Available in PDF, EPUB and Kindle. Book excerpt: The Drugs Offences Handbook provides a comprehensive, focused and concise analysis of the often complex evidential and litigation issues that relate to drugs cases. The law relating to drugs has the broadest span of any specialist area within crime. Evidentially it includes the forensic examination of drugs themselves and evidence linking individuals to drugs, as well as cell site analysis, interrogation of computers and mobile telephones, police powers of search, and the utilisation of police 'expert' witnesses. From a litigation perspective, drugs cases (together with financial crime) make up the vast majority of cases giving rise to money laundering and proceeds of crime issues. In complex supply and importation cases, the financial aspect frequently arises within the evidence as well. Laid out in three broad sections covering Offences, Evidence and Post-conviction, The Drugs Offences Handbook provides expert guidance on key areas such as: - Manufacture and cultivation - Importation - Possession and supply - Police powers of search and seizure - Sentencing and confiscation With reference to all relevant legislation including the Psychoactive Substances Act 2016, the Drugs Act 2005, the Proceeds of Crime Act 2002 as well as analysis of leading cases such as R v Hussain (Shabbir), R v Green and R v Wright, The Drugs Offences Handbook is an essential resource for criminal law practitioners as well as professionals such as drugs agencies, counselling agencies and expert witnesses. Tim Moloney QC, Tom Stevens, Paul Mason, Abigail Bright and Harriet Johnson are all members of Doughty Street Chambers. Steven Bird is the founder and director of Birds Solicitors. The Criminal Practice Series is a series of practical court-style guides covering a number of discrete, specialist areas. They assist users to identify cases, rules and regulations relevant to the specific topic quickly and easily. For more information please visit www.bloomsburyprofessional.com/criminal

Available in PDF, EPUB and Kindle. Book excerpt: This leading textbook places medical decision-making in its legal context and provides practical guidance on the most ethically challenging cases that face the courts. It explains how the Mental Capacity Act works in practice and how the courts and lawyers wrestle with and resolve problems relating to the very essence of life: what is life? what is an acceptable quality of life? what treatment is so burdensome that it should not be attempted? These questions are posed, not in the abstract but, in real – often desperate, often urgent – situations. This is the essential guide for solicitors, barristers and judges specialising in Court of Protection work, clinical negligence, personal injury and human rights. Postgraduate medical ethics students and academics, NHS bodies and local authority professionals, health professionals and administrators in the NHS and private practice and those in Commonwealth countries with an interest in these topics will also find this book an invaluable resource. Medical Treatment: Decisions and the Law offers a readily accessible text for those dealing with the provision of medical treatment to those without capacity and related areas, providing a clear description of procedure as well as practical application of the law. Key developments for the Fourth Edition include: · The impact of the Covid-19 pandemic on decision making in the Court of Protection, particularly in relation to end of life decisions and vaccination · New chapters on two controversial issues: “the Right to Die?” and “Access to Healthcare: Choice” · Expanded chapter on Decisions for Children, covering recent high-profile cases such as Re Gard where continued provision of life sustaining treatment for babies or very young infants was at issue, and addressing the difficult issues around decision making by 16 to 17 year olds · Substantially updated chapter on Going to Court, covering how the incapacitous patient can be supported to participate in decisions about their treatment Discussion of “Escalation of Care” covering matters including NICE guidelines and care pathways and expanded coverage of issues concerning the funding of treatment. This book was released on 2018-03-01 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: Thanks to remarkable advances in modern health care attributable to science, engineering, and medicine, it is now possible to cure or manage illnesses that were long deemed untreatable. At the same time, however, the United States is facing the vexing challenge of a seemingly uncontrolled rise in the cost of health care. Total medical expenditures are rapidly approaching 20 percent of the gross domestic product and are crowding out other priorities of national importance. The use of increasingly expensive prescription drugs is a significant part of this problem, making the cost of biopharmaceuticals a serious national concern with broad political implications. Especially with the highly visible and very large price increases for prescription drugs that have occurred in recent years, finding a way to make prescription medicinesâ€"and health care at largeâ€"more affordable for everyone has become a socioeconomic imperative. Affordability is a complex function of factors, including not just the prices of the drugs themselves, but also the details of an individual's insurance coverage and the number of medical conditions that an individual or family confronts. Therefore, any solution to the affordability issue will require considering all of these factors together. The current high and increasing costs of prescription drugsâ€"coupled with the broader trends in overall health care costsâ€"is unsustainable to society as a whole. Making Medicines Affordable examines patient access to affordable and effective therapies, with emphasis on drug pricing, inflation in the cost of drugs, and insurance design. This report explores structural and policy factors influencing drug pricing, drug access programs, the emerging role of comparative effectiveness assessments in payment policies, changing finances of medical practice with regard to drug costs and reimbursement, and measures to prevent drug shortages and foster continued innovation in drug development. It makes recommendations for policy actions that could address drug price trends, improve patient access to affordable and effective treatments, and encourage innovations that address significant needs in health care.

Available in PDF, EPUB and Kindle. Book excerpt: What does the UK's exit from the EU mean for health and the NHS? This book explains the legal and practical implications of Brexit on the NHS: its staffing; especially on the island of Ireland; medicines, medical devices and equipment; and biomedical research. It considers the UK's post-Brexit trade agreements and what they mean for health, and discusses the effects of the COVID-19 pandemic on post-Brexit health law. To put the legal analysis in context, the book draws on over 400 conversations the authors had with people in the north of England and Northern Ireland, interviews with over 40 health policy stakeholders, details of a film about their research made with ShoutOut UK, the authors' work with Parliaments and governments across the UK, and their collaborations with key actors like the NHS Confederation, the British Medical Association, and Cancer Research UK. The book shows that the language people use to talk about hoped-for legitimate post-Brexit health governance suggests a great deal of faith in law and legal process among 'ordinary people', but the opposite from 'insider elites'. Not What The Bus Promised puts the authors' knowledge and experiences centre frame, rather than claiming to express 'objective reality'. It will be of interest to any reader who cares about the NHS and wants to understand its present and future.
