EC note: These Regulations are made in exercise of the powers in order to address failures of retained EU law to operate effectively and other deficiencies. The functioning of the EU Emissions Trading Scheme ("EU ETS") depends on the monitoring and reporting of emissions by participants for each scheme year. It also requires the surrender by participants of a corresponding number of allowances in relation to their emissions for each scheme year. The issuing and surrender of allowances is dependent on EU systems and infrastructure, as such that aspect of the scheme will cease to apply to UK operators after the 2018 Scheme year in a no deal scenario. The monitoring, reporting, accreditation and verification obligations will continue to apply.

Book excerpt: Bringing together leading experts from across the UK and Europe, this book provides a comprehensive analysis of the impact of Brexit on the energy sector in the UK and in the European Union and its Member States. In recent decades, the trend within the EU has been towards greater integration and liberalisation of energy markets. Through the development of the Union’s internal energy market and the funding of cross-border energy infrastructure, EU membership facilitates cross-border trade in energy, promotes security of energy supply, and, via the European Atomic Energy Community (Euratom), allows EU Member States to trade in nuclear material for energy production. Brexit changes all of this. The significant level of integration and interdependence in EU energy policy means that the UK’s departure from the Union poses many challenges for the UK, the EU, and EU Member States. While certain energy-related arrangements have been addressed, the relationship between the UK and EU in the energy sector has been changed fundamentally. In this context, important and interrelated questions arise, such as the following: Under what terms will energy trading between the EU and UK now take place? What access will the UK have to EU energy markets? What does Brexit mean for the security of energy supply? What does the UK’s departure from Euratom mean for nuclear research? Can the crossborder single energy market (SEM) on the island of Ireland continue following Brexit? What implications does Brexit have for renewables, the environment, and climate change? Brexit comes at a time when the European energy sector is undergoing the processes of decarbonisation and energy transition. This book offers researchers, legal practitioners, and policy advisers in-depth understanding of the interplay between these challenges and Brexit.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines how the EU can be a more proactive actor in the promotion of the principles of sustainability and fairness from a legal environmental perspective. The book is one of the results of the research activity of the Jean Monnet Chair in EU Environmental Law (2017-2020) funded by the European Commission under the Erasmus+ programme. The European Union and Global Environmental Protection: Transforming Influence into Action begins with an introduction of the key EU competences, instruments and mechanisms, as well as the current international challenges at the EU level. It then explores case study examples from four regulated fields: climate change, biodiversity, multilateral trade, unregulated fishing, and access to justice; and four unregulated areas: mainstreaming of the Sustainable Development Goals in EU policies, and environmental justice, highlighting the extent to which the EU might align with international environmental regimes or extend its normative power. This volume will be of great relevance to students, scholars, and EU policy makers with an interest in international environmental law and policy.

Available in PDF, EPUB and Kindle. Book excerpt: The world is currently undergoing an historic energy transition, driven by increasingly stringent decarbonisation policies and rapid advances in low-carbon technologies. The large-scale shift to low-carbon energy is disrupting the global energy system, impacting whole economies, and changing the political dynamics within and between countries. This open access book, written by leading energy scholars, examines the economic and geopolitical implications of the global energy transition, from both regional and thematic perspectives. The first part of the book addresses the geopolitical implications in the world’s main energy-producing and energy-consuming regions, while the second presents in-depth case studies on selected issues, ranging from the geopolitics of renewable energy, to the mineral foundations of the global energy transformation, to governance issues in connection with the changing global energy order. Given its scope, the book will appeal to researchers in energy, climate change and international relations, as well as to professionals working in the energy industry.

Available in PDF, EPUB and Kindle. Book excerpt: This book assesses the consequences of Brexit for the control of illicit trade in tobacco products in the UK and EU. Based on the currently applicable legal framework, it examines the significance of a possible non-application of the acquis communautaire in the UK in matters relating to anti-illicit trade in tobacco legislation. It also analyses the modes of future cooperation between the UK and the EU in this area, as well as possible regulatory scenarios and their consequences. The book comprises six main sections. After the introduction (Section 1), Section 2 discusses the state of play of Brexit and possible outcomes of Article 50 of the Treaty of European Union procedure. Section 3 illustrates the data and trends of illicit tobacco trade in the UK. Section 4 describes the relevant legal (e.g. trade and fiscal measures) and enforcement frameworks in the UK and suggests possible post-Brexit scenarios in control of tobacco illicit trade. Section 5 focuses on the relevance of arrangements between governments and the tobacco industry in the control of illicit trade. Section 6 then analyses the relevance of key EU and global anti-illicit trade initiatives. Lastly, Section 7 the book offers some recommendations and conclusions on how the UK could control illicit trade in tobacco after Brexit.

This book was released on 2011-11-08 with total page 60 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Government and Ofgem are required to report annually to Parliament on the availability of electricity and gas for meeting the reasonable demands of consumers in Great Britain. This is the second annual report of this title [previously known as "Energy markets outlook"]. This is a technical report focusing on gas and electricity. Other fuels (coal, nuclear fuel, renewables) are also mentioned in the electricity chapter in the context of electricity generation. A chapter on oil is included for completeness though not a statutory requirement. The projection of peak demand for electricity remains at 60GW whilst generation capacity stands at 90.2GW. However, the coming decade will see many changes in the electricity markets, with the closure of a number of coal and oil fired plant that are considered too polluting by modern standards, and nuclear plant that are scheduled to come to the end of their working lives. New plant being built or going through the planning process, and renewable projects will replace the capacity due to close with cleaner technologies, enhance security of supply. The security of gas supply is in the short to medium term broadly benign in the near term, though it is not risk-free. It is the medium to long term that will be challenging. Whilst UK production is forecast to decline, there is an increasingly large and diverse range of import sources on which to draw. The report also looks at the security of supply of oil. Transport accounted for 75 per cent of final consumption of oil products in 2010. Significant reductions in oil demand are not expected over the next 20 years as the transport sector is the main consumer of oil and will continue to be heavily dependent on it over this period. UK oil production is declining and oil imports are forecast to increase in response to this decline.

Book excerpt: This new Sixth Edition of a major work by the well-known competition law team at Van Bael & Bellis in Brussels brings the book up to date to take account of the many developments in the case law and relevant legislation that have occurred since the Fifth Edition in 2010. The authors have also taken the opportunity to write a much-extended chapter on private enforcement and a dedicated section on competition law in the pharmaceutical sector. As one would expect, the new edition continues to meet the challenge for businesses and their counsel, providing a thoroughly practical guide to the application of the EU competition rules. The critical commentary cuts through the theoretical underpinnings of EU competition law to expose its actual impact on business. In this comprehensive new edition, the authors examine such notable developments as the following: important rulings concerning the concept of a restriction by object under Article 101; the extensive case law in the field of cartels, including in relation to cartel facilitation and price signalling; important Article 102 rulings concerning pricing and exclusivity, including the Post Danmark and Intel judgments, as well as standard essential patents; the current block exemption and guidelines applicable to vertical agreements, including those applicable to the motor vehicle sector; developments concerning online distribution, including the Pierre Fabre and Coty rulings; the current guidelines and block exemptions in the field of horizontal cooperation, including the treatment of information exchange; the evolution of EU merger control, including court defeats suffered by the Commission and the case law on procedural infringements; the burgeoning case law related to pharmaceuticals, including concerning reverse payment settlements; the current technology transfer guidelines and block exemption; procedural developments, including in relation to the right to privacy, access to file, parental liability, fining methodology, inability to pay and hybrid settlements; the implementation of the Damages Directive and the first interpretative rulings. As a comprehensive, up-to-date and above all practical analysis of the EU competition rules as developed by the Commission and EU Courts, this authoritative new edition of a classic work stands alone. Like its predecessors, it will be of immeasurable value to both business persons and their legal advisers.
