The monitoring of the implementation of the Human Rights Act is the subject of chapter 4, while chapter 5 covers work in relation to institutional support for human rights within the UK. The inquiries into the international treaties to which the UK is a party are dealt with in chapter 6, including the Convention on the Rights of the Child, the International Covenant on Economic Social and Cultural Rights, and the Convention on the Elimination of Racial Discrimination. The final chapter describes the work undertaken on monitoring action taken by the Government in response to incompatibilities with Convention rights, arising from Strasbourg judgments and declarations of incompatibility by UK courts.

Amongst its conclusions are a concerned that departments have failed to honour fully their undertaking to provide specific Code exemption when they failed to give answers on public interest grounds. The Committee will monitor the effect of the Freedom of Information Act but believes that Cabinet Office guidance is inconsistent with earlier practice and should be reconsidered. The Committee also recommend that there should be an annual report of departmental performance on named-day questions and they strongly deplore and attempt to use the new arrangements of dealing with Questions before Prorogation as a means of avoiding answering a Question.

PASC started the investigation after recent resignation of the former Secretary of State for Defence, the Rt Hon Dr Liam Fox: regrettably the then independent adviser Sir Philip Mawer was not consulted in the course of the events leading up to the resignation of Liam Fox. The retirement of Sir Philip shortly after the resignation of Dr Fox provided an opportunity to demonstrate the value the Prime Minister places on having complaints against Ministers investigated in a demonstrably independent way, but this opportunity was missed and the appointment of Sir Alex only became public knowledge after the event.
