a symbol of a perceived criminal conspiracy. The author is donating his proceeds from the sales of this book to charity.

Available in PDF, EPUB and Kindle. Book excerpt: Media and Entertainment Law presents a contemporary analysis of the law relating to the media and entertainment industry both in terms of its practical application and its theoretical framework. It provides a clear, current and comprehensive account of this exciting subject. Fully updated and revised, this second edition is one of the first texts to contain a full analysis of the Leveson Inquiry and the implications for our press and media that are arising from it. The new edition contains; a new chapter analysing the Defamation Act 2013; the Digital Economy Act 2010 which aimed to toughen up against copyright infringement online and has been subject to parliamentary review since coming into power; and the liability of internet service providers, including recent cases such as Tamiz vs Google 2012, which goes some way to define the extent to which an ISP may or may not be found liable for their bloggers content. With integrated coverage of Scots and Northern Irish law, Media and Entertainment Law also highlights comparisons with similar overseas jurisdictions, such as with the liability of ISPs where there are differences in both US and European law, in order to help students demonstrate an awareness of media laws, which may then influence UK legislation. Looking at key aspects such as TV and radio broadcasting, the print press, the music industry, online news and entertainment and social networking sites, this text provides detailed coverage of the key principles, cases and legislation as well as a critical analysis of regulatory bodies such as OFCOM and the new regulator for the UK's newspapers and magazines (and online editions), the Independent Press Standards Organisation (Ipso). The text also provides the most comprehensive and up to date coverage of the law relating to Intellectual Property law for the entertainment industry with recent changes in EU law relating to performers' rights. Book excerpt: All states are challenged by the need to protect national security while maintaining the rule of law, but the issue is particularly complex in the China–Hong Kong context. This timely and important book explores how China conceives of its national security and the position of Hong Kong. It considers the risks of introducing national security legislation in Hong Kong, and Hong Kong's sources of resilience against encroachments on its rule of law that may come under the guise of national security. It points to what may be needed to maintain Hong Kong's rule of law once China's 50-year commitment to its autonomy ends in 2047. The contributors to this book include world-renowned scholars in comparative public law and national security law. The collection covers a variety of disciplines and jurisdictions, and both scholarly and practical perspectives to present a forward-looking analysis on the rule of law in Hong Kong. It illustrates how Hong Kong may succeed in resisting pressure to advance China's security interests through repressive law. Given China's growing international stature, the book's reflections on China's approach to security have much to tell us about its potential impact on the global political, security, and economic order.

Book excerpt: An outspoken commentator on Malaysia's social and political affairs, Marina Mahathir takes on the issues, ideas and institutions of the day in her latest book, Telling it Straight. She highlights unpalatable truths, derides tired old ways and challenges the status quo. She asks the questions that need to be asked - and is unafraid of proposing solutions. In Telling it Straight, she touches on subjects as diverse as human trafficking, the underclass, flashmobs, Islamic law enforcement, corruption and plain idiocy. She defends the rights of the discriminated, and makes clear her stand for individual integrity and her respect for diversity and dissent. Marina's fortnightly column has been published in The Star newspaper for more than 20 years. Telling it Straight contains the best of her columns published from 2003 to 2012 as well as the original versions of several pieces that were banned, spiked or censored. Her columns are presented thematically, many of them with specially written introductions that provide context to the issues with which they deal. The book also includes a foreword by renowned political scientist and historian Dr Farish Noor. Indispensable to every Malaysian and everyone who wants to know Malaysia, Telling it Straight is a lively exploration into the nation's psyche and a common sense manifesto for a better future.
