Book excerpt: This essay will explore the future of U.S. intellectual property laws for the fashion industry in five major segments. First, in order to envision the future, the first chapter will look at the past and current issues of what intellectual property laws offer fashion designs and designers in the U.S. Then, in an attempt to have an insight into the benefits and weaknesses of the current U.S. laws in this field, the second chapter will look at the problems with trademark by looking at the Louis Vuitton Malletier v. My Other Bag decision. The third chapter will look at the transition of unsuccessful copyright cases in the fashion industry in the past to the momentous decision made by the U.S. Supreme Court in Star Athletica v. Varsity Sports. The following chapter will weigh the arguments for and against stronger copyright enforcement for fashion articles, and how trademark will be impacted by such enforcement or lack of enforcement. These chapters will not only look at the impact of enforcing copyrights for designers and brands, but also for consumers and the fashion industry as a whole. Finally, taking the previous chapter in consideration, the last chapter will attempt to conceive a policy that would be the most beneficial to both the producers and consumers in the fashion industry.
