Book excerpt: Drawing on human rights discourse and a study of the difficulties faced by religious minority groups (using the Ahmadiyya minority group as a case study), this book presents three interconnected challenges to human rights culture in Indonesia. First, it presents a normative challenge, describing the gap between philosophical and normative principles of human rights on one side and the overall problems and critical issues of human rights at national and local levels on the other. Second, it considers the political problems in developing and strengthening human rights culture. The political challenge addresses the ability (or inability) of the state to guarantee the rights of certain individuals and minority groups. Third, it examines the sociological challenge of majority-minority group relationships in human rights discourse and practices. This book describes the background of human rights in Indonesia and reviews the previous literature on the issue. It also presents a comprehensive review of the discourses about human rights and political changes in contemporary Indonesia. The analysis focuses on how human rights challenges affect the situation of religious minorities, looking in particular at the Ahmadiyya as a minority group that experiences human rights violations such as discrimination, persecution, and violence. The study fills out its treatment of these issues by examining the involvement of actors both from the state and society, addressing also the politics of human rights protection.

Book excerpt: This book responds to the failures of human rights—the way its institutions and norms reproduce geopolitical imbalances and social exclusions—through an analysis of how literary and visual culture can make visible human rights claims that are foreclosed in official discourses. Moore draws on theories of vulnerability, precarity, and dispossession to argue for the necessity of recognizing the embodied and material contexts of human rights subjects. At the same time, she demonstrates how these theories run the risk of reproducing the structural imbalances that lie at the core of critiques of human rights. Pairing conventional human rights genres—legal instruments, human rights reports, reportage, and humanitarian campaigns—with literary and visual culture, Moore develops a transnational feminist reading praxis of five sites of rights and their violation over the past fifty years: UN human rights instruments and child soldiers in Nigerian literature; human rights reporting and novels that address state-sponsored ethnocide in Zimbabwe; the international humanitarian campaigns and disaster capitalism in fiction of Bhopal, India; the work of Médecins Sans Frontières in the Sahel, Afghanistan, Democratic Republic of Congo, and Burma as represented in various media campaigns and in photo/graphic narratives; and, finally, the human rights campaigns, fiction, and film that have brought Indonesia’s history of anti-leftist violence into contemporary public debate. These case studies underscore how human rights norms are always subject to conditions of imaginative representation, and how literature and visual culture participate in that cultural imaginary. Expanding feminist theories of embodied and imposed vulnerability, Moore demonstrates the importance of situating human rights violations not only in the context of neo-liberal development policies but also in relation to the growth of security networks that serve the nation-state often at the expense of the security of specific subjects and populations. In place of conventional victims and agents, the intersection of vulnerability and human rights opens up readings of human rights claims and suffering that are, at once, embodied and shareable, yet which run the risk of cooptation by security rhetoric.

Book excerpt: In 1948 the United Nations adopted the Universal Declaration of Human Rights, and with it a profusion of norms, processes, and institutions to define, promote, and protect human rights. Today virtually every cause seeks to cloak itself in the righteous language of rights. But even so, this universal reliance on the rights idiom has not succeeded in creating common ground and deep agreement as to the scope, content, and philosophical bases for human rights. Makau Mutua argues that the human rights enterprise inappropriately presents itself as a guarantor of eternal truths without which human civilization is impossible. Mutua contends that in fact the human rights corpus, though well meaning, is a Eurocentric construct for the reconstitution of non-Western societies and peoples with a set of culturally biased norms and practices. Mutua maintains that if the human rights movement is to succeed, it must move away from Eurocentrism as a civilizing crusade and attack on non-European peoples. Only a genuine multicultural approach to human rights can make it truly universal. Indigenous, non-European traditions of Asia, Africa, the Pacific, and the Americas must be deployed to deconstruct—and to reconstruct—a universal bundle of rights that all human societies can claim as theirs.

Despite the potential human rights impact of Bank projects—the forced displacement of indigenous peoples resulting from a Bank-financed dam project, for example—the issue of human rights remains marginal in the Bank’s operational practices. Values in Translation analyzes the organizational culture of the World Bank and addresses the question of why it has not adopted a human rights framework. Academics and social advocates have typically focused on legal restrictions in the Bank’s Articles of Agreement. The Protocol gives individuals and groups the ability to bring complaints about rights violations before the UN Committee on Economic, Social, and Cultural Rights. Against this background, this book focuses on the question of how fundamental socio-economic human rights enshrined in international law are defined, interpreted, understood, and implemented. It assesses how effective efforts to realize ESC rights have been and investigates the contemporary challenges obstructing their protection. It sets out the impact of the global financial crisis and austerity measures, the human rights responsibilities of corporations, and trends in the justiciability of those rights at the national and international level. The interrelationship between ESC rights and other legal regimes such as trade and investment law, environmental law, international criminal law, and international humanitarian law is also thoroughly examined.
